SYNOPSIS AS INTRODUCED:
 
20 ILCS 2105/2105-15.8 new

    Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Provides for continuing education cultural competency trainings for a health care professional. Defines "cultural competency" and "health care professional". Provides that the cultural competency training includes information on sensitivity relating to providing affirming care to people in the person's preferred language, people with disabilities, people who are intersex, people living with HIV, and people of diverse sexual orientations and gender identities. Provides that for the first license or registration renewal occurring after the effective date of the amendatory Act, a health care professional who has continuing education requirements must complete at least 5 hours in cultural competency training. Provides that for the first license or registration renewal occurring after the effective date of the amendatory Act, a person licensed or registered by the Department of Financial and Professional Regulation under the Medical Practice Act of 1987 and who has continuing education requirements must complete at least 10 hours in cultural competency training. Provides that the hours required for cultural competency count toward meeting minimum hours required for continuing education. Provides the Department may adopt rules for the implementation of this Section. Effective January 1, 2023.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Professional Regulation Law
5of the Civil Administrative Code of Illinois is amended by
6adding Section 2105-15.8 as follows:
 
7    (20 ILCS 2105/2105-15.8 new)
8    Sec. 2105-15.8. Continuing education; health care cultural
9competency trainings.
10    (a) As used in this Section:
11    "Cultural competency" means a set of integrated attitudes,
12knowledge, and skills that enables a health care professional
13or organization to care effectively for patients from diverse
14cultures, groups, and communities. "Cultural competency"
15includes, but is not limited to: (i) applying linguistic
16skills to communicate effectively with the target population;
17(ii) utilizing cultural information to establish therapeutic
18relationships; (iii) eliciting and incorporating pertinent
19cultural data in diagnosis and treatment; and (iv)
20understanding and applying cultural and ethnic data to the
21process of clinic care.
22    "Health care professional" means a person licensed or
23registered by the Department of Financial and Professional

1Regulation under the Nurse Practice Act, the Clinical
2Psychologist Licensing Act, the Illinois Dental Practice Act,
3the Pharmacy Practice Act, the Illinois Physical Therapy Act,
4the Physician Assistant Practice Act of 1987, the Acupuncture
5Practice Act, the Illinois Athletic Trainers Practice Act, the
6Clinical Social Work and Social Work Practice Act, the
7Dietitian Nutritionist Practice Act, the Home Medical
8Equipment and Services Provider License Act, the Naprapathic
9Practice Act, the Nursing Home Administrators Licensing and
10Disciplinary Act, the Illinois Occupational Therapy Practice
11Act, the Illinois Optometric Practice Act of 1987, the
12Podiatric Medical Practice Act of 1987, the Respiratory Care
13Practice Act, the Professional Counselor and Clinical
14Professional Counselor Licensing and Practice Act, the Sex
15Offender Evaluation and Treatment Provider Act, the Illinois
16Speech-Language Pathology and Audiology Practice Act, the
17Perfusionist Practice Act, the Registered Surgical Assistant
18and Registered Surgical Technologist Title Protection Act, the
19Genetic Counselor Licensing Act, and the Licensed Certified
20Professional Midwife Practice Act.
21    (b) The cultural competency training required by this
22Section shall include information on sensitivity relating to
23and best practices for providing affirming care to people in
24the person's preferred language, people with disabilities,
25people who are intersex, people living with HIV, and people of
26diverse sexual orientations and gender identities, including,

1but not limited to, lesbian, gay, bisexual, transgender,
2queer, pansexual, asexual, and questioning individuals.
3    (c) For the first license or registration renewal
4occurring on or after the effective date of this amendatory
5Act of the 102nd General Assembly, a health care professional
6who has continuing education requirements must complete at
7least 5 hours in cultural competency training. For every
8license or registration renewal occurring thereafter, a health
9care professional must complete hours in cultural competency
10training per renewal period that are equal to 10% of the total
11hours required for continuing education but not to exceed 5
12hours in cultural competency training per renewal period.
13    (d) For the first license or registration renewal
14occurring on or after the effective date of this amendatory
15Act of the 102nd General Assembly, a person licensed or
16registered by the Department of Financial and Professional
17Regulation under the Medical Practice Act of 1987 and who has
18continuing education requirements must complete at least 10
19hours in cultural competency training. For every license or
20registration renewal occurring thereafter, a person licensed
21or registered by the Department of Financial and Professional
22Regulation under the Medical Practice Act of 1987 must
23complete at least 5 hours in cultural competency training per
24renewal period.
25    (e) The hours required by this Section may count toward
26meeting the minimum credit hours required for continuing

1education. Any cultural competency training applied to meet
2any other State licensure requirement, professional
3accreditation or certification requirement, or health care
4institutional practice agreement may count toward the
5requirements under this Section.
6    (f) The Department may adopt rules for the implementation
7of this Section.
 
8    Section 99. Effective date. This Act takes effect January
91, 2023.
