1 AMENDMENT TO HOUSE BILL 2057
2     AMENDMENT NO. ______. Amend House Bill 2057 by replacing
3 everything after the enacting clause with the following:

4     "Section 5. The Illinois Pension Code is amended by
5 changing Section 11-196 and by adding Section 12-162.5 as
6 follows:

7     (40 ILCS 5/11-196)  (from Ch. 108 1/2, par. 11-196)
8     Sec. 11-196. To subpoena witnesses and compel the
9 production of records. To issue subpoenas to compel the
10 attendance of witnesses to testify before it and to compel the
11 production of documents and records upon any matter concerning
12 theFund, including, but not limited to, in conjunction with:
13 ~~fund and allow witness fees not in excess of $6 per day.~~
14         (1) a disability claim;
15         (2) an administrative review proceeding;
16         (3) an attempt to obtain information to assist in the

1     collection of sums due to the Fund;
2         (4) obtaining any and all personal identifying
3     information necessary for the administration of benefits;
4         (5) the determination of the death of a benefit
5     recipient or a potential benefit recipient; or
6         (6) a felony forfeiture investigation.
7     The fees of witnesses for attendance and travel shall be
8 the same as the fees of witnesses before the circuit courts of
9 this State and shall be paid by the party seeking the subpoena.
10 The Board may apply to any circuit court in the State for an
11 order requiring compliance with a subpoena issued under this
12 Section. Subpoenas issued under this Section shall be subject
13 to applicable provisions of the Code of Civil Procedure. The
14 president or other members of the board may administer oaths
15 to witnesses.

16     Section 99. Effective date. This Act takes effect upon
17 becoming law.".
