AMENDMENT TO HOUSE BILL 5537

2    AMENDMENT NO. ______. Amend House Bill 5537, on page 1, by
3replacing lines 9 through 15 with the following:
4    "(a) General review criteria shall include a requirement
5that all health care facilities, including nursing homes
6operated by a county, but otherwise with the exception of
7skilled and intermediate long-term care facilities licensed
8under the Nursing Home Care Act, provide a Safety Net Impact
9Statement, which shall be filed with an application for a
10substantive project or when the application proposes to
11discontinue a category of service. A Safety Net Impact
12Statement shall also be filed with an application to change
13ownership of a nursing home operated by a county."; and
 
14on page 2, by replacing line 4 with "mental health centers, and
15nursing homes operated by a county."; and
 
16on page 3, by replacing lines 11 through 13 with "Nursing homes

1operated by a county shall also provide the number of the
2facility's Medicaid and Medicare certified beds for the 3
3fiscal years prior to the application."; and
 
4on page 4, by replacing lines 13 through 22 with the following:
5"replies, if any, that were filed.
6    The State Board Staff Report shall also include a
7statement of findings about an application's safety net impact
8when the application:
9        (1) proposes a substantive project at a nursing home
10    operated by a county;
11        (2) includes a change of ownership of a nursing home
12    currently operated by a county; or
13        (3) proposes to discontinue services at a nursing home
14    operated by a county.
15    The findings shall be considered when determining whether
16an application fulfills the public interest requirements of
17this Act."; and
 
18on page 10, by replacing lines 9 through 12 with the following:
19    "If the home was erected after referendum approval by the
20voters of the county, the county nursing home may be leased
21upon the vote of a 3/5 majority of all the members of the
22board.".
