| 1 | | AN ACT concerning safety. | 2 | | Be it enacted by the People of the State of Illinois, | 3 | | represented in the General Assembly: | 4 | | Section 1. Short title. This Act may be cited as the Small | 5 | | Single-Use Plastic Act. | 6 | | Section 5. Definitions. As used in this Act: | 7 | | "Hotel" has the same meaning ascribed to it in the Hotel | 8 | | Operators' Occupation Tax Act. | 9 | | "Personal care products" means a product intended to be | 10 | | applied to or used on the human body in the shower, bath, or | 11 | | any part thereof and shall include only shampoo, hair | 12 | | conditioner, and bath soap. | 13 | | "Small, single-use plastic bottle" means a plastic bottle | 14 | | or container with less than a 6-ounce capacity that is | 15 | | intended to be nonreusable by the end user | 16 | | Section 10. Small, single-use plastic bottles at hotels. | 17 | | (a) Beginning July 1, 2025, a hotel with 50 rooms or more | 18 | | shall not provide small, single-use plastic bottles containing | 19 | | personal care products in any space within a sleeping room | 20 | | accommodation, within bathrooms shared by the public or | 21 | | guests, or to a customer of the establishment staying in a | 22 | | sleeping room accommodation. |

| 1 | | (b) Beginning January 1, 2026, a hotel shall not provide | 2 | | small, single-use plastic bottles containing personal care | 3 | | products in any space within a sleeping room accommodation, | 4 | | within bathrooms shared by the public or guests, or to a | 5 | | customer of the establishment staying in a sleeping room | 6 | | accommodation. | 7 | | (c) A hotel may provide personal care products in small, | 8 | | single-use plastic bottles to a person at no cost, upon | 9 | | request, at a place other than a sleeping room accommodation, | 10 | | a space within the sleeping room accommodation, or within | 11 | | bathrooms shared by the public or guests. | 12 | | (d) A unit of government, including a Home Rule unit, | 13 | | shall not pass an ordinance, resolution, or rule prohibiting a | 14 | | hotel from providing small, single use plastic bottles | 15 | | containing personal care products to customers. This Act is a | 16 | | denial and limitation of home rule powers and functions under | 17 | | subsection (g) of Section 6 of Article VII of the Illinois | 18 | | Constitution. | 19 | | Section 15. Civil penalties. | 20 | | (a) A hotel in violation of this Act shall receive a | 21 | | written warning for the first violation from the Office of the | 22 | | Attorney General, a State's Attorney, or a municipal attorney. | 23 | | The written warning shall recite the violation and advise that | 24 | | subsequent violations may result in citations and penalties. | 25 | | Upon a second or subsequent violation, the hotel may be liable |

| 1 | | for a civil penalty of $500 for each violation after an action | 2 | | under subsection (b). | 3 | | (b) The Attorney General, a State's Attorney, or municipal | 4 | | attorney may bring an action to request a civil penalty and a | 5 | | court may impose a civil penalty under this Section against a | 6 | | hotel violating this Act. | 7 | | (c) The Attorney General shall adopt rules to implement | 8 | | this Section, including rules establishing jurisdictional | 9 | | authority over violations between the Attorney General, | 10 | | State's Attorneys, and municipal attorneys. |
