AMENDMENT TO HOUSE BILL 5289

2    AMENDMENT NO. ______. Amend House Bill 5289 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Human Services Act is
5amended by adding Section 1-41 as follows:
 
6    (20 ILCS 1305/1-41 new)
7    Sec. 1-41. Community-based mental health and substance use
8professionals; coverage for client-centered consultation. The
9Department of Human Services shall reimburse community-based
10mental health and substance use professionals for hours spent
11providing client-centered consultation when it occurs with a
12licensed practitioner of the healing arts as defined in 89
13Ill. Adm. Code 140.453(b)(3). As used in this Section,
14"community-based mental health and substance use professional"
15has the same meaning ascribed to that term in Section 5-52 of
16the Illinois Public Aid Code.

1    Section 10. The Illinois Public Aid Code is amended by
2adding Section 5-52 as follows:
 
3    (305 ILCS 5/5-52 new)
4    Sec. 5-52. Community-based mental health and substance use
5professionals; coverage for client-centered consultation.
6    (a) As used in this Section, "community-based mental
7health and substance use professional" means a licensed
8practitioner of the healing arts as defined in 89 Ill. Adm.
9Code 140.453(b)(3).
10    (b) The medical assistance program, including both the
11fee-for-service and managed care medical assistance programs
12established under this Article, shall reimburse
13community-based mental health and substance use professionals
14for hours spent providing client-centered consultation when it
15occurs with a licensed practitioner of the healing arts. The
16Department shall amend 89 Ill. Adm. Code 140.453 to allow
17client-centered consultation when it occurs with a licensed
18practitioner of the healing arts to be a covered service in
19accordance with the provisions of this subsection.
20    (c) By January 1, 2025, the Department shall submit to the
21Joint Committee on Administrative Rules a rulemaking proposal
22to implement this Section as soon as practicable.
 
23    Section 99. Effective date. This Act takes effect upon
