AMENDMENT TO HOUSE BILL 2616

2    AMENDMENT NO. ______. Amend House Bill 2616 on page 7, by
3replacing lines 13 through 26 with the following:
 
4        "(19) Acquisition of modifications or adjustments,
5    including, but not limited to, assistive technology
6    devices and assistive technology services, adaptive
7    equipment, repairs, and replacement parts to provide
8    reasonable accommodations (i) that enable a qualified
9    applicant with a disability to complete the job
10    application process and be considered for the position
11    such qualified applicant desires, (ii) that modify or
12    adjust the work environment to enable a qualified current
13    employee with a disability to perform the essential
14    functions of the position held by that employee, (iii) to
15    enable a qualified current employee with a disability to
16    enjoy equal benefits and privileges of employment as are
17    enjoyed by its other similarly situated employees without

1    disabilities, and (iv) that allow a customer, client,
2    claimant or member of the public seeking State services
3    full use and enjoyment of and access to its programs,
4    services, or benefits.
5        For purposes of this paragraph (19):
6        "Assistive technology devices" means any item, piece
7    of equipment, or product system, whether acquired
8    commercially off the shelf, modified, or customized, that
9    is used to increase, maintain, or improve functional
10    capabilities of individuals with disabilities.
11        "Assistive technology services" means any service that
12    directly assists an individual with a disability in
13    selection, acquisition, or use of an assistive technology
14    device.
15        "Qualified" has the same meaning and use as provided
16    under the federal Americans with Disabilities Act when
17    describing an individual with a disability.".
