| 2 | | AMENDMENT NO. ______. Amend House Bill 5135 by replacing | 3 | | everything after the enacting clause with the following: | 4 | | "Section 1. This Act may be referred to as the Melanoma | 5 | | Education Law. | 6 | | Section 5. The Acupuncture Practice Act is amended by | 7 | | adding Section 41 as follows: | 8 | | (225 ILCS 2/41 new) | 9 | | Sec. 41. Abnormal skin growth education. | 10 | | (a) In addition to any other requirements under this Act, | 11 | | the following applicants must provide proof of completion of a | 12 | | course approved by the Department in abnormal skin growth | 13 | | education, including training on identifying melanoma: | 14 | | (1) An applicant who submits an application for | 15 | | original licensure on or after January 1, 2026. |

| 1 | | (2) An applicant who was licensed before January 1, | 2 | | 2026 when submitting the applicant's first application for | 3 | | renewal or restoration of a license on or after January 1, | 4 | | 2026. | 5 | | (b) Nothing in this Section shall be construed to create a | 6 | | cause of action or any civil liabilities or to require or | 7 | | permit a licensee or applicant under this Act to practice | 8 | | medicine or otherwise practice outside of the scope of | 9 | | practice of a licensed acupuncturist. | 10 | | (c) A person licensed under this Act may refer an | 11 | | individual to seek care from a medical professional regarding | 12 | | an abnormal skin growth. Neither a person licensed under this | 13 | | Act who completes abnormal skin growth education as a part of | 14 | | the person's continuing education, nor the person's employer, | 15 | | shall be civilly or criminally liable for acting in good faith | 16 | | or failing to act on information obtained during the course of | 17 | | practicing in the person's profession or employment concerning | 18 | | potential abnormal skin growths. | 19 | | Section 10. The Illinois Athletic Trainers Practice Act is | 20 | | amended by adding Section 9.5 as follows: | 21 | | (225 ILCS 5/9.5 new) | 22 | | Sec. 9.5. Abnormal skin growth education. | 23 | | (a) In addition to any other requirements under this Act, | 24 | | the following applicants must provide proof of completion of a |

Neither a person licensed under this | 17 | | Act who completes abnormal skin growth education as a part of | 18 | | the person's continuing education, nor the person's employer, | 19 | | shall be civilly or criminally liable for acting in good faith | 20 | | or failing to act on information obtained during the course of | 21 | | practicing in the person's profession or employment concerning | 22 | | potential abnormal skin growths. | 23 | | Section 15. The Massage Licensing Act is amended by adding | 24 | | Section 68 as follows: |

Abnormal skin growth education. | 3 | | (a) In addition to any other requirements under this Act, | 4 | | the following applicants must provide proof of completion of a | 5 | | course approved by the Department in abnormal skin growth | 6 | | education, including training on identifying melanoma: | 7 | | (1) An applicant who submits an application for | 8 | | original licensure on or after January 1, 2026. | 9 | | (2) An applicant who was licensed before January 1, | 10 | | 2026 when submitting the applicant's first application for | 11 | | renewal or restoration of a license on or after January 1, | 12 | | 2026. | 13 | | (b) Nothing in this Section shall be construed to create a | 14 | | cause of action or any civil liabilities or to require or | 15 | | permit a licensee or applicant under this Act to practice | 16 | | medicine or otherwise practice outside of the scope of | 17 | | practice of a licensed massage therapist. | 18 | | (c) A person licensed under this Act may refer an | 19 | | individual to seek care from a medical professional regarding | 20 | | an abnormal skin growth. Neither a person licensed under this | 21 | | Act who completes abnormal skin growth education as a part of | 22 | | the person's continuing education, nor the person's employer, | 23 | | shall be civilly or criminally liable for acting in good faith | 24 | | or failing to act on information obtained during the course of | 25 | | practicing in the person's profession or employment concerning | 26 | | potential abnormal skin growths. |

| 1 | | Section 20. The Naprapathic Practice Act is amended by | 2 | | adding Section 66 as follows: | 3 | | (225 ILCS 63/66 new) | 4 | | Sec. 66. Abnormal skin growth education. | 5 | | (a) In addition to any other requirements under this Act, | 6 | | the following applicants must provide proof of completion of a | 7 | | course approved by the Department in abnormal skin growth | 8 | | education, including training on identifying melanoma: | 9 | | (1) An applicant who submits an application for | 10 | | original licensure on or after January 1, 2026. | 11 | | (2) An applicant who was licensed before January 1, | 12 | | 2026 when submitting the applicant's first application for | 13 | | renewal or restoration of a license on or after January 1, | 14 | | 2026. | 15 | | (b) Nothing in this Section shall be construed to create a | 16 | | cause of action or any civil liabilities or to require or | 17 | | permit a licensee or applicant under this Act to practice | 18 | | medicine or otherwise practice outside of the scope of | 19 | | practice of a licensed naprapath. | 20 | | (c) A person licensed under this Act may refer an | 21 | | individual to seek care from a medical professional regarding | 22 | | an abnormal skin growth. The Barber, Cosmetology, Esthetics, Hair | 6 | | Braiding, and Nail Technology Act of 1985 is amended by adding | 7 | | Section 1-7.10 as follows: | 8 | | (225 ILCS 410/1-7.10 new) | 9 | | Sec. 1-7.10. Abnormal skin growth education. | 10 | | (a) In addition to any other requirements under this Act, | 11 | | the following applicants must provide proof of completion of a | 12 | | course approved by the Department in abnormal skin growth | 13 | | education, including training on identifying melanoma: | 14 | | (1) An applicant who submits an application for | 15 | | original licensure on or after January 1, 2026. | 16 | | (2) An applicant who was licensed before January 1, | 17 | | 2026 when submitting the applicant's first application for | 18 | | renewal or restoration of a license on or after January 1, | 19 | | 2026. | 20 | | (b) Nothing in this Section shall be construed to create a | 21 | | cause of action or any civil liabilities or to require or | 22 | | permit a licensee or applicant under this Act to practice | 23 | | medicine or otherwise practice outside of the scope of | 24 | | practice of a licensed barber, cosmetologist, esthetician, |

Neither a person licensed under this | 5 | | Act who completes abnormal skin growth education as a part of | 6 | | the person's continuing education, nor the person's employer, | 7 | | shall be civilly or criminally liable for acting in good faith | 8 | | or failing to act on information obtained during the course of | 9 | | practicing in the person's profession or employment concerning | 10 | | potential abnormal skin growths. | 11 | | Section 35. The Electrologist Licensing Act is amended by | 12 | | adding Section 34 as follows: | 13 | | (225 ILCS 412/34 new) | 14 | | Sec. 34. Abnormal skin growth education. | 15 | | (a) In addition to any other requirements under this Act, | 16 | | the following applicants must provide proof of completion of a | 17 | | course approved by the Department in abnormal skin growth | 18 | | education, including training on identifying melanoma: | 19 | | (1) An applicant who submits an application for | 20 | | original licensure on or after January 1, 2026. | 21 | | (2) An applicant who was licensed before January 1, | 22 | | 2026 when submitting the applicant's first application for | 23 | | renewal or restoration of a license on or after January 1, | 24 | | 2026. |

| 1 | | (b) Nothing in this Section shall be construed to create a | 2 | | cause of action or any civil liabilities or to require or | 3 | | permit a licensee or applicant under this Act to practice | 4 | | medicine or otherwise practice outside of the scope of | 5 | | practice of a licensed electrologist. | 6 | | (c) A person licensed under this Act may refer an | 7 | | individual to seek care from a medical professional regarding | 8 | | an abnormal skin growth. Neither a person licensed under this | 9 | | Act who completes abnormal skin growth education as a part of | 10 | | the person's continuing education, nor the person's employer, | 11 | | shall be civilly or criminally liable for acting in good faith | 12 | | or failing to act on information obtained during the course of | 13 | | practicing in the person's profession or employment concerning | 14 | | potential abnormal skin growths. | 15 | | Section 99. Effective date. This Act takes effect upon | 16 | | becoming law.". |
