SYNOPSIS AS INTRODUCED:
 
430 ILCS 115/18 new

    Amends the Illinois Modular Dwelling and Mobile Structure Safety Act. Provides that an installer of manufactured homes must supply a weather radio with specified requirements in each manufactured home installed after 2023. Provides for an annual notice during National Fire Prevention Week to be given by the operator of a mobile home community to replace batteries in weather radios and smoke detectors. Provides installers with immunity from liability for the functionality of weather radios or smoke detectors.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Modular Dwelling and Mobile
5Structure Safety Act is amended by adding Section 18 as
6follows:
 
7    (430 ILCS 115/18 new)
8    Sec. 18. Weather radio requirement.
9    (a) This Section applies to a person that installs a
10manufactured home in a mobile home community after 2023.
11    (b) A person shall supply a weather radio inside each
12manufactured home that the person installs. The weather radio
13must be equipped with the following features:
14        (1) tone alarm activation;
15        (2) specific alert message encoding, or SAME,
16    technology; and
17        (3) public alert standard (CEA-2009) certification.
18    (c) The supplying of a weather radio by a person that
19installs a manufactured home as required by this Section does
20not subject the person to liability for the functionality of
21that weather radio.
22    (d) Each year during National Fire Prevention Week, the
23operator of a mobile home community is encouraged to provide a

1written reminder to the owners of all manufactured homes in
2the mobile home community to replace the batteries in all
3weather radios and smoke detectors contained in their
4manufactured homes. Any reminder, assistance, or instructions
5provided by an operator of a mobile home community concerning
6the function of a weather radio or smoke detector shall not
7subject the operator or an owner or employee of the mobile home
8community to liability for the functionality of that weather
9radio or smoke detector.
