AMENDMENT TO HOUSE BILL 5418

2    AMENDMENT NO. ______. Amend House Bill 5418 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Construction Law is amended by
5changing Section 5-100 as follows:
 
6    (105 ILCS 230/5-100)
7    Sec. 5-100. School maintenance project grants.
8    (a) The State Board of Education is authorized to make
9grants to school districts, regional offices of education,
10intermediate service centers, and special education
11cooperatives established by school districts, without regard
12to enrollment, to be used for school maintenance projects on
13publicly owned property. These grants shall be paid out of
14moneys appropriated for that purpose from the School
15Infrastructure Fund. No grant under this Section for one
16fiscal year shall exceed $50,000, but a school district,

1regional office of education, intermediate service center, or
2special education cooperative may receive grants for more than
3one project during one fiscal year. A school district,
4regional office of education, intermediate service center, or
5special education cooperative must provide local matching
6funds in an amount equal to the amount of the grant under this
7Section. A school district or special education cooperative
8has no entitlement to a grant under this Section.
9    (b) The State Board of Education shall adopt rules to
10implement this Section. These rules need not be the same as the
11rules for school construction project grants or debt service
12grants.
13    The rules may specify: (1) the manner of applying for
14grants; (2) project eligibility requirements; (3) restrictions
15on the use of grant moneys; (4) the manner in which school
16districts, regional offices of education, intermediate service
17centers, and special education cooperatives must account for
18the use of grant moneys; and (5) any other provision that the
19State Board determines to be necessary or useful for the
20administration of this Section.
21    The rules shall specify the methods and standards to be
22used by the State Board to prioritize applications. School
23maintenance projects shall be prioritized in the following
24order:
25        (i) emergency projects;
26        (ii) health/life safety projects;

1        (iii) State Program priority projects;
2        (iv) permanent improvement projects; and
3        (v) other projects.
4    (c) In each school year in which school maintenance
5project grants are awarded, 20% of the total amount awarded
6shall be awarded to a school district with a population of more
7than 500,000, provided that the school district complies with
8the requirements of this Section and the rules adopted under
9this Section.

11    Section 99. Effective date. This Act takes effect upon
12becoming law.".
