AMENDMENT TO HOUSE BILL 2817

2    AMENDMENT NO. ______. Amend House Bill 2817 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the State
5Agency and Grantee Bonus Prohibition Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Employee" means any person employed, full-time,
8part-time, or contractually, in any capacity by a State agency
9or hospital, without regard to whether that person's
10employment is subject to the advice and consent of the Senate
11or is for a stated term. "Employee" does not include persons
12subject to a collective bargaining agreement.
13    "Grant funds" has the meaning provided in Section 2 of the
14Illinois Grant Funds Recovery Act.
15    "Grantee" has the meaning provided in Section 2 of the
16Illinois Grant Funds Recovery Act.

1    "Hospital" has the meaning provided in Section 3 of the
2Hospital Licensing Act.
3    "State agency" has the meaning provided in Section
41-15.100 of the Illinois Procurement Code.
 
5    Section 10. Bonuses prohibited.
6    (a) No State agency or hospital shall pay from State
7funds, in whole or in part, and no employee of a State agency
8or hospital may receive a bonus as all or part of his or her
9compensation, including such bonuses as may be received for
10work on capital projects.
11    (b) No grantee shall pay, and no employee or contract
12worker of a grantee may receive, a bonus paid from grant funds
13awarded for operational expenses as all or part of his or her
14compensation, including such bonuses as may be received for
15work on capital projects.
16    (c) State agencies who use bonuses paid to State employees
17shall provide an annual report to the General Assembly
18itemizing each bonus awarded, including the amount of the
19bonuses awarded, the purpose of the bonus, the position of the
20employees to whom bonuses were awarded, and the overall agency
21fiscal impact for the bonuses awarded in the prior fiscal
22year. This report shall be due December 1, 2023 to the General
23Assembly and annually thereafter. Recruitment or retention
24bonuses for State employment shall be no more than $10,000 per
25bonus unless the Department of Central Management Services

1adopts rules increasing the monetary limit per bonus.
 
2    Section 99. Effective date. This Act takes effect upon
3becoming law.".
