AMENDMENT TO SENATE BILL 828

2    AMENDMENT NO. ______. Amend Senate Bill 828, AS AMENDED,
3immediately above Section 5, by inserting the following:
 
4    "Section 3. The Illinois Administrative Procedure Act is
5amended by adding Section 5-45.8 as follows:
 
6    (5 ILCS 100/5-45.8 new)
7    Sec. 5-45.8. Emergency rulemaking; Election Code. To
8provide for the expeditious and timely implementation of the
9changes made to Section 1-18, 3-5, and 19A-20 of the Election
10Code and Sections 3-14-1 and 5-5-5 of the Unified Code of
11Corrections by this amendatory Act of the 102nd General
12Assembly, emergency rules implementing the changes made to
13Sections 1-18, 3-5, and 19A-20 of the Election Code and
14Sections 3-14-1 and 5-5-5 of the Unified Code of Corrections
15by this amendatory Act of the 102nd General Assembly may be
16adopted by the State Board of Elections in accordance with

1Section 5-45, except that the 24-month limitation on the
2adoption of emergency rules and the provisions of Sections
35-115 and 5-125 do not apply to rules adopted under this
4Section. The adoption of emergency rules authorized by Section
55-45 and this Section is deemed to be necessary for the public
6interest, safety, and welfare.
7    This Section is repealed one year after the effective date
8of this amendatory Act of the 102nd General Assembly."; and
 
9in the introductory clause of Section 5, by replacing "Section
101-18" with "Sections 1-18 and 1-19"; and
 
11in Section 5, Sec. 1-18, subsection (b), by deleting "or not
12later than 5 days before the first primary, general,
13consolidated, or special election immediately following his or
14her conviction, whichever is earlier"; and
 
15in Section 5, Sec. 1-18, subsection (g), by deleting "number
16and location of ballot drop boxes established,"; and
 
17in Section 5, Sec. 1-18, immediately below subsection (h), by
18inserting the following:
19    "(i) The provisions of this Section shall apply to all
20elections beginning with the general primary election in 2022.
21    (j) The State Board of Elections may adopt rules,
22including emergency rules, to implement the provisions of this

1Section."; and
 
2immediately below Sec. 1-18 of Section 5, by inserting the
3following:
 
4    "(10 ILCS 5/1-19 new)
5    Sec. 1-19. Post-Conviction Task Force.
6    (a) The Post-Conviction Task Force is created to implement
7the provisions of Section 1-18 that restores the right to vote
8for a person convicted of a felony, or otherwise under
9sentence in a correctional institution or jail and provides
10access to vote while under sentence in a correctional
11institution.
12    (b) The members of the Task Force shall be as follows:
13        (1) the chair of the State Board of Elections, or his
14    or her designee, who shall serve as chair of the Task
15    Force;
16        (2) the Director of Corrections, or his or her
17    designee;
18        (3) a representative from a statewide organization
19    that represents county clerks, appointed by the chair of
20    the State Board of Elections;
21        (4) a representative from an Illinois organization
22    advocating against voter disenfranchisement, appointed by
23    the chair of the State Board of Elections; and
24        (5) 4 members from the General Assembly, with one

1    member appointed by the President of the Senate, one
2    member appointed by the Senate Minority Leader, one member
3    appointed by the Speaker of the House of Representatives,
4    and one member appointed by the House Minority Leader.
5    (c) The State Board of Elections shall provide
6administrative and other support to the Task Force.
7    (d) On or before December 31, 2021, the Task Force shall
8prepare a report that summarizes its work and makes
9recommendations on the implementation of restoring voting
10rights to a person convicted of a felony, or otherwise under
11sentence in a correctional institution or jail, and providing
12access to vote while under sentence in a correctional
13institution.
14    (e) The Task Force is dissolved and this Section is
15repealed on January 1, 2023."; and
 
16in Section 99, by replacing "July 1, 2022" with "upon becoming
17law".
