AMENDMENT TO HOUSE BILL 2040

2    AMENDMENT NO. ______. Amend House Bill 2040 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Highway Code is amended by
5changing Section 6-115 as follows:
 
6    (605 ILCS 5/6-115)  (from Ch. 121, par. 6-115)
7    Sec. 6-115. (a) Except as provided in Section 10-20 of the
8Township Code or subsections subsection (b) and (c), no person
9shall be eligible to the office of highway commissioner or
10clerk unless he shall be a legal voter and has been one year a
11resident of the district. In road districts that elect a
12clerk, the same limitation shall apply to the district clerk.
13    (b) A board of trustees in a county organized under
14Division 2-1 of the Counties Code may (i) appoint a
15non-resident or a resident that has not resided in the
16district for one year to be a highway commissioner, or (ii)

1contract with a neighboring township to provide highway
2commissioner or clerk services if:
3        (1) the district is within a township with no
4    incorporated town;
5        (2) the township has a population of less than 1,000
6    500; and
7        (3) no qualified candidate who has resided in the
8    township for at least one year is willing to serve as
9    highway commissioner or clerk.
10    (c) A board of trustees in a county organized under
11Division 2-4 of the Counties Code may (i) appoint a
12non-resident or a resident who has not resided in the district
13for one year to be a highway commissioner, or (ii) contact with
14a neighboring township to provide highway commissioner or
15clerk services if no qualified candidate who has resided in
16the road district for at least one year is willing to serve as
17highway commissioner or clerk.
