AMENDMENT TO HOUSE BILL 5441

2    AMENDMENT NO. ______. Amend House Bill 5441 on page 6, by
3replacing lines 10 through 13 with the following:
4"reasonably should have been known by the accused. "Unable to
5give knowing consent" also includes when the victim has taken
6an intoxicating substance or any controlled substance causing
7the victim to become unconscious of the nature of the act, and
8this condition was known or reasonably should have been known
9by the accused, but the accused did not provide or administer
10the intoxicating substance. As used in this paragraph,".
