SYNOPSIS AS INTRODUCED:
 
20 ILCS 1005/1005-107 new

    Amends the Department of Employment Security Law. Directs the Department of Employment Security to take necessary actions to ensure that Illinois residents interact safely and legitimately with the Department under the Unemployment Insurance Act. Requires the Department to regularly review its practices and implement strategies, including the adoption of a two-factor authentication system to process claims. Requires the Department to conduct a study of its practices and report its findings to the General Assembly.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Employment Security Law of
5the Civil Administrative Code of Illinois is amended by adding
6Section 1005-107 as follows:
 
7    (20 ILCS 1005/1005-107 new)
8    Sec. 1005-107. Secure administration of the Unemployment
9Insurance Act.
10    (a) The Department must source and take any necessary
11actions to quickly implement any and all methods to ensure
12that all Illinois residents are safely and legitimately
13interacting with the Department as it relates to the
14Unemployment Insurance Act, including, but not limited to, the
15application for and receipt of unemployment benefits. The
16Department, in the interest of increased security and identity
17theft protection, must regularly review its systems and
18practices and implement any strategies or processes necessary
19to protect the accuracy of any unemployment claims or
20benefits, including the adoption of a two-factor
21authentication system for all online-based claims and benefits
22portals, websites, and processes. The Department must,
23further, conduct a study of:

1        (1) current processes, practices, and systems utilized
2    by the Department; and
3        (2) other State processes, practices, and systems,
4    including a study of any methods that other states use to
5    protect the identity and security of their online systems.
6    (b) The Department shall report to the Governor and the
7General Assembly the findings of this study and include any
8real or perceived deficiencies in current practices and
9processes as they relate to issues of identity theft,
10fraudulent activity, and data security within 30 days after
11the effective date of this amendatory Act of the 102nd General
12Assembly.
