SYNOPSIS AS INTRODUCED:
 
520 ILCS 5/3.41 new

    Amends the Wildlife Code. Provides that the Department of Natural Resources shall encourage the owners of structures to eliminate nonflashing (steady burning) L-810 lights by a January 1, 2024. Provides that the owners of structures constructed on or after March 1, 2022 that are located within migratory flyways, or in ecologically sensitive areas, or are within one mile of a forest preserve or federal or State park or wildlife area shall turn off all lights not required for safety or maintenance between 12:00am through 7:00am during migratory seasons. Provides the Department of Natural Resources with rulemaking authority. Effective immediately.

1    AN ACT concerning wildlife.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Wildlife Code is amended by adding Section
53.41 as follows:
 
6    (520 ILCS 5/3.41 new)
7    Sec. 3.41. Navigational lighting. Notwithstanding any
8provision of law to the contrary:
9    (a) The Department shall encourage the owners of
10structures to eliminate nonflashing (steady burning) L-810
11lights by a January 1, 2024. The Department shall issue
12certificates of recognition to owners for eliminating
13nonflashing (steady burning) L-810 lights.
14    (b) Structures constructed on or after March 1, 2022 that
15are located within migratory flyways, or in ecologically
16sensitive areas (as the Department shall determine), or are
17within one mile of a forest preserve or federal or State park
18or wildlife area shall turn off all lights not required for
19safety or maintenance between 12:00am through 7:00am during
20migratory seasons. The Department shall determine the dates of
21such migratory seasons and shall publish those dates at least
226 months in advance on the Department's Internet website.
23    (c) The Department may adopt such rules as it deems

1necessary to implement the provisions of this Section.
2    (d) As used in this Section, "structure" has the meaning
3provided in Section 9 of the Airport Zoning Act and also
4includes a "wireless support structure" as defined in Section
510 of the Small Wireless Facilities Deployment Act.
 
6    Section 99. Effective date. This Act takes effect upon
7becoming law.
