Civil Administrative Code of Illinois is amended by | 7 | | adding Section 2105-370 and 2105-375 as follows: | 8 | | (20 ILCS 2105/2105-370 new) | 9 | | Sec. 2105-370. Continuing education; cultural competency. | 10 | | (a) As used in this Section: | 11 | | "Cultural competency" means a set of integrated attitudes, | 12 | | knowledge, and skills that enables a health care professional | 13 | | or organization to care effectively for patients from diverse | 14 | | cultures, groups, and communities. | 15 | | "Health care professional" means a person licensed or | 16 | | registered by the Department under the following Acts: the |

| 1 | | Medical Practice Act of 1987, the Nurse Practice Act, the | 2 | | Clinical Psychologist Licensing Act, the Illinois Optometric | 3 | | Practice Act of 1987, the Illinois Physical Therapy Act, the | 4 | | Pharmacy Practice Act, the Physician Assistant Practice Act of | 5 | | 1987, the Clinical Social Work and Social Work Practice Act, | 6 | | the Nursing Home Administrators Licensing and Disciplinary | 7 | | Act, the Illinois Occupational Therapy Practice Act, the | 8 | | Podiatric Medical Practice Act of 1987, the Respiratory Care | 9 | | Practice Act, the Professional Counselor and Clinical | 10 | | Professional Counselor Licensing and Practice Act, the | 11 | | Illinois Speech-Language Pathology and Audiology Practice Act, | 12 | | the Illinois Dental Practice Act, the Illinois Dental Practice | 13 | | Act, or the Behavior Analyst Licensing Act. | 14 | | (b) For health care professional license or registration | 15 | | renewals occurring on or after January 1, 2025, a health care | 16 | | professional who has continuing education requirements must | 17 | | complete at least a one-hour course in training on cultural | 18 | | competency. A health care professional may count this one hour | 19 | | for completion of this course toward meeting the minimum | 20 | | credit hours required for continuing education. | 21 | | (c) The Department may adopt rules for the implementation | 22 | | of this Section. | 23 | | (20 ILCS 2105/2105-375 new) | 24 | | Sec. 2105-375. Limitation on specific statutorily mandated | 25 | | training requirements. |

| 1 | | (a) As used in this Section: | 2 | | "Health care professional" means a person licensed or | 3 | | registered by the Department under the following Acts: the | 4 | | Medical Practice Act of 1987, the Nurse Practice Act, the | 5 | | Clinical Psychologist Licensing Act, the Illinois Optometric | 6 | | Practice Act of 1987, the Illinois Physical Therapy Act, the | 7 | | Pharmacy Practice Act, the Physician Assistant Practice Act of | 8 | | 1987, the Clinical Social Work and Social Work Practice Act, | 9 | | the Nursing Home Administrators Licensing and Disciplinary | 10 | | Act, the Illinois Occupational Therapy Practice Act, the | 11 | | Podiatric Medical Practice Act of 1987, the Respiratory Care | 12 | | Practice Act, the Professional Counselor and Clinical | 13 | | Professional Counselor Licensing and Practice Act, the | 14 | | Illinois Speech-Language Pathology and Audiology Practice Act, | 15 | | the Illinois Dental Practice Act, the Illinois Dental Practice | 16 | | Act, or the Behavior Analyst Licensing Act. | 17 | | "Statutorily mandated topics" means continuing education | 18 | | training as specified by statute, including, but not limited | 19 | | to, training required under Sections 2105-365 and 2105-370. | 20 | | (b) Notwithstanding any other provision of law, for health | 21 | | care professional license or registration renewals occurring | 22 | | on or after January 1, 2025, a health care professional whose | 23 | | license or registration renewal occurs every 2 years must | 24 | | complete all statutorily mandated topics within 3 renewal | 25 | | periods. If any additional statutorily mandated topics are | 26 | | added by law after the effective date of this amendatory Act of |

| 1 | | the 103rd General Assembly, then a health care professional | 2 | | whose license or registration renewal occurs every 2 years | 3 | | must complete all statutorily mandated topics within 4 renewal | 4 | | periods. | 5 | | (c) Notwithstanding any other provision of law, for health | 6 | | care professional license or registration renewals occurring | 7 | | on or after January 1, 2025, a health care professional whose | 8 | | license or registration renewal occurs every 3 years must | 9 | | complete all statutorily mandated topics within 2 renewal | 10 | | periods. If any additional statutorily mandated topics are | 11 | | added by law after the effective date of this amendatory Act of | 12 | | the 103rd General Assembly, then a health care professional | 13 | | whose license or registration renewal occurs every 3 years | 14 | | must complete all statutorily mandated topics within 3 renewal | 15 | | periods. | 16 | | (d) Notwithstanding any other provision of this Section to | 17 | | the contrary, the implicit bias awareness training required | 18 | | under Section 2105-15.7 and the sexual harassment prevention | 19 | | training required under Section 2105-15.5 must be completed as | 20 | | provided by law. | 21 | | (e) The Department shall maintain on its website | 22 | | information regarding the current requirements for the | 23 | | specific statutorily mandated topics. | 24 | | (f) Each license or permit application or renewal form the | 25 | | Department provides to a health care professional must include | 26 | | a notification regarding the current specific statutorily |

| 1 | | mandated topics. | 2 | | Section 10. The Illinois Controlled Substances Act is | 3 | | amended by changing Section 315.5 as follows: | 4 | | (720 ILCS 570/315.5) | 5 | | Sec. 315.5. Opioid education for prescribers. In | 6 | | accordance with the requirement for prescribers of controlled | 7 | | substances to undergo training under Section 1263 of the | 8 | | Consolidated Appropriations Act, 2023 (Public Law 117-328), | 9 | | every Every prescriber who is licensed to prescribe controlled
| 10 | | substances shall, during the pre-renewal period, complete one | 11 | | hour 3 hours of continuing education on safe opioid
| 12 | | prescribing practices offered or accredited by a professional | 13 | | association, State government agency, or federal government
| 14 | | agency. Notwithstanding any individual licensing Act or | 15 | | administrative rule, a
prescriber may count this hour these 3 | 16 | | hours toward the total continuing education hours required for | 17 | | renewal of a
professional license. Continuing education on | 18 | | safe opioid prescribing practices applied to meet any other | 19 | | State
licensure requirement or professional accreditation or | 20 | | certification requirement may be used toward the
requirement | 21 | | under this Section.
The Department of Financial and | 22 | | Professional Regulation may adopt rules for the administration | 23 | | of this Section.
