AMENDMENT TO HOUSE BILL 4988

2    AMENDMENT NO. ______. Amend House Bill 4988 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Environmental Protection Act is amended by
5adding Section 19.11 as follows:
 
6    (415 ILCS 5/19.11 new)
7    Sec. 19.11. Public water supply disruption; notification.
8    (a) In this Section:
9    "Disruption event" means any:
10        (1) change to a disinfection technique, practice, or
11    technology that could change disinfectant levels in the
12    water within a public water supply;
13        (2) planned or unplanned work on or damage to a water
14    main;
15        (3) change in the treatment or source of water that
16    results in an altered finished water quality;

1        (4) event that results in a public water supply's
2    operating pressure falling below 20 PSI; or
3        (5) condition that results in the issuance of a boil
4    water order.
5    "Disruption event" includes, but is not limited to, any
6water main break, system failure or disruption, equipment
7failure, chemical or disinfectant treatment interruption,
8severe storm, earthquake, fire, or flooding or any other
9increase or decrease of water flow.
10    "Health care facility" means a facility, hospital, or
11establishment licensed or organized under the Ambulatory
12Surgical Treatment Center Act, the University of Illinois
13Hospital Act, the Hospital Licensing Act, the Nursing Home
14Care Act, the Assisted Living and Shared Housing Act, or the
15Community Living Facilities Licensing Act.
16    "Health care facility list" means a list enumerating
17health care facilities and their designees that are served by
18a public water supply and maintained by a public water supply
19operator.
20    "Public water supply" has the same meaning as defined in
21Section 3.365.
22    "Public water supply operator" means any of the following
23entities that are responsible for the direct supervision of a
24public water supply: a municipality, a private corporation, an
25individual private owner, or a regularly organized body
26governed by a constitution and by-laws requiring regular

1election of officers.
2    "State agencies" means the Illinois Environmental
3Protection Agency and the Illinois Department of Public
4Health.
5    "Water supply operator" means any individual trained in
6the treatment or distribution of water who has practical
7knowledge of the chemical, biological, and physical sciences
8essential to the practical mechanics of water treatment or
9distribution and who is capable of conducting and maintaining
10the water treatment or distribution processes of a public
11water supply, as defined in Section 3.365 of the Environmental
12Protection Act, in a manner that will provide safe, potable
13water for human consumption.
14    (b) A public water supply operator shall notify all health
15care facilities on the public water supply's health care
16facility list not more than 30 days, but no fewer than 15 days,
17before any known, planned, or anticipated disruption event.
18This requirement includes any disruption event that could or
19should be reasonably anticipated by a public water supply
20operator. The public water supply operator must notify its
21water supply operator in the same timeframe.
22    (c) A public water supply operator shall notify all health
23care facilities served by the public water supply that are
24affected by an unplanned disruption event in the public water
25supply's water distribution system within 2 hours after
26becoming aware of the unplanned disruption event. The public

1water supply operator shall also notify its water supply
2operator in the same timeframe.
3    (d) A health care facility shall designate an email
4address accessible to the health care facility's designated
5management and administrative personnel to receive electronic
6notifications from the public water supply operator concerning
7planned or unplanned disruption events.
8    (e) Any planned or unplanned disruption event notification
9sent to a health care facility under this Section shall also be
10sent to the State agencies within 5 business days.
11Notification shall also be posted on the public water supply
12operator's website that is accessible to the public if such a
13website existed as of January 1, 2022. A public water supply
14operator may provide notification to its customers and the
15public on a social media website rather than posting on its
16website if (1) the public water supply operator uses the
17social media website to regularly communicate with its
18customers; (2) the social media website is accessible to the
19general public; and (3) using the social media website will
20reduce the timeframe for customer notification. The State
21agencies shall establish, maintain, and retain a list of
22notifications received pursuant to this subsection (e).
23    The notice required under this Section shall include, but
24shall not be limited to, the following:
25        (1) a detailed description of the disruption event;
26        (2) the date, time, and location of the disruption

1    event;
2        (3) any action undertaken to correct the disruption
3    event;
4        (4) the expected time needed to resolve the disruption
5    event; and
6        (5) a list of the health care facilities notified by
7    the public water supply operator.
8    Each month, the State agencies shall publish on their
9websites a list of disruptions events that have occurred in
10the preceding month.
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.".
