AMENDMENT TO HOUSE BILL 2878

2    AMENDMENT NO. ______. Amend House Bill 2878 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5Student Parent Data Collection Act.
 
6    Section 5. Definitions. In this Act:
7    "Parent" means the parent or legal guardian of a child who
8is under the age of 18 years.
9    "Public institution of higher education" or "institution"
10means a public community college or public university in this
11State.
 
12    Section 10. Student parent data collection.
13    (a) The Board of Higher Education, in consultation with
14the Illinois Community College Board, public institutions of
15higher education, and advocates, shall prepare a question or

1questions to be placed on one or more forms that are used by an
2institution on an annual basis to collect demographic data
3from its students for the purpose of determining the parental
4status or legal guardian status of each of its enrolled
5students.
6    (b) The data collected under subsection (a) must be
7disaggregated by all variables collected normally, including,
8but not limited to, the student's race, ethnicity, income,
9gender, age, enrollment status, type of credential sought,
10receipt of financial aid, grade point average, persistence
11toward a degree or credential, and completion outcomes.
 
12    Section 15. Campus child care. Beginning September 1,
132021, each public institution of higher education that
14operates one or more child care centers or early learning
15centers on its campus or is otherwise affiliated with a child
16care center or early learning center shall collect all of the
17following information:
18        (1) The total number of children who are served by
19    each child care center or early learning center per
20    semester.
21        (2) The number of children of students who are
22    enrolled at the institution who are served by each child
23    care center or early learning center per semester.
 
24    Section 20. Reporting requirements.

1    (a) On or before July 1, 2022 and annually thereafter,
2each public university shall report the data collected under
3Sections 10 and 15 to the Board of Higher Education, and each
4public community college shall report the data collected under
5Sections 10 and 15 to the Illinois Community College Board.
6    (b) Each institution, the Board of Higher Education, and
7the Illinois Community College Board shall make the data
8reported under subsection (a) publicly available annually on
9their Internet websites.
10    (c) The Board of Higher Education and the Illinois
11Community College Board, in consultation with public
12institutions of higher education and advocates, may adopt
13rules concerning the reporting of data to protect student
14privacy while satisfying the requirements of this Act.
 
15    Section 25. Family Educational Rights and Privacy Act of
161974. The sharing and reporting of data under this Act must be
17in accordance with the requirements of the federal Family
18Educational Rights and Privacy Act of 1974. Nothing in this
19Act supersedes the federal Family Educational Rights and
20Privacy Act of 1974 or rules adopted pursuant to the federal
21Family Educational Rights and Privacy Act of 1974 or any
22federal or State laws and rules governing student privacy
23rights.
 
24    Section 99. Effective date. This Act takes effect July 1,
