AMENDMENT TO SENATE BILL 2093

2    AMENDMENT NO. ______. Amend Senate Bill 2093 as follows:
 
3on page 6, immediately below line 10, by inserting the
4following:
5    "(f) The Fund shall provide a conditional grace period for
6contract schools that show evidence of timely and good faith
7efforts to submit payroll records and make pension
8contributions due between July 1, 2021 and October 1, 2021. If
9payroll records and pension contributions due during that time
10period are not submitted by October 1, 2021, the statutory
11penalties, liquidated damages, and interest shall be
12calculated from the original due date to the submission date
13of the pension contributions or payroll records, as
14applicable.
15    Evidence of timely and good faith efforts shall include,
16but are not limited to, the following:
17        (1) evidence of the contract school's continuing

1    efforts to submit payroll records and make pension
2    contributions, both before and after the date the payroll
3    records and pension contributions were due;
4        (2) documented evidence submitted by the contract
5    school of the contract school's continuing efforts to
6    submit payroll records and make pension contributions;
7        (3) evidence in the possession of the Fund of the
8    contract school's continuing efforts to submit payroll
9    records and make pension contributions; and
10        (4) contact by the contract school with the Fund to
11    seek assistance and notify the Fund of difficulties with
12    submitting the payroll records and making the pension
13    contributions within a period of time determined by the
14    Board after the date the pension contributions and payroll
15    records were due.
16    The Fund may adopt rules to implement the changes made by
17this amendatory Act of the 102nd General Assembly.".
