AMENDMENT TO HOUSE BILL 3046

2    AMENDMENT NO. ______. Amend House Bill 3046, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Environmental Protection Act is amended by
6changing Sections 3.145 and 3.365 as follows:
 
7    (415 ILCS 5/3.145)  (was 415 ILCS 5/3.05)
8    Sec. 3.145. Community water supply. "Community water
9supply" means a public water supply which serves or is
10intended to serve at least 15 service connections used by
11residents or regularly serves at least 25 residents for the
12purpose of drinking, and which serves or is intended to serve
13at least 50 service connections or regularly serve at least
14100 residents for the purpose of general domestic use.
15    "Non-community water supply" means a public water supply
16that is not a community water supply. The requirements of this

1Act shall not apply to non-community water supplies.

4    Sec. 3.365. Public water supply. "Public water supply"
5means all mains, pipes and structures through which water is
6obtained and distributed to the public, including wells and
7well structures, intakes and cribs, pumping stations,
8treatment plants, reservoirs, storage tanks and appurtenances,
9collectively or severally, actually used or intended for use
10for the purpose of furnishing water for drinking or general
11domestic use and which serve at least 15 service connections
12or which regularly serve at least 25 persons at least 60 days
13per year. "Public water supply" also means all mains, pipes,
14and structures through which water is obtained and distributed
15to the public, including wells and well structures, intakes
16and cribs, pumping stations, treatment plants, reservoirs,
17storage tanks and appurtenances, collectively or severally,
18actually used or intended for use for the purpose of
19furnishing water for general domestic use and which serve at
20least 50 service connections or which regularly serve at least
21100 persons at least 120 days per year. A public water supply
22is either a "community water supply" or a "non-community water
23supply".
