SYNOPSIS AS INTRODUCED:

    Amends the Illinois Lottery Law. Provides that the Department of the Lottery shall offer a special instant scratch-off game titled "Epilepsy Quality of Life". Provides that the game commences on January 1, 2024 and shall be discontinued on December 31, 2029. Provides that the operation of the game is governed by the Act and by any rules adopted by the Department. Creates the Epilepsy Quality of Life Fund. Provides that the Department shall award grants to qualified recipients in amounts that are proportionate to the annual budget of each recipient in relation to every other recipient. Provides that during the time that tickets are sold for the Epilepsy Quality of Life game, the Department shall not unreasonably diminish the efforts devoted to marketing any other instant scratch-off lottery game. Provides that the Department may adopt any rules necessary to implement the scratch-off game. Makes a corresponding change in the State Finance Act.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Lottery Law is amended by changing
5Sections 9.3 and 20 and by adding Section 21.15 as follows:
 
6    (20 ILCS 1605/9.3)
7    Sec. 9.3. Expenditure and distribution of lottery
8proceeds.
9    (a) Beginning July 1, 2022, except as provided in Sections
1021.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11, 21.12, and 21.13,
11and 21.15 of this Act and Section 25-70 of the Sports Wagering
12Act, the Department shall distribute all proceeds of lottery
13tickets and shares sold in the following priority and manner:
14        (1) The payment of prizes and retailer bonuses.
15        (2) The payment of costs incurred in the operation and
16    administration of the Lottery, including the payment of
17    sums due to the private manager under the management
18    agreement with the Department and including costs of
19    administering the Lottery sports wagering program pursuant
20    to Section 25-70 of the Sports Wagering Act.
21        (3) On the last day of each month or as soon thereafter
22    as possible, the State Comptroller shall direct and the
23    State Treasurer shall transfer from the State Lottery Fund

1    to the Common School Fund the Department's estimate of net
2    lottery proceeds.
3        (4) If an amount in excess of the annual net lottery
4    proceeds is transferred for a fiscal year, then the
5    Department shall offset the monthly transfers of estimated
6    net lottery proceeds during the following fiscal year by
7    that excess amount. If an amount less than the annual net
8    lottery proceeds is transferred for a fiscal year, then
9    after the related annual fiscal year audit is completed
10    following such fiscal year, the Department shall direct
11    the deposit of any remaining annual net lottery proceeds
12    from such fiscal year, subject to payments under
13    paragraphs (1) and (2), into the Common School Fund as
14    soon thereafter as possible.
15    (b) The net lottery proceeds shall be determined by
16deducting from total annual lottery proceeds the expenditures
17required by paragraphs (1) and (2) of subsection (a). The
18total annual lottery proceeds and annual net lottery proceeds
19shall be determined according to generally accepted accounting
20principles for governmental entities and verified by an annual
21fiscal year audit.

24    Sec. 20. State Lottery Fund.
25    (a) There is created in the State Treasury a special fund

1to be known as the State Lottery Fund. Such fund shall consist
2of all revenues received from (1) the sale of lottery tickets
3or shares, (net of commissions, fees representing those
4expenses that are directly proportionate to the sale of
5tickets or shares at the agent location, and prizes of less
6than $600 which have been validly paid at the agent level), (2)
7application fees, and (3) all other sources including moneys
8credited or transferred thereto from any other fund or source
9pursuant to law. Interest earnings of the State Lottery Fund
10shall be credited to the Common School Fund.
11    (b) The receipt and distribution of moneys under Section
1221.5 of this Act shall be in accordance with Section 21.5.
13    (c) The receipt and distribution of moneys under Section
1421.6 of this Act shall be in accordance with Section 21.6.
15    (d) The receipt and distribution of moneys under Section
1621.7 of this Act shall be in accordance with Section 21.7.
17    (e) The receipt and distribution of moneys under Section
1821.8 of this Act shall be in accordance with Section 21.8.
19    (f) The receipt and distribution of moneys under Section
2021.9 of this Act shall be in accordance with Section 21.9.
21    (g) The receipt and distribution of moneys under Section
2221.10 of this Act shall be in accordance with Section 21.10.
23    (h) The receipt and distribution of moneys under Section
2421.11 of this Act shall be in accordance with Section 21.11.
25    (i) The receipt and distribution of moneys under Section
2621.12 of this Act shall be in accordance with Section 21.12.

1    (j) The receipt and distribution of moneys under Section
221.13 of this Act shall be in accordance with Section 21.13.
3    (j-5) The receipt and distribution of moneys under Section
421.15 of this Act shall be in accordance with Section 21.15.
5    (k) The receipt and distribution of moneys under Section
625-70 of the Sports Wagering Act shall be in accordance with
7Section 25-70 of the Sports Wagering Act.

11    Sec. 21.15. Scratch-off for epilepsy mental health
12counseling, education, and other client-related supportive
13services.
14    (a) The Department shall offer a special instant
15scratch-off game titled "Epilepsy Quality of Life". The game
16shall commence on January 1, 2024, or as soon thereafter, at
17the discretion of the Director, as is reasonably practical,
18and shall be discontinued on December 31, 2029. The operation
19of the game is governed by this Act and by any rules adopted by
20the Department.
21    (b) The Epilepsy Quality of Life Fund is created as a
22special fund in the State treasury. The net revenue from the
23Epilepsy Quality of Life special instant scratch-off game
24shall be deposited into the Fund for appropriation by the
25General Assembly solely to the Department of Human Services

1for the purpose of making grants to not-for-profit entities in
2the State, excluding hospitals, for services provided to
3individuals with epilepsy, including mental health counseling,
4education, and other client-related supportive services. Grant
5funds pertaining to this Section may not be used for
6institutional, organizational, or indirect costs or levies.
7Moneys received for the purposes of this Section from net
8revenue from the special instant scratch-off game must be
9deposited into the Fund. Any interest earned on moneys in the
10Fund must be deposited into the Fund. Moneys appropriated from
11the Fund are intended to augment existing appropriations and
12shall not be used to supplant existing appropriations.
13    For the purposes of this subsection, "net revenue" means
14the total amount for which tickets have been sold less the sum
15of the amount paid out in prizes and the actual administrative
16expenses of the Department solely related to the Epilepsy
17Quality of Life game.
18    (c) The Department shall award grants to qualified
19recipients in amounts that are proportionate to the annual
20budget of each recipient in relation to every other recipient.
21Grant recipients cannot outsource the services provided to
22individuals with epilepsy.
23    (d) During the time that tickets are sold for the Epilepsy
24Quality of Life game, the Department shall not unreasonably
25diminish the efforts devoted to marketing any other instant
26scratch-off lottery game.

1    (e) The Department may adopt any rules necessary to
2implement the provisions of this Section.
 
3    Section 10. The State Finance Act is amended by adding
4Section 5.990 as follows:

6    Sec. 5.990. The Epilepsy Quality of Life Fund.
