| 2 | | AMENDMENT NO. ______. Amend House Bill 3924 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 5. The School Code is amended by changing Section | 5 | | 27-13.2 as follows:
| 6 | | (105 ILCS 5/27-13.2) (from Ch. 122, par. 27-13.2)
| 7 | | Sec. 27-13.2. Required instruction. | 8 | | (a) In every public school there
shall be instruction, | 9 | | study, and discussion of effective methods by which
pupils may | 10 | | recognize the danger of and avoid abduction, and in every
| 11 | | public school maintaining any of grades kindergarten through | 12 | | 8 , there shall
be, for such grades, instruction, study, and | 13 | | discussion of effective
methods for the prevention and | 14 | | avoidance of drugs and the dangers of opioid and substance | 15 | | abuse.
School boards may
include such required instruction, | 16 | | study , and discussion in the courses of
study regularly taught |

| 1 | | in the public schools of their respective districts;
provided, | 2 | | however, that such instruction shall be given each year to all
| 3 | | pupils in grades kindergarten through 8. The State | 4 | | Superintendent of
Education may prepare and make available to | 5 | | all public and non-public
schools instructional materials | 6 | | which may be used by such schools
as guidelines for | 7 | | development of a program of instruction
under this subsection | 8 | | (a) Section ; provided, however, that each school board shall
| 9 | | itself determine the minimum amount of instruction time which | 10 | | shall qualify
as a program of instruction
which will
satisfy | 11 | | the requirements of this subsection (a) Section .
| 12 | | The State Superintendent of Education, in cooperation with | 13 | | the
Department of Children and Family Services, shall prepare | 14 | | and disseminate
to all public schools and non-public schools, | 15 | | information on instructional
materials and programs about | 16 | | child sexual abuse which may be used by such
schools for their | 17 | | own or community programs. Such information may also be
| 18 | | disseminated by such schools to parents.
| 19 | | (b) Notwithstanding subsection (a) the foregoing | 20 | | provisions of this Section, no pupil in
any of grades | 21 | | kindergarten through 8 shall be required to take or
| 22 | | participate in any class or course providing instruction in | 23 | | recognizing and
avoiding sexual abuse if the parent or | 24 | | guardian of the pupil submits
written objection thereto; and | 25 | | refusal to take or participate in such class
or course after | 26 | | such written objection is made shall not be reason for

| 1 | | failing, suspending or expelling such pupil. Each school board | 2 | | intending
to offer any such class or course to pupils in any of | 3 | | grades kindergarten
through 8 shall give not less than 5 days | 4 | | written notice to the parents or
guardians of such pupils | 5 | | before commencing the class or course.
| 6 | | (c) Beginning with the 2024-2025 school year, in every | 7 | | State-required health course for grades 9 through 12,
a school | 8 | | district shall provide instruction, study, and discussion on | 9 | | the dangers of fentanyl.
Information for the instruction, | 10 | | study, and discussion of fentanyl shall come
from information | 11 | | provided by the National Institutes of Health, the United | 12 | | States Drug
Enforcement Administration, or the United States | 13 | | Department of Health and Human
Services. This instruction, | 14 | | study, and discussion shall include, at a
minimum, all of the | 15 | | following: | 16 | | (1) Information on fentanyl itself, including, an | 17 | | explanation of the differences between synthetic and | 18 | | nonsynthetic opioids and illicit drugs, the variations of | 19 | | fentanyl itself, and the differences between the legal and | 20 | | illegal uses of fentanyl. | 21 | | (2) The side effects and the risk factors of using | 22 | | fentanyl, along with information comparing the lethal | 23 | | amounts of fentanyl to other drugs. Information on the | 24 | | risk factors may include, but is not limited to: | 25 | | (A) the lethal dose of fentanyl; | 26 | | (B) how often fentanyl is placed in drugs without |

| 1 | | a person's knowledge; | 2 | | (C) an explanation of what fentanyl does to a | 3 | | person's body and the severity of fentanyl's addictive | 4 | | properties; and | 5 | | (D) how the consumption of fentanyl can lead to | 6 | | hypoxia, as well as an explanation of what hypoxia | 7 | | precisely does to a person's body; | 8 | | (3) Providing details about the process of lacing | 9 | | fentanyl in other drugs and why drugs get laced with | 10 | | fentanyl. | 11 | | (4) Providing details about how to detect fentanyl in | 12 | | drugs and how to save someone from an overdose of | 13 | | fentanyl, which shall include: | 14 | | (A) how to buy and use fentanyl test strips; | 15 | | (B) how to buy and use naloxone, either through a | 16 | | nasal spray or an injection; and | 17 | | (C) how to detect if someone is overdosing on | 18 | | fentanyl. | 19 | | Students shall be assessed on the instruction required | 20 | | under this subsection (c). The assessment may include, but is | 21 | | not limited to: | 22 | | (1) the differences between synthetic and nonsynthetic | 23 | | drugs; | 24 | | (2) hypoxia; | 25 | | (3) the effects of fentanyl on a person's body; | 26 | | (4) the lethal dose of fentanyl; and |

| 1 | | (5) how to detect and prevent overdoses. | 2 | | The instruction required under this subsection (c) shall | 3 | | be taught by a licensed educator, school

| 6 | | Section 10. The Critical Health Problems and Comprehensive | 7 | | Health
Education Act is amended by changing Section 3 as | 8 | | follows:
| 9 | | (105 ILCS 110/3)
| 10 | | Sec. 3. Comprehensive Health Education Program. The | 11 | | program established
under this Act shall include, but not be | 12 | | limited to, the following major
educational areas as a basis | 13 | | for curricula in all elementary and secondary
schools in this | 14 | | State: human ecology and health; human growth and
development; | 15 | | the emotional, psychological, physiological, hygienic, and
| 16 | | social responsibilities of family life, including sexual | 17 | | abstinence until
marriage; the prevention and control of | 18 | | disease, including instruction in
grades 6 through 12 on the | 19 | | prevention, transmission, and spread of AIDS; age-appropriate | 20 | | sexual abuse and assault awareness and prevention education in | 21 | | grades pre-kindergarten through 12; public and environmental | 22 | | health; consumer health; safety education and
disaster | 23 | | survival; mental health and illness; personal health habits;
| 24 | | alcohol and drug use and abuse, including the medical and |

| 1 | | legal ramifications
of alcohol, drug, and tobacco use; abuse | 2 | | during pregnancy; evidence-based and medically accurate | 3 | | information regarding sexual
abstinence; tobacco and | 4 | | e-cigarettes and other vapor devices; nutrition; and dental | 5 | | health. The instruction on mental health and illness must | 6 | | evaluate the multiple dimensions of health by reviewing the | 7 | | relationship between physical and mental health so as to | 8 | | enhance student understanding, attitudes, and behaviors that | 9 | | promote health, well-being, and human dignity and must include | 10 | | how and where to find mental health resources and specialized | 11 | | treatment in the State. The program shall also provide course | 12 | | material and instruction to advise pupils of the Abandoned | 13 | | Newborn Infant Protection Act.
The program shall include | 14 | | information about cancer, including, without limitation, types | 15 | | of cancer, signs and symptoms, risk factors, the importance of | 16 | | early prevention and detection, and information on where to go | 17 | | for help. Notwithstanding the above educational areas, the | 18 | | following areas may also
be included as a basis for curricula | 19 | | in all elementary and secondary
schools in this State: basic | 20 | | first aid (including, but not limited to,
cardiopulmonary | 21 | | resuscitation and the Heimlich maneuver), heart disease, | 22 | | diabetes, stroke, the
prevention of child abuse, neglect, and | 23 | | suicide, and teen dating violence in grades 7 through 12. | 24 | | Beginning with the 2014-2015 school year, training on how to | 25 | | properly administer cardiopulmonary resuscitation (which | 26 | | training must be in accordance with standards of the American |

| 1 | | Red Cross, the American Heart Association, or another | 2 | | nationally recognized certifying organization) and how to use | 3 | | an automated external defibrillator shall be included as a | 4 | | basis for curricula in all secondary schools in this State. | 5 | | The school board of each
public elementary and secondary | 6 | | school in the State
shall encourage all teachers and other | 7 | | school personnel to acquire,
develop, and maintain the | 8 | | knowledge and skills necessary to properly
administer | 9 | | life-saving techniques, including, without limitation, the
| 10 | | Heimlich maneuver and rescue breathing.
The training shall be | 11 | | in
accordance with standards of the
American Red Cross, the | 12 | | American Heart Association, or another nationally
recognized | 13 | | certifying organization.
A school board may use the
services | 14 | | of non-governmental entities whose personnel have expertise in
| 15 | | life-saving techniques to instruct teachers and other school | 16 | | personnel in
these techniques. Each school board
is encouraged | 17 | | to have in
its employ, or on its volunteer staff, at least one | 18 | | person who is certified, by
the American Red Cross or by | 19 | | another qualified certifying agency,
as qualified to | 20 | | administer first aid and
cardiopulmonary resuscitation. In | 21 | | addition, each school board is authorized to
allocate | 22 | | appropriate portions of its institute or inservice days to | 23 | | conduct
training programs for teachers and other school | 24 | | personnel who have expressed an
interest in becoming qualified | 25 | | to administer emergency first aid or
cardiopulmonary | 26 | | resuscitation. School boards are urged to
encourage their |

| 1 | | teachers and other school personnel who coach school athletic
| 2 | | programs and other extracurricular school activities to | 3 | | acquire, develop, and
maintain the knowledge and skills | 4 | | necessary to properly administer first aid
and cardiopulmonary | 5 | | resuscitation in accordance with standards and requirements
| 6 | | established by the American Red Cross or another qualified | 7 | | certifying agency. Subject to appropriation, the State Board | 8 | | of Education shall establish and administer a matching grant | 9 | | program to pay for half of the cost that a school district | 10 | | incurs in training those teachers and other school personnel | 11 | | who express an interest in becoming qualified to administer | 12 | | cardiopulmonary resuscitation (which training must be in
| 13 | | accordance with standards of the
American Red Cross, the | 14 | | American Heart Association, or another nationally
recognized | 15 | | certifying organization) or in learning how to use an | 16 | | automated external defibrillator. A school district that | 17 | | applies for a grant must demonstrate that it has funds to pay | 18 | | half of the cost of the training for which matching grant money | 19 | | is sought. The State Board of Education shall award the grants | 20 | | on a first-come, first-serve basis.
| 21 | | No pupil shall be
required to take or participate in any | 22 | | class or course on AIDS or family
life instruction or to | 23 | | receive training on how to properly administer cardiopulmonary | 24 | | resuscitation or how to use an automated external | 25 | | defibrillator if his or her parent or guardian submits written | 26 | | objection
thereto, and refusal to take or participate in the |

| 1 | | course or program or the training shall
not be reason for | 2 | | suspension or expulsion of the pupil.
| 3 | | Curricula developed under programs established in | 4 | | accordance with this
Act in the major educational area of | 5 | | alcohol and drug use and abuse shall
include classroom | 6 | | instruction in grades 5 through 12. The instruction,
which | 7 | | shall include matters relating to both the physical and legal | 8 | | effects
and ramifications of drug and substance abuse, shall | 9 | | be integrated into
existing curricula; and the State Board of | 10 | | Education shall develop and make
available to all elementary | 11 | | and secondary schools in this State
instructional materials | 12 | | and guidelines which will assist the schools in
incorporating | 13 | | the instruction into their existing curricula. In
addition, | 14 | | school districts may offer, as part of existing curricula | 15 | | during
the school day or as part of an after school program, | 16 | | support services and
instruction for pupils or pupils whose | 17 | | parent, parents, or guardians are
chemically dependent. | 18 | | Curricula developed under programs established in accordance | 19 | | with this
Act in the major educational area of alcohol and drug | 20 | | use and abuse shall
include the instruction, study, and | 21 | | discussion required under subsection (c) of Section 27-13.2 of | 22 | | the School Code.
