1 AMENDMENT TO HOUSE BILL 5359
2     AMENDMENT NO. ______. Amend House Bill 5359 as follows:

3 on page 87, line 14, by replacing "all of part of" with "all or
4 part of"; and

5 on page 87, lines 25 and 26, by replacing "in either" with "in,
6 or within 2 miles of, either"; and

7 on page 88, line 1, immediately after "defined" by inserting
8 "in"; and

9 on page 88, by replacing lines 20 and 21 with "the (i)
10 applicable regional transmission organization or independent
11 transmission system operator and (ii) the applicable
12 transmission utility"; and

13 on page 93, immediately below line 9, by inserting the

1 following:
2             "(2.5) Beginning on the effective date of this
3         amendatory Act of the 103rd General Assembly, the
4         provisions of items (1) and (2) of this subparagraph
5         (Q) shall also apply to any energy storage facility
6         that is selected by the Agency to enter into a contract
7         with an electric utility to provide energy storage
8         resources."; and

9 on page 130, immediately below line 19, by inserting the
10 following:
11             "(3.5) Beginning on the effective date of this
12         amendatory Act of the 103rd General Assembly, the
13         provisions of this subsection (c-10) shall also apply
14         to any energy storage facility that is selected by the
15         Agency to enter into a contract with an electric
16         utility to provide energy storage resources.".
