| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Decennial Committees on Local Government | 5 | | Efficiency Act is amended by changing Sections 5, 10, 20, and | 6 | | 25 as follows: | 7 | | (50 ILCS 70/5)
| 8 | | Sec. 5. Definitions Definition . As used in this Act : , | 9 | | "Governing board" means the governing body of a | 10 | | governmental unit. If the governmental unit is a road | 11 | | district, then "governing board" means the governing body of | 12 | | the road district, as provided in Division 1 of Article 6 of | 13 | | the Illinois Highway Code, including, but not limited to, the | 14 | | highway board of auditors, the highway commissioner of a | 15 | | township road district, the township board of trustees, the | 16 | | city council, the municipal president and board of trustees, | 17 | | or the county board, as applicable. | 18 | | " Governmental unit" means all entities that levy taxes and | 19 | | are also units of local government, as defined in Section 1 of | 20 | | Article VII of the Illinois Constitution, governmental unit" | 21 | | includes all units of local government that may levy any tax, | 22 | | except municipalities and counties.

| 2 | | Sec. 10. Formation of committee; members; vacancy; | 3 | | administrative support.
| 4 | | (a) By June 10, 2023 ( Within one year after the effective | 5 | | date of this Act ) and at least once every 10 years after June | 6 | | 10, 2023 thereafter , each governmental unit must form a | 7 | | committee to study local efficiencies and report | 8 | | recommendations regarding efficiencies and increased | 9 | | accountability to the county board in which the governmental | 10 | | unit is located. | 11 | | (b) Each committee's membership shall include the elected | 12 | | or appointed members of the governing board of the | 13 | | governmental unit; at least 2 residents within the territory | 14 | | served by of the governmental unit, who are appointed by the | 15 | | chair of the governing board of the governmental unit , with | 16 | | the advice and consent of the governing board; and any chief | 17 | | executive officer or other officer of the governmental unit. | 18 | | The committee shall be chaired by the president or chief | 19 | | elected or appointed official of the governing board of the | 20 | | governmental unit, or his or her designee. The chairperson may | 21 | | appoint additional members to the committee as the chairperson | 22 | | he or she deems appropriate. | 23 | | Committee members shall serve without compensation but may | 24 | | be reimbursed by the governmental unit for their expenses | 25 | | incurred in performing their duties. |

| 1 | | (b-5) In lieu of the committee described in subsection | 2 | | (a), a highway commissioner of a township road district in a | 3 | | county with a population under 400,000 and the township board | 4 | | of the same township may form a joint committee for the | 5 | | purposes described in subsection (a). That joint committee | 6 | | shall include: the township trustees; the highway | 7 | | commissioner; at least 2 residents of the territory served by | 8 | | the governmental unit appointed by the township supervisor | 9 | | with the advice and consent of the township board; at least one | 10 | | resident of the governmental unit appointed by the highway | 11 | | commissioner; and the township supervisor. The joint committee | 12 | | shall be chaired by the township supervisor and shall issue a | 13 | | joint report with 2 sections, one section for the township and | 14 | | one section for the road district. Except with respect to its | 15 | | composition and report, the joint committee shall otherwise | 16 | | comply with subsection (b). References in this Act to a | 17 | | "committee" shall also include a joint committee formed under | 18 | | this subsection. | 19 | | (c) A committee may employ or use the services of | 20 | | specialists in public administration and governmental | 21 | | management and any other trained consultants, analysts, | 22 | | investigators, and assistants it considers appropriate, and it | 23 | | may seek assistance from community colleges and universities | 24 | | as necessary to prepare the report required under Section 25. | 25 | | (d) If a vacancy occurs in the committee membership, the | 26 | | vacancy shall be filled in the same manner as the appointments |

| 1 | | under subsection (b). | 2 | | (e) Each governmental unit shall provide administrative | 3 | | and other support to its committee.

| 6 | | Sec. 20. Meetings. Each committee shall meet at least 3 | 7 | | times. The committee may meet during a regularly scheduled | 8 | | meeting of the governmental unit as long as: (1) separate | 9 | | notice is given in conformance with the Open Meetings Act; (2) | 10 | | the committee meeting is listed as part of the governing | 11 | | board's board of the governmental unit's agenda; and (3) at | 12 | | least a majority of the members of the committee are present at | 13 | | the committee's meeting. Each meeting of the committee shall | 14 | | be public, and the committee shall provide an opportunity for | 15 | | any person to be heard at the public hearings for at least 3 | 16 | | minutes. The committee may require speakers to register. The | 17 | | committee shall meet in accordance with the Open Meetings Act, | 18 | | and the committee shall be a public body to which the Freedom | 19 | | of Information Act applies. | 20 | | At the conclusion of each meeting, the committee shall | 21 | | conduct a survey of residents who attended asking for input on | 22 | | the matters discussed at the meeting. A survey conducted via
| 23 | | email to all residents who attended the meeting and provided a
| 24 | | valid email address will be sufficient to satisfy the
| 25 | | requirements of this paragraph.

| 3 | | Sec. 25. Report. Each committee shall summarize its work | 4 | | and findings within a written report, which shall include | 5 | | recommendations in respect to increased accountability and | 6 | | efficiency, and shall provide the report to the administrative | 7 | | office of each county board in which the governmental unit is | 8 | | located no later than 18 months after the formation of the | 9 | | committee. The report shall be made available to the public.
| 10 | | For purposes of this Section, if a governmental unit is
| 11 | | located in multiple counties, the committee may, if required, | 12 | | provide the

The State Mandates Act is amended by adding | 16 | | Section 8.47 as follows: | 17 | | (30 ILCS 805/8.47 new) | 18 | | Sec. 8.47. Exempt mandate. Notwithstanding Sections 6 and | 19 | | 8 of this Act, no reimbursement by the State is required for | 20 | | the implementation of any mandate created by the Decennial | 21 | | Committees on Local Government Efficiency Act.
| 22 | | Section 99. Effective date. This Act takes effect upon | 23 | | becoming law.
