AMENDMENT TO HOUSE BILL 3093

2    AMENDMENT NO. ______. Amend House Bill 3093 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Equitable Restrooms Act is amended by
5changing Section 20 and by adding Sections 30 and 35 as
6follows:
 
7    (410 ILCS 35/20)  (from Ch. 111 1/2, par. 3751-20)
8    Sec. 20. Application. Except for Section 25 and Section
930, this Act applies only to places of public accommodation
10that commence construction, or that commence alterations
11exceeding 50% of the entire place of public accommodation,
12after the effective date of this Act.

15    Sec. 30. Menstrual hygiene products in public restrooms.

1    (a) The General Assembly finds that:
2        (1) menstrual hygiene products are a health care
3    necessity and not an item that can be forgone or
4    substituted easily; and
5        (2) access to menstrual hygiene products is a serious
6    and ongoing need in this State.
7    (b) As used in this Section:
8    "Menstrual hygiene products" means tampons and sanitary
9napkins for use in connection with the menstrual cycle.
10    "Public restroom" means any public toilet facility that is
11available without preference to any specific gender or any
12public toilet facility that is available only to women.
13"Public restroom" does not include any public toilet facility
14in a mosque, temple, church, and other places of worship if the
15provision of menstrual hygiene products would conflict with
16the entity's sincerely held religious beliefs, practices, or
17observances.
18    (c) This Section applies to any existing or future public
19buildings, as that term is defined in Section 18.
20    (d) Notwithstanding any other provision of law, the owner
21of a public restroom shall make available and accessible in
22that public restroom menstrual hygiene products at no cost and
23shall be responsible for ordering, stocking, and replenishing
24the supply of those products in that restroom.
25    (e) During any inspection of a public building by a health
26officer or health inspector, the health officer or health

1inspector may inspect the public building to determine whether
2it complies with this Section.
3    (f) The Department of Public Health shall adopt rules to
4implement this Section.
 
5    (410 ILCS 35/35 new)
6    Sec. 35. Violation. The owner of a place of public
7accommodation or a public building that violates Section 18,
8Section 25, or Section 30 is guilty of a petty offense. The
9penalty is a fine of not more than $100.
 
10    Section 99. Effective date. This Act takes effect upon
11becoming law.".
