2    AMENDMENT NO. ______. Amend House Bill 4414 by replacing
3everything after the enacting clause with the following:
4    "Section 5. The Expressway Camera Act is amended by
5changing Sections 5 and 90 as follows:
6    (605 ILCS 140/5)
7    (Section scheduled to be repealed on July 1, 2023)
8    Sec. 5. Camera program.
9    (a) The Illinois State Police, the Illinois Department of
10Transportation, and the Illinois State Toll Highway Authority
11shall work together to conduct a program to increase the
12amount of cameras along expressways and the State highway
13system in the counties of Boone, Bureau, Champaign, Cook,
14DeKalb, DuPage, Grundy, Henry, Kane, Kendall, Lake, LaSalle,
15Macon, Madison, McHenry, Morgan, Peoria, Sangamon, St. Clair,
16Will, and Winnebago Cook County.

1    (b) Images from the cameras may be used by any municipal
2police department, county sheriff's office, State Police
3officer, or other law enforcement agency with jurisdiction
4over the expressway in Cook County in the investigation of any
5violent offenses, including, but not limited to, offenses
6offense involving the use of a firearm and vehicular
7hijacking, and to detect expressway hazards. Images from the
8cameras shall not be used to enforce petty offenses. Images
9from the cameras may be used by any law enforcement agency
10conducting an active law enforcement investigation involving a
11violent offense.
12    (c) Subject to appropriation, any funds needed to conduct
13the program for use on expressways under the jurisdiction of
14the Department of Transportation shall be taken from the Road
15Fund. Any funds needed to conduct the program for use on
16expressways under the jurisdiction of the Illinois State Toll
17Highway Authority shall be paid for by funds from the Illinois
18State Tollway Highway Authority.
19    (d) As used in this Section, "expressway" has the meaning
20provided in Section 1-119.3 of the Illinois Vehicle Code.
