1    AN ACT concerning government.

 
2    Be it enacted by the People of the State of Illinois, 
3represented in the General Assembly: 



 
4    Section 5. The Public Water District Act is amended  by 
5adding Section 28.2 as follows:
 
6    (70 ILCS 3705/28.2 new)
7    Sec. 28.2. Sangamon Valley Public Water District 
8annexation. 
9    (a) The General Assembly finds:
10        (1) Due to a natural gas leak in December 2016, 
11    multiple water wells connected to the Mahomet Aquifer, one 
12    of the largest sources of water in the State of Illinois, 
13    were contaminated with methane, so much so, that numerous 
14    homeowners are without potable water.
15        (2) The issue of methane contamination of the State of 
16    Illinois' water supply has become a statewide issue and 
17    resulted in the Illinois Attorney General having 
18    litigation pending over the contamination.  On December 21, 
19    2018, the Mahomet Aquifer Task Force issued their report 
20    specifically addressing this incident and future incidents 
21    and stressed the need to provide State government, 
22    legislative, and monetary relief so immediate remediation 
23    may begin.

1        (3) The area residents have been without safe water 
2    service for 4 years.
3        (4) The cost of expanding infrastructure to the area 
4    is estimated around $10,000,000.  The Sangamon Valley 
5    Public Water District is not a taxing body, but rather 
6    operates on fees for provided water service and to 
7    initiate construction would require an initial sum of 
8    $3,800,000.
9        (5) In June 2020, in recognition of this Illinois 
10    water-source crisis, the General Assembly passed, and the 
11    Governor signed a Capital Bill appropriating $3,800,000 
12    required for initiation of the plan to bring water to this 
13    area of the State.
14        (6) In addition to funding, the affected area needs to 
15    be annexed into a water district territory for such 
16    district to be able to lawfully expend funds to benefit 
17    the territory and the current statutory annexation 
18    procedure is insufficient to address the crisis and does 
19    not provide for nor contemplate an expedited procedure in 
20    the event of water contamination.
21    (b) Notwithstanding any other provision of law, on the 
22effective date of this amendatory Act of the 102nd General 
23Assembly, the following property is annexed into the territory 
24of the Sangamon Valley Public Water District:
