SYNOPSIS AS INTRODUCED:
 
415 ILCS 5/19.11 new

    Amends the Environmental Protection Act. Requires public water supply operators to notify specified health care facilities at least 30 days prior to any known, planned, or anticipated disruption event and within one hour after being aware of an unplanned disruption event. Provides that any planned or unplanned disruption event notification sent to a health care facility shall be sent to the Environmental Protection Agency and the Department of Public Health and shall be posted on the public water supply operator's website. Contains notification requirements. Contains other provisions. Effective immediately.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5adding Section 19.11 as follows:
 
6    (415 ILCS 5/19.11 new)
7    Sec. 19.11. Public water supply disruption; notification.
8    (a) In this Section:
9    "Health care facility" means a facility, hospital, or
10establishment licensed or organized under the Ambulatory
11Surgical Treatment Center Act, the University of Illinois
12Hospital Act, the Hospital Licensing Act, the Nursing Home
13Care Act, the Assisted Living and Shared Housing Act, or the
14Community Living Facilities Licensing Act.
15    "Health care facility list" means a list enumerating
16health care facilities and their designees that are served by
17a public water supply and maintained by a public water supply
18operator.
19    "Public water supply" has the same meaning as defined in
20Section 3.365.
21    "Public water supply operator" means a municipal or
22private corporation, individual private ownership, or a
23regularly organized body governed by a constitution and

1by-laws requiring regular election of officers under which a
2public water supply is under the direct supervision of.
3    "State agencies" means the Illinois Environmental
4Protection Agency and the Illinois Department of Public
5Health.
6    (b) A public water supply operator shall notify all health
7care facilities on the public water supply's health care
8facility list at least 30 days prior to any known, planned, or
9anticipated disruption event. This requirement includes any
10disruption event that could or should be reasonably
11anticipated by a public water supply operator. A known,
12planned, or anticipated disruption event includes, but is not
13limited to, a construction activity, water and sewer system
14maintenance, source water disturbance or maintenance, change
15to chemical treatment or disinfectant, lead pipe and water
16infrastructure replacement, and change to water sourcing,
17pressure, or flow.
18    (c) A public water supply operator shall notify all health
19care facilities served by the public water supply that are
20affected by an unplanned disruption event in the public water
21supply's water distribution system within one hour after being
22aware of the unplanned disruption event. An unplanned
23disruption event includes, but is not limited to, a flooding,
24water main break, system failure and disruption, equipment
25failure, chemical and disinfectant treatment interruption,
26severe storm, earthquake, major fire, flow change, and other

1known or discovered water pressure loss that lowers the public
2water supply's operating pressure below 20 PSI.
3    (d) A health care facility shall designate a contact
4person for the health care facility list who will receive
5electronic notifications from the public water supply operator
6when there is a planned or unplanned disruption to the health
7care facility's water supply.
8    (e) Any planned or unplanned disruption event notification
9sent to a health care facility under this Section shall also be
10sent to the State agencies. Notification shall also be posted
11on the public water supply operator's website that is
12accessible to the public. The State agencies shall establish
13and maintain a list of notifications that shall be represented
14graphically on a map of Illinois and posted on a publicly
15accessible website. The website shall be available to the
16public no later than 150 days after the effective date of this
17amendatory Act of the 102nd General Assembly.
18    The notice required under this Section shall include, but
19shall not be limited to, the following:
20        (1) The specifics that define the planned or unplanned
21    disruption event.
22        (2) The date, time, and location of the planned or
23    unplanned disruption event.
24        (3) Any action undertaken to correct the planned or
25    unplanned disruption event.
26        (4) The expected time needed to resolve the planned or

1    unplanned disruption event.
 
2    Section 99. Effective date. This Act takes effect upon
3becoming law.
