SYNOPSIS AS INTRODUCED:

30 ILCS 105/6z-130 new

    Amends the State Finance Act. Creates the Protect Our Communities Grant Fund as a special fund in the State treasury. Provides that moneys in the Fund shall be used by the Illinois Law Enforcement Training Standards Board for grants to units of local government and public institutions of higher education in this State for specified purposes. Provides that moneys received for the specified purposes of the Fund, including, but not limited to, fee receipts, gifts, grants, and awards from any public or private entity, must be deposited into the Fund. Provides that any interest earned on moneys in the Fund must be deposited into the Fund. Provides for the adoption of rules concerning distribution of grant moneys. Provides that moneys in the Fund shall not be appropriated, assigned, or transferred to another State fund. Requires the State Comptroller to direct and the State Treasurer to transfer the sum of $250,000,000 from the General Revenue Fund to the Fund. Makes other changes.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Sections 5.970 and 6z-130 as follows:
 
6    (30 ILCS 105/5.970 new)
7    Sec. 5.970. The Protect Our Communities Grant Fund.

9    Sec. 6z-130. Protect Our Communities Grant Fund.
10    (a) The Protect Our Communities Grant Fund is created as a
11special fund in the State treasury.
12    (b) Subject to appropriation, moneys in the Fund shall be
13used by the Illinois Law Enforcement Training Standards Board
14for grants to units of local government and public
15institutions of higher education in this State for the
16following purposes:
17        (1) hiring and retention of law enforcement officers,
18    including hiring and retention incentives and overtime;
19        (2) providing mental health care for law enforcement
20    officers;
21        (3) purchasing public safety equipment designed to
22    prevent violent crimes, motor vehicle theft, vehicular

1    hijacking, or the sale of contraband;
2        (4) training for law enforcement officers in
3    preventing gang violence, motor vehicle theft, vehicular
4    hijacking, or the sale of contraband; and
5        (5) improvements to jail facilities.
6    (c) Moneys received for the purposes of this Section,
7including, but not limited to, fee receipts, gifts, grants,
8and awards from any public or private entity, must be
9deposited into the Fund. Any interest earned on moneys in the
10Fund must be deposited into the Fund.
11    (d) The Illinois Law Enforcement Training Standards Board
12may by rule set requirements for the distribution of grant
13moneys and determine which law enforcement agencies are
14eligible.
15    (e) The Illinois Law Enforcement Training Standards Board
16shall consider compliance with the Uniform Crime Reporting Act
17as a factor in awarding grant moneys.
18    (f) Notwithstanding any other provision of law to the
19contrary, moneys in the Fund shall not be appropriated,
20assigned, or transferred to another State fund.
21    (g) As soon as practical after the effective date of this
22amendatory Act of the 102nd General Assembly, the State
23Comptroller shall direct and the State Treasurer shall
24transfer the sum of $250,000,000 from the General Revenue Fund
25to the Fund created under this Section.
