1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Sections
510-16a and 10-22.39 as follows:
 
6    (105 ILCS 5/10-16a)
7    Sec. 10-16a. School board member's leadership training.
8    (a) This Section applies to all school board members
9serving pursuant to Section 10-10 of this Code who have been
10elected after the effective date of this amendatory Act of the
1197th General Assembly or appointed to fill a vacancy of at
12least one year's duration after the effective date of this
13amendatory Act of the 97th General Assembly.
14    (b) Every voting member of a school board of a school
15district elected or appointed for a term beginning after the
16effective date of this amendatory Act of the 97th General
17Assembly, within a year after the effective date of this
18amendatory Act of the 97th General Assembly or the first year
19of his or her first term, shall complete a minimum of 4 hours
20of professional development leadership training covering
21topics in education and labor law, financial oversight and
22accountability, and fiduciary responsibilities of a school
23board member, and, beginning with the 2022-2023 school year,

1trauma-informed practices for students and staff. The school
2district shall maintain on its Internet website, if any, the
3names of all voting members of the school board who have
4successfully completed the training.
5    (b-5) The training for trauma-informed practices for
6students and staff required under this Section must include,
7but is not limited to, all of the following information that is
8relevant to and within the scope of the duties of a school
9board member:
10        (1) The recognition of and care for trauma in students
11    and educators.
12        (2) The relationship between educator wellness and
13    student learning.
14        (3) The effect of trauma on student behavior and
15    learning.
16        (4) The prevalence of trauma among students, including
17    the prevalence of trauma among student populations at
18    higher risk of experiencing trauma.
19        (5) The effects of implicit or explicit bias on
20    recognizing trauma among various racial or ethnic groups
21    of students.
22        (6) Effective district and school policies and
23    practices that are shown to:
24            (A) prevent and mitigate the negative effect of
25        trauma on student behavior and learning; and
26            (B) support the emotional wellness of educators.

1    (c) The training on financial oversight, accountability,
2and fiduciary responsibilities, and, beginning with the
32022-2023 school year, trauma-informed practices for students
4and staff may be provided by an association established under
5this Code for the purpose of training school board members or
6by other qualified providers approved by the State Board of
7Education, in consultation with an association so established.
8    (d) The State Board of Education may adopt any rules
9necessary to implement and administer this Section.

12    Sec. 10-22.39. In-service training programs.
13    (a) To conduct in-service training programs for teachers.
14    (b) In addition to other topics at in-service training
15programs, at least once every 2 years, licensed school
16personnel and administrators who work with pupils in
17kindergarten through grade 12 shall be trained to identify the
18warning signs of mental illness, trauma, and suicidal behavior
19in youth and shall be taught appropriate intervention and
20referral techniques. A school district may utilize the
21Illinois Mental Health First Aid training program, established
22under the Illinois Mental Health First Aid Training Act and
23administered by certified instructors trained by a national
24association recognized as an authority in behavioral health,
25to provide the training and meet the requirements under this

1subsection. If licensed school personnel or an administrator
2obtains mental health first aid training outside of an
3in-service training program, he or she may present a
4certificate of successful completion of the training to the
5school district to satisfy the requirements of this
6subsection.
7    Training regarding the adoption and administration of a
8trauma-informed school standard satisfies the requirements of
9this subsection (b).
10    A course of instruction as described in this subsection
11(b) may provide information that is relevant to and within the
12scope of the duties of licensed school personnel and school
13administrators. A course of instruction may include, but is
14not limited to, all of the following:
15        (1) The recognition of and care for trauma in students
16    and educators.
17        (2) The relationship between educator wellness and
18    student learning.
19        (3) The effect of trauma on student behavior and
20    learning.
21        (4) The prevalence of trauma among students, including
22    the prevalence of trauma among student populations at
23    higher risk of experiencing trauma.
24        (5) The effects of implicit or explicit bias on
25    recognizing trauma among various racial or ethnic groups
26    of students.

1        (6) Effective district and school policies and
2    practices that are shown to:
3            (A) prevent and mitigate the negative effect of
4        trauma on student behavior and learning; and
5            (B) support the emotional wellness of educators.
6    (c) School guidance counselors, nurses, teachers and other
7school personnel who work with pupils may be trained to have a
8basic knowledge of matters relating to acquired
9immunodeficiency syndrome (AIDS), including the nature of the
10disease, its causes and effects, the means of detecting it and
11preventing its transmission, and the availability of
12appropriate sources of counseling and referral, and any other
13information that may be appropriate considering the age and
14grade level of such pupils. The School Board shall supervise
15such training. The State Board of Education and the Department
16of Public Health shall jointly develop standards for such
17training.
18    (d) In this subsection (d):
19    "Domestic violence" means abuse by a family or household
20member, as "abuse" and "family or household members" are
21defined in Section 103 of the Illinois Domestic Violence Act
22of 1986.
23    "Sexual violence" means sexual assault, abuse, or stalking
24of an adult or minor child proscribed in the Criminal Code of
251961 or the Criminal Code of 2012 in Sections 11-1.20,
2611-1.30, 11-1.40, 11-1.50, 11-1.60, 12-7.3, 12-7.4, 12-7.5,

112-12, 12-13, 12-14, 12-14.1, 12-15, and 12-16, including
2sexual violence committed by perpetrators who are strangers to
3the victim and sexual violence committed by perpetrators who
4are known or related by blood or marriage to the victim.
5    At least once every 2 years, an in-service training
6program for school personnel who work with pupils, including,
7but not limited to, school and school district administrators,
8teachers, school guidance counselors, school social workers,
9school counselors, school psychologists, and school nurses,
10must be conducted by persons with expertise in domestic and
11sexual violence and the needs of expectant and parenting youth
12and shall include training concerning (i) communicating with
13and listening to youth victims of domestic or sexual violence
14and expectant and parenting youth, (ii) connecting youth
15victims of domestic or sexual violence and expectant and
16parenting youth to appropriate in-school services and other
17agencies, programs, and services as needed, and (iii)
18implementing the school district's policies, procedures, and
19protocols with regard to such youth, including
20confidentiality. At a minimum, school personnel must be
21trained to understand, provide information and referrals, and
22address issues pertaining to youth who are parents, expectant
23parents, or victims of domestic or sexual violence.
24    (e) At least every 2 years, an in-service training program
25for school personnel who work with pupils must be conducted by
26persons with expertise in anaphylactic reactions and

1management.
2    (f) At least once every 2 years, a school board shall
3conduct in-service training on educator ethics,
4teacher-student conduct, and school employee-student conduct
5for all personnel.

7    Section 99. Effective date. This Act takes effect upon
8becoming law.
