AMENDMENT TO HOUSE BILL 1342

2    AMENDMENT NO. ______. Amend House Bill 1342, AS AMENDED,
3with reference to page and line numbers of Senate Amendment
4No. 2, on page 12, line 25, by replacing "days" with "business
5days"; and
 
6on page 13, line 13, by replacing "parties" with "parties,
7including legal counsel,"; and
 
8on page 13, line 18, after "accused", by inserting "or the
9accused's legal counsel"; and
 
10on page 16, line 1, by replacing "January" with "July"; and
 
11on page 16, immediately below line 4, by inserting the
12following:
13    "(c) For the purposes of determining compliance with this
14Section, a Service Board shall not be deemed to be in violation

1of this Section when failure to comply is due to:
2        (1) the unavailability of zero-emission buses from a
3    manufacturer or funding to purchase zero-emission buses;
4        (2) the lack of necessary charging, fueling, or
5    storage facilities or funding to procure charging,
6    fueling, or storage facilities; or
7        (3) the inability of a third party to enter into a
8    contractual or commercial relationship with a Service
9    Board that is necessary to carry out the purposes of this
10    Section."; and
 
11on page 17, by replacing lines 8 through 11 with "violation is
12not practicable, then the Authority shall make a reasonable
13effort to provide notice to the individual by personal
14service, by mailing a copy of the notice by certified mail,
15return receipt requested, and first-class mail to the person's
16current address, or by emailing a copy of the notice to an
17email address on file, if available. If the"; and
 
18on page 18, line 2, by replacing "days" with "business days";
19and
 
20on page 18, line 16, by replacing "parties" with "parties,
21including legal counsel,"; and

2on page 20, line 20, after "cards", by inserting "with a value
3of $20 per card"; and
 
4by replacing line 26 on page 33 through line 5 on page 34 with
5the following:
6    "The Authority shall file a statement certifying that the
7Service Boards published the data described in subsection
8(b-5) with the General Assembly and the Governor after
9adoption of the Annual Budget and Two-Year Financial Plan
10required by subsection (a). If the Authority fails to file a
11statement certifying publication of the data, then the
12appropriations to the Department of Transportation for grants
13to the Authority intended to reimburse the Service Boards for
14providing free and reduced fares shall be withheld.
15    (b-5) For fiscal years 2024 and 2025, the Service Boards
16must publish a monthly".
