AMENDMENT TO HOUSE BILL 4169

2    AMENDMENT NO. ______. Amend House Bill 4169 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Finance Act is amended by adding
5Section 5.1012 as follows:
 
6    (30 ILCS 105/5.1012 new)
7    Sec. 5.1012. The Navy Club Fund.
 
8    Section 10. The Illinois Vehicle Code is amended by
9changing Section 3-699.14 as follows:

13    Sec. 3-699.14. Universal special license plates.
14    (a) In addition to any other special license plate, the

1Secretary, upon receipt of all applicable fees and
2applications made in the form prescribed by the Secretary, may
3issue Universal special license plates to residents of
4Illinois on behalf of organizations that have been authorized
5by the General Assembly to issue decals for Universal special
6license plates. Appropriate documentation, as determined by
7the Secretary, shall accompany each application. Authorized
8organizations shall be designated by amendment to this
9Section. When applying for a Universal special license plate
10the applicant shall inform the Secretary of the name of the
11authorized organization from which the applicant will obtain a
12decal to place on the plate. The Secretary shall make a record
13of that organization and that organization shall remain
14affiliated with that plate until the plate is surrendered,
15revoked, or otherwise cancelled. The authorized organization
16may charge a fee to offset the cost of producing and
17distributing the decal, but that fee shall be retained by the
18authorized organization and shall be separate and distinct
19from any registration fees charged by the Secretary. No decal,
20sticker, or other material may be affixed to a Universal
21special license plate other than a decal authorized by the
22General Assembly in this Section or a registration renewal
23sticker. The special plates issued under this Section shall be
24affixed only to passenger vehicles of the first division,
25including motorcycles and autocycles, or motor vehicles of the
26second division weighing not more than 8,000 pounds. Plates

1issued under this Section shall expire according to the
2multi-year procedure under Section 3-414.1 of this Code.
3    (b) The design, color, and format of the Universal special
4license plate shall be wholly within the discretion of the
5Secretary. Universal special license plates are not required
6to designate "Land of Lincoln", as prescribed in subsection
7(b) of Section 3-412 of this Code. The design shall allow for
8the application of a decal to the plate. Organizations
9authorized by the General Assembly to issue decals for
10Universal special license plates shall comply with rules
11adopted by the Secretary governing the requirements for and
12approval of Universal special license plate decals. The
13Secretary may, in his or her discretion, allow Universal
14special license plates to be issued as vanity or personalized
15plates in accordance with Section 3-405.1 of this Code. The
16Secretary of State must make a version of the special
17registration plates authorized under this Section in a form
18appropriate for motorcycles and autocycles.
19    (c) When authorizing a Universal special license plate,
20the General Assembly shall set forth whether an additional fee
21is to be charged for the plate and, if a fee is to be charged,
22the amount of the fee and how the fee is to be distributed.
23When necessary, the authorizing language shall create a
24special fund in the State treasury into which fees may be
25deposited for an authorized Universal special license plate.
26Additional fees may only be charged if the fee is to be paid

1over to a State agency or to a charitable entity that is in
2compliance with the registration and reporting requirements of
3the Charitable Trust Act and the Solicitation for Charity Act.
4Any charitable entity receiving fees for the sale of Universal
5special license plates shall annually provide the Secretary of
6State a letter of compliance issued by the Attorney General
7verifying that the entity is in compliance with the Charitable
8Trust Act and the Solicitation for Charity Act.
9    (d) Upon original issuance and for each registration
10renewal period, in addition to the appropriate registration
11fee, if applicable, the Secretary shall collect any additional
12fees, if required, for issuance of Universal special license
13plates. The fees shall be collected on behalf of the
14organization designated by the applicant when applying for the
15plate. All fees collected shall be transferred to the State
16agency on whose behalf the fees were collected, or paid into
17the special fund designated in the law authorizing the
18organization to issue decals for Universal special license
19plates. All money in the designated fund shall be distributed
20by the Secretary subject to appropriation by the General
21Assembly.
22    (e) The following organizations may issue decals for
23Universal special license plates with the original and renewal
24fees and fee distribution as follows:
25        (1) The Illinois Department of Natural Resources.
26            (A) Original issuance: $25; with $10 to the

1        Roadside Monarch Habitat Fund and $15 to the Secretary
2        of State Special License Plate Fund.
3            (B) Renewal: $25; with $23 to the Roadside Monarch

6        (2) Illinois Veterans' Homes.
7            (A) Original issuance: $26, which shall be
8        deposited into the Illinois Veterans' Homes Fund.

20    the Roadside Monarch Habitat Fund shall be paid as grants
21    to the Illinois Department of Natural Resources to fund
22    roadside monarch and other pollinator habitat development,
23    enhancement, and restoration projects in this State.
24        (2) The Prostate Cancer Awareness Fund. All money in
25    the Prostate Cancer Awareness Fund shall be paid as grants
26    to the Prostate Cancer Foundation of Chicago.

1        (3) The Horsemen's Council of Illinois Fund. All money
2    in the Horsemen's Council of Illinois Fund shall be paid
3    as grants to the Horsemen's Council of Illinois.
4        (4) The Post-Traumatic Stress Disorder Awareness Fund.
5    All money in the Post-Traumatic Stress Disorder Awareness
6    Fund shall be paid as grants to K9s for Veterans, NFP for
7    support, education, and awareness of veterans with
8    post-traumatic stress disorder.
9        (5) The Guide Dogs of America Fund. All money in the
10    Guide Dogs of America Fund shall be paid as grants to the
11    International Guiding Eyes, Inc., doing business as Guide
12    Dogs of America.
13        (6) The Mechanics Training Fund. All money in the
14    Mechanics Training Fund shall be paid as grants to the
15    Mechanics Local 701 Training Fund.
16        (7) The Theresa Tracy Trot - Illinois CancerCare
17    Foundation Fund. All money in the Theresa Tracy Trot -
18    Illinois CancerCare Foundation Fund shall be paid to the
19    Illinois CancerCare Foundation for the purpose of
20    furthering pancreatic cancer research.
21        (8) The Developmental Disabilities Awareness Fund. All
22    money in the Developmental Disabilities Awareness Fund
23    shall be paid as grants to the Illinois Department of
24    Human Services to fund legal aid groups to assist with
25    guardianship fees for private citizens willing to become
26    guardians for individuals with developmental disabilities

1    but who are unable to pay the legal fees associated with
2    becoming a guardian.
3        (9) The Pediatric Cancer Awareness Fund. All money in
4    the Pediatric Cancer Awareness Fund shall be paid as
5    grants to the Cancer Center at Illinois for pediatric
6    cancer treatment and research.
7        (10) The Folds of Honor Foundation Fund. All money in
8    the Folds of Honor Foundation Fund shall be paid as grants
9    to the Folds of Honor Foundation to aid in providing
10    educational scholarships to military families.
11        (11) The Experimental Aircraft Association Fund. All
12    money in the Experimental Aircraft Association Fund shall
13    be paid, subject to appropriation by the General Assembly
14    and distribution by the Secretary, as grants to promote
15    recreational aviation.
16        (12) The Child Abuse Council of the Quad Cities Fund.
17    All money in the Child Abuse Council of the Quad Cities
18    Fund shall be paid as grants to benefit the Child Abuse
19    Council of the Quad Cities.
20        (13) The Illinois Health Care Workers Benefit Fund.
21    All money in the Illinois Health Care Workers Benefit Fund
22    shall be paid as grants to the Trinity Health Foundation
23    for the benefit of health care workers, doctors, nurses,
24    and others who work in the health care industry in this
25    State.
26        (14) The Future Farmers of America Fund. All money in

1    the Future Farmers of America Fund shall be paid as grants
2    to the Illinois Association of Future Farmers of America.

2        (6) The Mechanics Training Fund. All money in the
3    Mechanics Training Fund shall be paid as grants to the
4    Mechanics Local 701 Training Fund.
5        (7) The Theresa Tracy Trot - Illinois CancerCare
6    Foundation Fund. All money in the Theresa Tracy Trot -
7    Illinois CancerCare Foundation Fund shall be paid to the
8    Illinois CancerCare Foundation for the purpose of
9    furthering pancreatic cancer research.
10        (8) The Developmental Disabilities Awareness Fund. All

12    shall be paid as grants to the Illinois Department of
13    Human Services to fund legal aid groups to assist with

18        (9) The Pediatric Cancer Awareness Fund. All money in
19    the Pediatric Cancer Awareness Fund shall be paid as
20    grants to the Cancer Center at Illinois for pediatric
21    cancer treatment and research.
22        (10) The Folds of Honor Foundation Fund. All money in
23    the Folds of Honor Foundation Fund shall be paid as grants
24    to the Folds of Honor Foundation to aid in providing
25    educational scholarships to military families.
26        (11) The Experimental Aircraft Association Fund. All

1    money in the Experimental Aircraft Association Fund shall
2    be paid, subject to appropriation by the General Assembly
3    and distribution by the Secretary, as grants to promote

6    All money in the Child Abuse Council of the Quad Cities
7    Fund shall be paid as grants to benefit the Child Abuse
8    Council of the Quad Cities.
9        (13) The Illinois Health Care Workers Benefit Fund.
10    All money in the Illinois Health Care Workers Benefit Fund
11    shall be paid as grants to the Trinity Health Foundation
12    for the benefit of health care workers, doctors, nurses,
13    and others who work in the health care industry in this
14    State.
15        (14) The Future Farmers of America Fund. All money in
16    the Future Farmers of America Fund shall be paid as grants
17    to the Illinois Association of Future Farmers of America.
18        (15) The Tick Research, Education, and Evaluation
19    Fund. All money in the Tick Research, Education, and
20    Evaluation Fund shall be paid as grants to the Illinois
21    Lyme Association.
22        (16) The Navy Club Fund. All money in the Navy Club
23    Fund shall be paid as grants to any local chapter of the
24    Navy Club that is located in this State.
