AMENDMENT TO HOUSE BILL 3526

2    AMENDMENT NO. ______. Amend House Bill 3526 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Recreational Trails of Illinois Act is
5amended by changing Section 25.5 as follows:
 
6    (20 ILCS 862/25.5)
7    Sec. 25.5. Off-highway vehicle trails public access
8sticker.
9    (a) An off-highway vehicle trails public access sticker is
10a separate and additional requirement from the Off-Highway
11Vehicle Usage Stamp under Section 26 of this Act.
12    (b) Except as provided in subsection (c) of this Section,
13a person may not operate and an owner may not give permission
14to another to operate an off-highway vehicle on lands or
15waters in public off-highway vehicle parks paid for, operated,
16or supported by the grant program established under subsection

1(d) of Section 15 of this Act unless the off-highway vehicle
2displays an off-highway vehicle trails public access sticker
3in a manner prescribed by the Department by rule.
4    (c) An off-highway vehicle does not need an off-highway
5vehicle trails public access sticker if the off-highway
6vehicle is used on private land or if the off-highway vehicle
7is owned by the State, the federal government, or a unit of
8local government.
9    (d) The Department shall issue an off-highway vehicle
10trails public access sticker and shall charge the following
11fees:
12        (1) $30 for 3 years for individuals;
13        (2) $50 for 3 years for rental units;
14        (3) $75 for 3 years for dealer and manufacturer
15    demonstrations and research;
16        (4) $50 for 3 years for an all-terrain vehicle or
17    off-highway motorcycle used for production agriculture, as
18    defined in Section 3-821 of the Illinois Vehicle Code;
19        (5) $50 for 3 years for residents of a State other than
20    Illinois that does not have a reciprocal agreement with
21    the Department, under subsection (e) of this Section; and
22        (6) $50 for 3 years for an all-terrain vehicle or
23    off-highway motorcycle that does not have a title.
24    (d-5) The Department, by administrative rule, may make
25replacement stickers available at a reduced cost. The fees for
26public access stickers shall be deposited as follows: into the

1Off-Highway Vehicle Trails Fund
2        (1) $5 from the sale of each off-highway vehicle
3    trails public access sticker shall be deposited into the
4    Tick Research, Education, and Evaluation (TREE) Fund,
5    which is created as a special fund in the State treasury.
6    Moneys deposited in the Tick Research, Education, and
7    Evaluation (TREE) Fund shall be paid as grants for the
8    ordinary and contingent expenses associated with tick
9    research, education, and evaluation; and
10        (2) the remainder of the fees for public access
11    stickers shall be deposited into the Off-Highway Vehicle
12    Trails Fund to be used for improvements to Illinois State
13    Parks.
14    (e) The Department may enter into reciprocal agreements
15with other states that have a similar off-highway vehicle
16trails public access sticker program to allow residents of
17those states to operate off-highway vehicles on land or lands
18or waters in public off-highway vehicle parks paid for,
19operated, or supported by the off-highway vehicle trails grant
20program established under subsection (d) of Section 15 of this
21Act without acquiring an off-highway vehicle trails public
22access sticker in this State under subsection (b) of this
23Section.
24    (f) The Department may license vendors to sell off-highway
25vehicle trails public access stickers. Issuing fees may be set
26by administrative rule.

1    (g) Any person participating in an organized competitive
2event on land or lands in off-highway vehicle parks paid for,
3operated by, or supported by the grant program established in
4subsection (d) of Section 15 shall display the public access
5sticker required under subsection (b) of this Section or pay
6$5 per event. Fees collected under this subsection shall be
7deposited into the Off-Highway Vehicle Trails Fund.

9    Section 10. The State Finance Act is amended by adding
10Section 5.990 as follows:
 
11    (30 ILCS 105/5.990 new)
12    Sec. 5.990. The Tick Research, Education, and Evaluation
13(TREE) Fund.".
