AMENDMENT TO SENATE BILL 1016

2    AMENDMENT NO. ______. Amend Senate Bill 1016 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Water Commission Act of 1985 is amended by
5changing Section 0.001 as follows:
 
6    (70 ILCS 3720/0.001)
7    Sec. 0.001. Commissioners; terms; vacancies. Effective
8January 1, 2011, the terms of office of the chairperson and all
9commissioners of water commissions appointed pursuant to this
10Act shall terminate and the commission shall be reconstituted.
11    (a) The commissioners of water commissions appointed
12pursuant to this Act shall be appointed as follows:
13        (1) A chairperson, who shall also serve in the
14    capacity of a commissioner, shall be appointed by the
15    chairperson of the county board of the home county with
16    the advice and consent of the county board. For

1    appointments made on or after the effective date of this
2    amendatory Act of the 102nd General Assembly, the
3    chairperson shall be a resident of the home county.
4        (2) One commissioner from each county board district
5    within the home county shall be appointed by the
6    chairperson of the county board of the home county with
7    the advice and consent of the county board.
8        (3) One commissioner from each county board district
9    within the home county shall be appointed by the majority
10    vote of the mayors of those included municipalities that
11    have the greatest percentage of their respective
12    populations residing within such county board district of
13    the home county. A vice-chairperson of the commission
14    shall be appointed from the commissioners appointed
15    pursuant to this paragraph by a majority vote of these
16    commissioners.
17        (4) Upon receipt of water by any territorial
18    municipality, one commissioner from a territorial
19    municipality shall be appointed by the chairperson of the
20    county board of the home county with the advice and
21    consent of the county board.
22        (5) Upon receipt of water by a territorial
23    municipality, one commissioner from a territorial
24    municipality shall be appointed by the majority vote of
25    the mayors of those territorial municipalities.
26    (b) All commissioners shall be residents of the home

1county or a resident of an included municipality. However,
2commissioners appointed under paragraph (4) or (5) of
3subsection (a) on or after the effective date of this
4amendatory Act of the 102nd General Assembly shall be
5residents of a territorial municipality.
6    (c) The initial commissioners appointed pursuant to
7subsection (a) shall serve the following terms:
8        (1) The chairperson shall serve for a term of 6 years.
9        (2) At the first meeting of the commission held after
10    January 1, 2011, the commissioners appointed pursuant to
11    paragraph (2) of subsection (a) shall determine publicly
12    by lot one-third of their members to serve for a term of 2
13    years, one-third of their members to serve for a term of 4
14    years, and one-third of their members to serve for a term
15    of 6 years, any odd number of commissioners so determined
16    by dividing into thirds to serve 6-year terms.
17        (3) At the first meeting of the commission held after
18    January 1, 2011, the commissioners and the
19    vice-chairperson appointed pursuant to paragraph (3) of
20    subsection (a) shall determine publicly by lot one-third
21    of their members to serve for a term of 2 years, one-third
22    of their members to serve for a term of 4 years, and
23    one-third of their members to serve for a term of 6 years,
24    any odd number of commissioners so determined by dividing
25    into thirds to serve 6-year terms.
26        (4) The commissioner appointed pursuant to paragraph

1    (4) of subsection (a) shall serve an initial term of 3
2    years.
3        (5) The commissioner appointed pursuant to paragraph
4    (5) of subsection (a) shall serve an initial term of 6
5    years.
6    The successor commissioners shall serve for a term of 6
7years or until their successors have been appointed and
8qualified in the same manner as the original appointments.
9    (d) A commissioner shall be eligible for reappointment
10upon the expiration of his or her term. A vacancy in the office
11of a commissioner shall be filled for the balance of the
12unexpired term by appointment and with the qualifications as
13to residency in the same manner as the original appointment
14was made.
15    (e) A commissioner may be a member of the governing board,
16an officer, or an employee of the county or any unit of local
17government located within the county.
18    (f) As used in this Section, "territorial municipality"
19means a municipality entirely outside of the home county, but
20within the territorial limits and receiving water from the
21water commission.

23    Section 99. Effective date. This Act takes effect upon
24becoming law.".
