AMENDMENT TO SENATE BILL 693

2    AMENDMENT NO. ______. Amend Senate Bill 693 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Waterway Ports Commission Act is
5amended by changing Sections 5, 10, and 15 as follows:
 
6    (70 ILCS 1816/5)
7    Sec. 5. Creation; membership; administrative support.
8    (a) The Illinois Waterway Ports Commission is hereby
9created. The Commission shall exercise jurisdiction with
10respect to the duties and powers delegated to it under this Act
11within the following port districts and counties: the Seneca
12Regional Port District, the Ottawa Port District, the Illinois
13Valley Regional Port District, the Heart of Illinois Regional
14Port District, and the Havana Port District and Fulton, Mason,
15Tazewell, Peoria, Woodford, Marshall, Putnam, Bureau, LaSalle,
16and Grundy counties.

1    (b) The Commission shall consist of the following 9
2appointed members:
3        (1) a member appointed by the Chairperson of the Board
4    of the Seneca Regional Port District, appointed by the
5    Chairperson of the Board;
6        (2) a member appointed by the Chairperson of the Board
7    of the Ottawa Port District, appointed by the Chairperson
8    of the Board;
9        (3) a member appointed by the Chairperson of the Board
10    of the Illinois Valley Regional Port District, appointed
11    by the Chairperson of the Board;
12        (4) a member appointed by the Chairperson of the Board
13    of the Heart of Illinois Regional Port District, appointed
14    by the Chairperson of the Board;
15        (5) a member appointed by the Chairperson of the Board
16    of the Havana Regional Port District, appointed by the
17    Chairperson of the Board;
18        (6) a member from a not-for-profit organization that
19    assists with local government planning within the northern
20    territory of the Commission, appointed by the majority
21    vote of the chairpersons of the Seneca Regional Port
22    District, Ottawa Port District, Illinois Valley Regional
23    Port District, Heart of Illinois Regional Port District,
24    and Havana Regional Port District;
25        (7) a member appointed by the Tri-County Regional
26    Planning Commission from the Tri-County Regional Planning

1    Commission;
2        (8) a member from a not-for-profit organization that
3    assists with local government planning within the southern
4    territory of the Commission, appointed by the majority
5    vote of the chairpersons of the Seneca Regional Port
6    District, Ottawa Port District, Illinois Valley Regional
7    Port District, Heart of Illinois Regional Port District,
8    and Havana Regional Port District;
9        (9) a member that is recommended by the Chairperson of
10    the Board of the Heart of Illinois Regional Port District
11    and appointed by the majority vote of the chairpersons of
12    the Seneca Regional Port District, Ottawa Port District,
13    Illinois Valley Regional Port District, Heart of Illinois
14    Regional Port District, and Havana Regional Port District.
15    The members shall be appointed no later than 90 days after
16the effective date of this Act. The members shall hold office
17for a period of 6 years, or until a successor has been
18appointed, and the members shall serve without compensation.
19At the expiration of the term of an appointed member, the
20person, organization, chairperson, or chairpersons who
21appointed the member shall appoint a successor who shall hold
22office for 6 years or until a successor has been appointed.
23    (c) The members of the Commission shall elect a
24chairperson of the Commission for a 2-year term after all the
25members are selected. A member of the Commission shall not
26serve more than 2 terms as chairperson.

1    (d) If a vacancy occurs in the Commission membership, the
2vacancy shall be filled in the same manner as the original
3appointment for the remainder of the unexpired term.
4    (e) The Commission shall meet no less than once a year.
5    (f) The Heart of Illinois Regional Port District shall
6provide administrative support and other support to the
7Commission.

10    Sec. 10. Duties. The Commission has the following duties:
11    (1) to coordinate and synchronize common efforts and
12initiatives within the areas over which it has jurisdiction
13under this Act in order to enhance the reporting and benefits
14of statistical data;
15    (2) to make recommendations to the Governor, the General
16Assembly, Congress, and federal agencies on regional issues
17that impact multimodal transportation, economic development,
18environmental sustainability, and climate resiliency within
19the areas over which it has jurisdiction under this Act;
20    (3) to coordinate and synchronize common efforts and
21initiatives with the Mid-America Port Commission and the
22Joliet Regional Port District;
23    (4) to coordinate and synchronize federal activities
24associated with the nonfederal sponsorship and development of
25the M-55 Illinois-Gulf Marine Highway; and

1    (5) to request funding or assist in requesting funding, as
2it deems necessary, for those areas over which it has
3jurisdiction under this Act.

6    Sec. 15. Powers.
7    (a) The Commission may request funding from any federal,
8state, municipal, or local government or any other person or
9organization for purposes of the Commission within the
10Commission's jurisdiction. The individual port districts
11within the Commission's jurisdiction retain authority to
12request funding from any federal, state, municipal, or local
13government or any other person or organization for purposes of
14the individual port districts within the Commission area.
15    (b) The Commission may enter into a memorandum of
16understanding or intergovernmental agreement with the State, a
17unit of local government, or a federal governmental
18organization in the performance of its duties. The Commission
19may not exercise control over an a operation of a port district
20established by any other law except by voluntary agreement
21between the port district and the Commission.
22    (c) The Commission may acquire, purchase, install, lease,
23construct, own, hold, maintain, equip, use, control, or
24operate ports, harbors, waterways, channels, wharves, piers,
25docks, quays, elevators, tipples, compresses, bulk loading and

1unloading facilities, warehouse, dry docks, marine support
2railways, tugboats, ships, vessels, shipyards, shipbuilding
3facilities, machinery and equipment dredges, or any other
4facilities required or incidental to the construction,
5outfitting, dry docking, or repair of ships or vessels, or
6water, air, or rail terminals, or roadways or approaches to
7the facilities or other structures or facilities necessary for
8the convenient use of the same in the aid of commerce,
9including the dredging, deepening, extending, widening, or
10enlarging of any ports, harbors, rivers, channels, or
11waterways, the damming of inland waterways, the establishment
12of a water basin, the acquisition and development of
13industrial sites, or the reclaiming of submerged lands.
14    (d) The Commission may not exercise control over the
15operation of port districts established by any other law of
16the State, except by voluntary agreement between the port
17district and the Commission.
18    (e) (c) The Commission may perform any other act that may
19be useful in performing its duties under Section 10 or powers
20under this Section, including, but not limited to, enhancing
21the reporting and benefits of statistical data.

23    Section 99. Effective date. This Act takes effect upon
24becoming law.".
