| 2 | | AMENDMENT NO. ______. Amend House Bill 798 by replacing | 3 | | everything after the enacting clause with the following: | 4 | | "Section 1. This Act may be referred to as the William P. | 5 | | "Bill" Wozniak Memorial Act. | 6 | | Section 5. The Illinois Administrative Procedure Act is | 7 | | amended by adding Section 5-45.55 as follows: | 8 | | (5 ILCS 100/5-45.55 new) | 9 | | Sec. 5-45.55. Emergency rulemaking; Secretary of State | 10 | | Act. To provide for the expeditious and timely implementation | 11 | | of this amendatory Act of the 103rd General Assembly, | 12 | | emergency rules implementing this amendatory Act of the 103rd | 13 | | General Assembly may be adopted in accordance with Section | 14 | | 5-45 by the Secretary of State. The adoption of emergency | 15 | | rules authorized by Section 5-45 and this Section is deemed to |

| 1 | | be necessary for the public interest, safety, and welfare. | 2 | | This Section is repealed one year after the effective date | 3 | | of this amendatory Act of the 103rd General Assembly. | 4 | | Section 10. The Secretary of State Act is amended by | 5 | | adding Sections 5.1, 5.2, and 5.3 as follows: | 6 | | (15 ILCS 305/5.1 new) | 7 | | Sec. 5.1. Enhancement of security in the State Capitol | 8 | | Complex. | 9 | | (a) The Secretary of State, in collaboration with the | 10 | | Office of the Architect of the Capitol, shall install and | 11 | | maintain: | 12 | | (1) automated license plate readers in positions | 13 | | around the State Capitol Complex that offer the most | 14 | | strategic advantage for security monitoring and incident | 15 | | response, including, but not limited to, all entrances and | 16 | | exits of aboveground and underground State Capitol Complex | 17 | | parking structures and parking lots; and | 18 | | (2) hardened security posts in the State Capitol | 19 | | Complex where law enforcement personnel of the Secretary | 20 | | of State Police Department and other security personnel | 21 | | are stationed while on duty. | 22 | | The automated license plate readers installed under | 23 | | paragraph (1) shall not be used for facial recognition. | 24 | | (b) The Secretary of State shall replace, install, and |

| 1 | | maintain: | 2 | | (1) enhanced security screening devices at entrances | 3 | | of secured areas in the State Capitol Complex; and | 4 | | (2) identification card verification checkpoints at | 5 | | entrances of secured areas in the State Capitol Complex. | 6 | | (c) The Secretary of State shall identify acceptable forms | 7 | | of identification that may be used to gain access to secured | 8 | | areas in the State Capitol Complex, which may include forms of | 9 | | identification issued by the Clerk of the House of | 10 | | Representatives, the Secretary of the Senate, the Secretary of | 11 | | State, and the Department of Central Management Services. The | 12 | | Secretary of State shall adopt rules to establish the manner | 13 | | in which these forms of identification are to be presented, | 14 | | additional acceptable forms of identification, and any other | 15 | | provisions that the Secretary of State determines to be | 16 | | necessary or useful for the administration of this subsection. | 17 | | (d) As used in this Section: | 18 | | "Automated license plate readers" means equipment designed | 19 | | to capture an image of a vehicle's license plate and compare | 20 | | the collected data and photographs to existing law enforcement | 21 | | databases for investigative purposes. | 22 | | "Hardened security post" means a security post that is | 23 | | strengthened in a manner that will protect it in the event of | 24 | | attack or reduce the risk of personal injury to its occupants. | 25 | | (15 ILCS 305/5.2 new) |

| 1 | | Sec. 5.2. Rules for security measures in State Capitol | 2 | | Complex. | 3 | | (a) The Secretary of State shall adopt rules to: | 4 | | (1) establish a chain of command based in Springfield | 5 | | for police and other security personnel responding to an | 6 | | incident at the State Capitol Complex; | 7 | | (2) authorize administrative personnel based in | 8 | | Springfield to issue emergency orders in response to an | 9 | | incident at the State Capitol Complex; | 10 | | (3) provide adequate mitigation and response training | 11 | | to law enforcement personnel of the Secretary of State | 12 | | Police Department and other security personnel who are | 13 | | stationed at the State Capitol Complex; | 14 | | (4) create a volunteer training program to allow | 15 | | security personnel employed by the Secretary of State to | 16 | | successfully complete firearm training and qualify to | 17 | | carry firearms only while on duty at the State Capitol | 18 | | Complex and provide incentive compensation to all trained | 19 | | and qualified individuals; and | 20 | | (5) adopt and enforce improved security procedures for | 21 | | legislators, staff, lobbyists, and visitors entering the | 22 | | State Capitol Complex, including procedures to allow law | 23 | | enforcement personnel of the Secretary of State Police | 24 | | Department and other security personnel to perform | 25 | | additional screening on any individual seeking to enter a | 26 | | secured area at the discretion of the law enforcement |

| 1 | | personnel or security personnel. | 2 | | The procedures established under paragraph (4) shall | 3 | | require that all firearms issued to trained and qualified | 4 | | security personnel, other than law enforcement personnel of | 5 | | the Secretary of State Police Department, shall be returned to | 6 | | designated and secured storage areas in the State Capitol | 7 | | Complex at the end of each duty shift. A participant in the | 8 | | volunteer training program shall have prior or current law | 9 | | enforcement experience and be certified by the Illinois Law | 10 | | Enforcement Training and Standards Board in accordance with | 11 | | the Illinois Police Training Act. | 12 | | (b) The Secretary of State may adopt emergency rules to | 13 | | implement this Section. | 14 | | (15 ILCS 305/5.3 new) | 15 | | Sec. 5.3. Report concerning security enhancements to the | 16 | | State Capitol Complex. No later than March 12, 2026, the | 17 | | Secretary of State, in collaboration with the Office of the | 18 | | Architect of the Capitol, shall submit a report to the | 19 | | Governor and the General Assembly concerning the | 20 | | implementation of this amendatory Act of the 103rd General | 21 | | Assembly, that includes, but is not limited to, a summary of | 22 | | all security enhancements put in place to protect life and | 23 | | property at the State Capitol Complex, the efficacy of the | 24 | | volunteer training program, and all additional mitigation and | 25 | | response training put in place to better equip security |
