AMENDMENT TO HOUSE BILL 2450

2    AMENDMENT NO. ______. Amend House Bill 2450, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Department of Professional Regulation Law
6of the Civil Administrative Code of Illinois is amended by
7adding Section 2105-370 and 2105-375 as follows:
 
8    (20 ILCS 2105/2105-370 new)
9    Sec. 2105-370. Continuing education; cultural competency.
10    (a) As used in this Section:
11    "Cultural competency" means a set of integrated attitudes,
12knowledge, and skills that enables a health care professional
13or organization to care effectively for patients from diverse
14cultures, groups, and communities.
15    "Health care professional" means a person licensed or
16registered by the Department under the following Acts: the

1Medical Practice Act of 1987, the Nurse Practice Act, the
2Clinical Psychologist Licensing Act, the Illinois Optometric
3Practice Act of 1987, the Illinois Physical Therapy Act, the
4Pharmacy Practice Act, the Physician Assistant Practice Act of
51987, the Clinical Social Work and Social Work Practice Act,
6the Nursing Home Administrators Licensing and Disciplinary
7Act, the Illinois Occupational Therapy Practice Act, the
8Podiatric Medical Practice Act of 1987, the Respiratory Care
9Practice Act, the Professional Counselor and Clinical
10Professional Counselor Licensing and Practice Act, the
11Illinois Speech-Language Pathology and Audiology Practice Act,
12the Illinois Dental Practice Act, the Illinois Dental Practice
13Act, or the Behavior Analyst Licensing Act.
14    (b) For health care professional license or registration
15renewals occurring on or after January 1, 2025, a health care
16professional who has continuing education requirements must
17complete at least a one-hour course in training on cultural
18competency. A health care professional may count this one hour
19for completion of this course toward meeting the minimum
20credit hours required for continuing education.
21    (c) The Department may adopt rules for the implementation
22of this Section.

24    Sec. 2105-375. Limitation on specific statutorily mandated
25training requirements.

1    (a) As used in this Section:
2    "Health care professional" means a person licensed or
3registered by the Department under the following Acts: the
4Medical Practice Act of 1987, the Nurse Practice Act, the
5Clinical Psychologist Licensing Act, the Illinois Optometric
6Practice Act of 1987, the Illinois Physical Therapy Act, the
7Pharmacy Practice Act, the Physician Assistant Practice Act of
81987, the Clinical Social Work and Social Work Practice Act,
9the Nursing Home Administrators Licensing and Disciplinary
10Act, the Illinois Occupational Therapy Practice Act, the
11Podiatric Medical Practice Act of 1987, the Respiratory Care
12Practice Act, the Professional Counselor and Clinical
13Professional Counselor Licensing and Practice Act, the
14Illinois Speech-Language Pathology and Audiology Practice Act,
15the Illinois Dental Practice Act, the Illinois Dental Practice
16Act, or the Behavior Analyst Licensing Act.
17    "Statutorily mandated topics" means continuing education
18training as specified by statute, including, but not limited
19to, training required under Sections 2105-365 and 2105-370.
20    (b) Notwithstanding any other provision of law, for health
21care professional license or registration renewals occurring
22on or after January 1, 2025, a health care professional whose
23license or registration renewal occurs every 2 years must
24complete all statutorily mandated topics within 3 renewal
25periods. If any additional statutorily mandated topics are
26added by law after the effective date of this amendatory Act of

1the 103rd General Assembly, then a health care professional
2whose license or registration renewal occurs every 2 years
3must complete all statutorily mandated topics within 4 renewal
4periods.
5    (c) Notwithstanding any other provision of law, for health
6care professional license or registration renewals occurring
7on or after January 1, 2025, a health care professional whose
8license or registration renewal occurs every 3 years must
9complete all statutorily mandated topics within 2 renewal
10periods. If any additional statutorily mandated topics are
11added by law after the effective date of this amendatory Act of
12the 103rd General Assembly, then a health care professional
13whose license or registration renewal occurs every 3 years
14must complete all statutorily mandated topics within 3 renewal
15periods.
16    (d) Notwithstanding any other provision of this Section to
17the contrary, the implicit bias awareness training required
18under Section 2105-15.7 and the sexual harassment prevention
19training required under Section 2105-15.5 must be completed as
20provided by law.
21    (e) The Department shall maintain on its website
22information regarding the current requirements for the
23specific statutorily mandated topics.
24    (f) Each license or permit application or renewal form the
25Department provides to a health care professional must include
26a notification regarding the current specific statutorily

1mandated topics.
 
2    Section 10. The Illinois Controlled Substances Act is
3amended by changing Section 315.5 as follows:
 
4    (720 ILCS 570/315.5)
5    Sec. 315.5. Opioid education for prescribers. In
6accordance with the requirement for prescribers of controlled
7substances to undergo training under Section 1263 of the
8Consolidated Appropriations Act, 2023 (Public Law 117-328),
9every Every prescriber who is licensed to prescribe controlled
10substances shall, during the pre-renewal period, complete one
11hour 3 hours of continuing education on safe opioid
12prescribing practices offered or accredited by a professional
13association, State government agency, or federal government
14agency. Notwithstanding any individual licensing Act or
15administrative rule, a prescriber may count this hour these 3
16hours toward the total continuing education hours required for
17renewal of a professional license. Continuing education on
18safe opioid prescribing practices applied to meet any other
19State licensure requirement or professional accreditation or
20certification requirement may be used toward the requirement
21under this Section. The Department of Financial and
22Professional Regulation may adopt rules for the administration
23of this Section.

1    Section 99. Effective date. This Act takes effect January
21, 2025.".
