AMENDMENT TO SENATE BILL 517

2    AMENDMENT NO. ______. Amend Senate Bill 517, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The School Code is amended by adding Section
614-17 as follows:
 
7    (105 ILCS 5/14-17 new)
8    Sec. 14-17. High-Cost Special Education Funding
9Commission.
10    (a) The High-Cost Special Education Funding Commission is
11created for the purpose of making recommendations to the
12Governor and the General Assembly for an alternative funding
13structure in this State for high-cost special education
14students that is aligned to the principles of the
15evidence-based funding formula in Section 18-8.15 in which
16school districts furthest away from adequacy receive the

1greatest amount of funding.
2    (b) The Commission shall consist of all of the following
3members:
4        (1) One representative appointed by the Speaker of the
5    House of Representatives, who shall serve as
6    co-chairperson.
7        (2) One representative appointed by the Minority
8    Leader of the House of Representatives.
9        (3) One senator appointed by the President of the
10    Senate, who shall serve as co-chairperson.
11        (4) One senator appointed by the Minority Leader of
12    the Senate.
13        (5) The State Superintendent of Education or a
14    designee.
15        (6) The Director of the Governor's Office of
16    Management and Budget or a designee.
17        (7) The Chairperson of the Advisory Council on the
18    Education of Children with Disabilities or a designee.
19    Additionally, within 60 days after the effective date of
20this amendatory Act of the 102nd General Assembly, the State
21Superintendent of Education shall appoint all of the following
22individuals to the Commission:
23        (A) One representative of a statewide association that
24    represents private special education schools.
25        (B) One representative of a statewide association that
26    represents special education cooperatives.

1        (C) One educator from a special education cooperative,
2    recommended by a statewide association that represents
3    teachers.
4        (D) One educator from a special education cooperative,
5    recommended by a different statewide association that
6    represents teachers.
7        (E) One educator from a nonpublic special education
8    school.
9        (F) One representative of a statewide association that
10    represents school administrators.
11        (G) One representative of a statewide association that
12    represents school business officials.
13        (H) One parent of a high-cost special education
14    student.
15    Members appointed to the Commission must reflect the
16racial, ethnic, and geographic diversity of this State.
17    (c) Members of the Commission shall serve without
18compensation, but may be reimbursed for their reasonable and
19necessary expenses from funds appropriated to the State Board
20of Education for that purpose.
21    (d) The State Board of Education shall provide
22administrative support to the Commission.
23    (e) To ensure that high-quality services are provided to
24ensure equitable outcomes for high-cost special education
25students, the Commission shall do all the following:
26        (1) Review the current system of funding high-cost

1    special education students in this State.
2        (2) Review the needs of high-cost special education
3    students in this State and the associated costs to ensure
4    high quality services are provided to these students.
5        (3) Review how other states fund high-cost special
6    education students.
7        (4) If available, review other proposals and best
8    practices for funding high-cost special education
9    students.
10    (f) On or before November 30, 2021, the Commission shall
11report its recommendations to the Governor and the General
12Assembly.
13    (g) This Section is repealed on December 31, 2022.
 
14    Section 99. Effective date. This Act takes effect upon
15becoming law.".
