AMENDMENT TO HOUSE BILL 1953

2    AMENDMENT NO. ______. Amend House Bill 1953 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Election Code is amended by changing
5Sections 2A-1.1b, 7-4, 7-10, 8-8, and 19-2 as follows:
 
6    (10 ILCS 5/2A-1.1b)
7    (Section scheduled to be repealed on January 1, 2023)
8    Sec. 2A-1.1b. 2022 general primary election and general
9election dates.
10    (a) In addition to the provisions of this Code and
11notwithstanding any other law to the contrary, the provisions
12in this Section shall govern the dates for the conduct of the
132022 general primary election and for preparing for the 2022
14general election. The provisions of this Code shall control
15any aspect of the administration or conduct of the 2022
16general primary election and 2022 general election that is not

1provided for in this Section, provided that in the event of
2conflict between this Section and any other provision of this
3Code or any other law, the provisions of this Section shall
4control. The provisions of this Section shall apply to all
5election authorities, including, but not limited to, those
6under the jurisdiction of a Board of Election Commissioners.
7The provisions of this Section shall apply for the dates for
8the 2022 general primary election and the 2022 general
9election only and the provisions of this amendatory Act of the
10102nd General Assembly shall be in effect through December 31,
112022.
12    (b) Petitions for nomination for the general primary
13election may begin circulation on January 13, 2022. All
14petitions for nomination of an established party candidate for
15statewide office shall be signed by at least 3,250 but not more
16than 6,500 of the qualified primary electors of the
17candidate's party. All petitions for nomination of an
18established party candidate for the office of Representative
19in the General Assembly shall be signed by at least 400 but not
20more than 1,000 of the qualified primary electors of the
21candidate's party in the candidate's representative district.
22All petitions for nomination of an established party candidate
23for the office of State Senator shall be signed by at least 650
24but not more than 2,000 of the qualified primary electors of
25the candidate's party in the candidate's legislative district.

1for all other offices shall be reduced by one-third and any
2provision of this Code limiting the maximum number of
3signatures that may be submitted for those offices shall be
4reduced by one-third.
5    (c) Petitions for nomination for congressional, or
6judicial office, or for any office a nomination for which is
7made for a territorial division or district which comprises
8more than one county or is partly in one county and partly in
9another county or counties (including the Fox Metro Water
10Reclamation District) for the general primary election may be
11filed in the principal office of the State Board of Elections
12beginning on March 7, 2022 but no later than March 14, 2022; a
13petition for nomination to fill a vacancy by special election
14in the office of representative in Congress from this State
15(for vacancies occurring between February 21, 2022 and March
1614, 2022) for the general primary election may be filed in the
17principal office of the State Board of Elections beginning
18March 28, 2022 but no later than April 4, 2022.
19    (d) Objections to certificates of nomination and
20nomination papers and petitions to submit public questions to
21a referendum for the general primary election shall be filed
22no later than March 21, 2022.
23    (e) Notwithstanding any provision of Section 19-2 to the
24contrary, electors Electors may request vote by mail ballots
25for the general primary election beginning on March 30, 2022
26but no later than June 23, 2022.

1    (f) Petitions for nomination for independent candidates
2and new political party candidates for the general election
3may begin circulation on April 13, 2022.
4    (g) The State Board of Elections shall certify the names
5of candidates who filed nomination papers or certificates of
6nomination for the general primary election with the Board no
7later than April 21, 2022.
8    (h) A notarized declaration of intent to be a write-in
9candidate for the general primary election shall be filed with
10the proper election authority or authorities no later than
11April 28, 2022.
12    (i) Each election authority shall mail ballots to each
13person who has filed an application for a ballot for the
14general primary election under Article 20 no later than May
1514, 2022, and any application received after May 12, 2022
16shall be mailed within 2 business days after receipt of the
17application.
18    (j) The period for early voting by personal appearance for
19the general primary election shall begin on May 19, 2022.
20    (k) The general primary election shall be held on June 28,
212022.
22    (l) The last day for an established party managing
23committee to appoint someone to fill a vacancy for the general
24election when no candidate was nominated at the general
25primary election and for the appointee to file the required
26documentation is July 25, 2022. The signature requirement for

1an established party candidate filing to fill a vacancy shall
2be reduced by two-thirds and any provision of this Code
3limiting the maximum number of signatures that may be
4submitted for those offices shall be reduced by two-thirds.
5Objections to nomination papers, certificates of nomination,
6or resolutions for established party candidates filing to fill
7a vacancy shall be filed no later than August 1, 2022.
8    (m) Certificates of nomination and nomination papers for
9the nomination of new political parties and independent
10candidates for offices to be filled by electors of the entire
11State, or any district not entirely within a county, or for
12congressional, State legislative or judicial offices shall be
13presented to the principal office of the State Board of
14Elections beginning July 5, 2022 but no later than July 11,
152022. Certificates of nomination and nomination papers for the
16nomination of new political parties and independent candidates
17for all other offices shall be presented to the appropriate
18election authority or local election official with whom such
19nomination papers are filed beginning July 5, 2022 but no
20later than July 11, 2022.
21    (n) Objections to certificates of nomination and
22nomination papers for new political parties and independent
23candidates for the general election shall be filed no later
24than July 18, 2022.

4    Sec. 7-4. The following words and phrases in this Article
57 shall, unless the same be inconsistent with the context, be
6construed as follows:
7    1. The word "primary", the primary elections provided for
8in this Article, which are the general primary, the
9consolidated primary, and for those municipalities which have
10annual partisan elections for any officer, the municipal
11primary held 6 weeks prior to the general primary election
12date in even numbered years.
13    2. The definitions of terms in Section 1-3 of this Code
14shall apply to this Article.
15    3. The word "precinct", a voting district heretofore or
16hereafter established by law within which all qualified
17electors vote at one polling place.
18    4. The words "state office" or "state officer", an office
19to be filled, or an officer to be voted for, by qualified
20electors of the entire state, including United States Senator
21and Congressperson at large.
22    5. The words "congressional office" or "congressional
23officer", representatives in Congress.
24    6. The words "county office" or "county officer," include
25an office to be filled or an officer to be voted for, by the

1qualified electors of the entire county. "County office" or
2"county officer" also include the assessor and board of
3appeals and county commissioners and president of county board
4of Cook County, and county board members and the chair of the
5county board in counties subject to Division 2-3 of the
6Counties Code.
7    7. The words "city office" and "village office," and
8"incorporated town office" or "city officer" and "village
9officer", and "incorporated town officer", an office to be
10filled or an officer to be voted for by the qualified electors
11of the entire municipality, including alderpersons.
12    8. The words "town office" or "town officer", an office to
13be filled or an officer to be voted for by the qualified
14electors of an entire town.
15    9. The words "town" and "incorporated town" shall
16respectively be defined as in Section 1-3 of this Code.
17    10. The words "delegates and alternate delegates to
18National nominating conventions" include all delegates and
19alternate delegates to National nominating conventions whether
20they be elected from the state at large or from congressional
21districts or selected by State convention unless contrary and
22non-inclusive language specifically limits the term to one
23class.
24    11. "Judicial office" means a post held by a judge of the
25Supreme, Appellate, or Circuit Court.
26    "State Central Committeeperson" includes "committeeman" or

1"committeewoman" for those persons elected or appointed under
2State Central Committee Alternative B under Section 7-8.

5    Sec. 7-10. Form of petition for nomination. The name of no
6candidate for nomination, or State central committeeperson, or
7township committeeperson, or precinct committeeperson, or ward
8committeeperson or candidate for delegate or alternate
9delegate to national nominating conventions, shall be printed
10upon the primary ballot unless a petition for nomination has
11been filed in his behalf as provided in this Article in
12substantially the following form:
13    We, the undersigned, members of and affiliated with the

16Illinois, do hereby petition that the following named person
17or persons shall be a candidate or candidates of the .... party

17    Each sheet of the petition other than the statement of
18candidacy and candidate's statement shall be of uniform size
19and shall contain above the space for signatures an
20appropriate heading giving the information as to name of
21candidate or candidates, in whose behalf such petition is
22signed; the office, the political party represented and place
23of residence; and the heading of each sheet shall be the same.

1    Such petition shall be signed by qualified primary
2electors residing in the political division for which the
3nomination is sought in their own proper persons only and
4opposite the signature of each signer, his residence address
5shall be written or printed. The residence address required to
6be written or printed opposite each qualified primary
7elector's name shall include the street address or rural route
8number of the signer, as the case may be, as well as the
9signer's county, and city, village or town, and state.
10However, the county or city, village or town, and state of
11residence of the electors may be printed on the petition forms
12where all of the electors signing the petition reside in the
13same county or city, village or town, and state. Standard
14abbreviations may be used in writing the residence address,
15including street number, if any. At the bottom of each sheet of
16such petition shall be added a circulator statement signed by
17a person 18 years of age or older who is a citizen of the
18United States, stating the street address or rural route
19number, as the case may be, as well as the county, city,
20village or town, and state; and certifying that the signatures
21on that sheet of the petition were signed in his or her
22presence and certifying that the signatures are genuine; and
23either (1) indicating the dates on which that sheet was
24circulated, or (2) indicating the first and last dates on
25which the sheet was circulated, or (3) for elections where the
26petition circulation period is 90 days, certifying that none

1of the signatures on the sheet were signed more than 90 days
2preceding the last day for the filing of the petition, or (4)
3for the 2022 general primary election only, certify that the
4signatures on the sheet were signed during the period of
5January 13, 2022 through March 14, 2022 or certify that the
6signatures on the sheet were signed during the period of
7January 13, 2022 through the date on which this Statement was
8sworn or affirmed to and certifying that to the best of his or
9her knowledge and belief the persons so signing were at the
10time of signing the petitions qualified voters of the
11political party for which a nomination is sought. Such
12statement shall be sworn to before some officer authorized to
13administer oaths in this State.
14    Except as otherwise provided in this Code, no petition
15sheet shall be circulated more than 90 days preceding the last
16day provided in Section 7-12 for the filing of such petition.
17    The person circulating the petition, or the candidate on
18whose behalf the petition is circulated, may strike any
19signature from the petition, provided that:
20        (1) the person striking the signature shall initial
21    the petition at the place where the signature is struck;
22    and
23        (2) the person striking the signature shall sign a
24    certification listing the page number and line number of
25    each signature struck from the petition. Such
26    certification shall be filed as a part of the petition.

1    Such sheets before being filed shall be neatly fastened
2together in book form, by placing the sheets in a pile and
3fastening them together at one edge in a secure and suitable
4manner, and the sheets shall then be numbered consecutively.
5The sheets shall not be fastened by pasting them together end
6to end, so as to form a continuous strip or roll. All petition
7sheets which are filed with the proper local election
8officials, election authorities or the State Board of
9Elections shall be the original sheets which have been signed
10by the voters and by the circulator thereof, and not
11photocopies or duplicates of such sheets. Each petition must
12include as a part thereof, a statement of candidacy for each of
13the candidates filing, or in whose behalf the petition is
14filed. This statement shall set out the address of such
15candidate, the office for which he is a candidate, shall state
16that the candidate is a qualified primary voter of the party to
17which the petition relates and is qualified for the office
18specified (in the case of a candidate for State's Attorney it
19shall state that the candidate is at the time of filing such
20statement a licensed attorney-at-law of this State), shall
21state that he has filed (or will file before the close of the
22petition filing period) a statement of economic interests as
23required by the Illinois Governmental Ethics Act, shall
24request that the candidate's name be placed upon the official
25ballot, and shall be subscribed and sworn to by such candidate

8    The petitions, when filed, shall not be withdrawn or added
9to, and no signatures shall be revoked except by revocation
10filed in writing with the State Board of Elections, election
11authority or local election official with whom the petition is
12required to be filed, and before the filing of such petition.
13Whoever forges the name of a signer upon any petition required
14by this Article is deemed guilty of a forgery and on conviction
15thereof shall be punished accordingly.
16    A candidate for the offices listed in this Section must
17obtain the number of signatures specified in this Section on
18his or her petition for nomination.
19    (a) Statewide office or delegate to a national nominating
20convention. Except as otherwise provided in this Code, if a
21candidate seeks to run for statewide office or as a delegate or
22alternate delegate to a national nominating convention elected
23from the State at-large, then the candidate's petition for
24nomination must contain at least 5,000 but not more than
2510,000 signatures.

1    (b) Congressional office or congressional delegate to a
2national nominating convention. Except as otherwise provided
3in this Code, if a candidate seeks to run for United States
4Congress or as a congressional delegate or alternate
5congressional delegate to a national nominating convention
6elected from a congressional district, then the candidate's
7petition for nomination must contain at least the number of
8signatures equal to 0.5% of the qualified primary electors of
9his or her party in his or her congressional district. In the
10first primary election following a redistricting of
11congressional districts, a candidate's petition for nomination
12must contain at least 600 signatures of qualified primary
13electors of the candidate's political party in his or her
14congressional district.
15    (c) County office. Except as otherwise provided in this
16Code, if a candidate seeks to run for any countywide office,
17including, but not limited to, county board chairperson or
18county board member, elected on an at-large basis, in a county
19other than Cook County, then the candidate's petition for
20nomination must contain at least the number of signatures
21equal to 0.5% of the qualified electors of his or her party who
22cast votes at the last preceding general election in his or her
23county. If a candidate seeks to run for county board member
24elected from a county board district, then the candidate's
25petition for nomination must contain at least the number of
26signatures equal to 0.5% of the qualified primary electors of

1his or her party in the county board district. In the first
2primary election following a redistricting of county board
3districts or the initial establishment of county board
4districts, a candidate's petition for nomination must contain
5at least the number of signatures equal to 0.5% of the
6qualified electors of his or her party in the entire county who
7cast votes at the last preceding general election divided by
8the total number of county board districts comprising the
9county board; provided that in no event shall the number of
10signatures be less than 25.
11    (d) County office; Cook County only.
12        (1) If a candidate seeks to run for countywide office
13    in Cook County, then the candidate's petition for
14    nomination must contain at least the number of signatures
15    equal to 0.5% of the qualified electors of his or her party
16    who cast votes at the last preceding general election in
17    Cook County.
18        (2) If a candidate seeks to run for Cook County Board
19    Commissioner, then the candidate's petition for nomination
20    must contain at least the number of signatures equal to
21    0.5% of the qualified primary electors of his or her party
22    in his or her county board district. In the first primary
23    election following a redistricting of Cook County Board of
24    Commissioners districts, a candidate's petition for
25    nomination must contain at least the number of signatures
26    equal to 0.5% of the qualified electors of his or her party

1    in the entire county who cast votes at the last preceding
2    general election divided by the total number of county
3    board districts comprising the county board; provided that
4    in no event shall the number of signatures be less than 25.
5        (3) Except as otherwise provided in this Code, if a
6    candidate seeks to run for Cook County Board of Review
7    Commissioner, which is elected from a district pursuant to
8    subsection (c) of Section 5-5 of the Property Tax Code,
9    then the candidate's petition for nomination must contain
10    at least the number of signatures equal to 0.5% of the
11    total number of registered voters in his or her board of
12    review district in the last general election at which a
13    commissioner was regularly scheduled to be elected from
14    that board of review district. In no event shall the
15    number of signatures required be greater than the
16    requisite number for a candidate who seeks countywide
17    office in Cook County under subsection (d)(1) of this
18    Section. In the first primary election following a
19    redistricting of Cook County Board of Review districts, a
20    candidate's petition for nomination must contain at least
21    4,000 signatures or at least the number of signatures
22    required for a countywide candidate in Cook County,
23    whichever is less, of the qualified electors of his or her
24    party in the district.
25    (e) Municipal or township office. If a candidate seeks to
26run for municipal or township office, then the candidate's

1petition for nomination must contain at least the number of
2signatures equal to 0.5% of the qualified primary electors of
3his or her party in the municipality or township. If a
4candidate seeks to run for alderperson of a municipality, then
5the candidate's petition for nomination must contain at least
6the number of signatures equal to 0.5% of the qualified
7primary electors of his or her party of the ward. In the first
8primary election following redistricting of wards or trustee
9districts of a municipality or the initial establishment of
10wards or districts, a candidate's petition for nomination must
11contain the number of signatures equal to at least 0.5% of the
12total number of votes cast for the candidate of that political
13party who received the highest number of votes in the entire
14municipality at the last regular election at which an officer
15was regularly scheduled to be elected from the entire
16municipality, divided by the number of wards or districts. In
17no event shall the number of signatures be less than 25.
18    (f) State central committeeperson. If a candidate seeks to
19run for State central committeeperson, then the candidate's
20petition for nomination must contain at least 100 signatures
21of the primary electors of his or her party of his or her
22congressional district.
23    (g) Sanitary district trustee. Except as otherwise
24provided in this Code, if a candidate seeks to run for trustee
25of a sanitary district in which trustees are not elected from
26wards, then the candidate's petition for nomination must

1contain at least the number of signatures equal to 0.5% of the
2primary electors of his or her party from the sanitary
3district. If a candidate seeks to run for trustee of a sanitary
4district in which trustees are elected from wards, then the
5candidate's petition for nomination must contain at least the
6number of signatures equal to 0.5% of the primary electors of
7his or her party in the ward of that sanitary district. In the
8first primary election following redistricting of sanitary
9districts elected from wards, a candidate's petition for
10nomination must contain at least the signatures of 150
11qualified primary electors of his or her ward of that sanitary
12district.
13    (h) Judicial office. Except as otherwise provided in this
14Code, if a candidate seeks to run for judicial office in a
15district, then the candidate's petition for nomination must
16contain the number of signatures equal to 0.4% of the number of
17votes cast in that district for the candidate for his or her
18political party for the office of Governor at the last general
19election at which a Governor was elected, but in no event less
20than 500 signatures. If a candidate seeks to run for judicial
21office in a circuit or subcircuit, then the candidate's
22petition for nomination must contain the number of signatures
23equal to 0.25% of the number of votes cast for the judicial
24candidate of his or her political party who received the
25highest number of votes at the last general election at which a
26judicial officer from the same circuit or subcircuit was

1regularly scheduled to be elected, but in no event less than
21,000 signatures in circuits and subcircuits located in the
3First Judicial District or 500 signatures in every other
4Judicial District.
5    (i) Precinct, ward, and township committeeperson. Except
6as otherwise provided in this Code, if a candidate seeks to run
7for precinct committeeperson, then the candidate's petition
8for nomination must contain at least 10 signatures of the
9primary electors of his or her party for the precinct. If a
10candidate seeks to run for ward committeeperson, then the
11candidate's petition for nomination must contain no less than
12the number of signatures equal to 10% of the primary electors
13of his or her party of the ward, but no more than 16% of those
14same electors; provided that the maximum number of signatures
15may be 50 more than the minimum number, whichever is greater.
16If a candidate seeks to run for township committeeperson, then
17the candidate's petition for nomination must contain no less
18than the number of signatures equal to 5% of the primary
19electors of his or her party of the township, but no more than
208% of those same electors; provided that the maximum number of
21signatures may be 50 more than the minimum number, whichever
22is greater.
23    (j) State's attorney or regional superintendent of schools
24for multiple counties. If a candidate seeks to run for State's
25attorney or regional Superintendent of Schools who serves more
26than one county, then the candidate's petition for nomination

1must contain at least the number of signatures equal to 0.5% of
2the primary electors of his or her party in the territory
3comprising the counties.
4    (k) Any other office. If a candidate seeks any other
5office, then the candidate's petition for nomination must
6contain at least the number of signatures equal to 0.5% of the
7registered voters of the political subdivision, district, or
8division for which the nomination is made or 25 signatures,
9whichever is greater.
10    For purposes of this Section the number of primary
11electors shall be determined by taking the total vote cast, in
12the applicable district, for the candidate for that political
13party who received the highest number of votes, statewide, at
14the last general election in the State at which electors for
15President of the United States were elected. For political
16subdivisions, the number of primary electors shall be
17determined by taking the total vote cast for the candidate for

19in the political subdivision at the last regular election at
20which an officer was regularly scheduled to be elected from

22subdivisions, the number of primary electors shall be
23determined by taking the total vote cast for the candidate for

2    A "qualified primary elector" of a party may not sign
3petitions for or be a candidate in the primary of more than one
4party.
5    The changes made to this Section by Public Act 93-574 are
6declarative of existing law, except for item (3) of subsection
7(d).
8    Petitions of candidates for nomination for offices herein
9specified, to be filed with the same officer, may contain the
10names of 2 or more candidates of the same political party for
11the same or different offices. In the case of the offices of
12Governor and Lieutenant Governor, a joint petition including
13one candidate for each of those offices must be filed.

1that the candidate has filed the statement of economic
2interests required by the Illinois Governmental Ethics Act
3must be filed with the petitions for nomination as provided in
4subsection (8) of Section 7-12 of this Code.
5    Except as otherwise provided in this Code, all petitions
6for nomination for the office of State Senator shall be signed
7by at least 1,000 but not more than 3,000 of the qualified
8primary electors of the candidate's party in his legislative
9district.
10    Except as otherwise provided in this Code, all petitions
11for nomination for the office of Representative in the General
12Assembly shall be signed by at least 500 but not more than
131,500 of the qualified primary electors of the candidate's
14party in his or her representative district.
15    Opposite the signature of each qualified primary elector
16who signs a petition for nomination for the office of State
17Representative or State Senator such elector's residence
18address shall be written or printed. The residence address
19required to be written or printed opposite each qualified
20primary elector's name shall include the street address or
21rural route number of the signer, as the case may be, as well
22as the signer's county and city, village or town.
23    For the purposes of this Section, the number of primary
24electors shall be determined by taking the total vote cast, in
25the applicable district, for the candidate for such political
26party who received the highest number of votes, state-wide, at

1the last general election in the State at which electors for
2President of the United States were elected.
3    A "qualified primary elector" of a party may not sign
4petitions for or be a candidate in the primary of more than one
5party.
6    In the affidavit at the bottom of each sheet, the petition
7circulator, who shall be a person 18 years of age or older who
8is a citizen of the United States, shall state his or her
9street address or rural route number, as the case may be, as
10well as his or her county, city, village or town, and state;
11and shall certify that the signatures on that sheet of the
12petition were signed in his or her presence; and shall certify
13that the signatures are genuine; and shall certify that to the
14best of his or her knowledge and belief the persons so signing
15were at the time of signing the petition qualified primary
16voters for which the nomination is sought.
17    In the affidavit at the bottom of each petition sheet, the
18petition circulator shall either (1) indicate the dates on
19which he or she circulated that sheet, or (2) indicate the
20first and last dates on which the sheet was circulated, or (3)
21for elections where the petition circulation period is 90
22days, certify that none of the signatures on the sheet were
23signed more than 90 days preceding the last day for the filing
24of the petition, (4) for the 2022 general primary election
25only, certify that the signatures on the sheet were signed
26during the period of January 13, 2022 through March 14, 2022 or

1certify that the signatures on the sheet were signed during
2the period of January 13, 2022 through the date on which this
3Statement was sworn or affirmed to. No petition sheet shall be
4circulated more than 90 days preceding the last day provided
5in Section 8-9 for the filing of such petition.
6    All petition sheets which are filed with the State Board
7of Elections shall be the original sheets which have been
8signed by the voters and by the circulator, and not
9photocopies or duplicates of such sheets.
10    The person circulating the petition, or the candidate on
11whose behalf the petition is circulated, may strike any
12signature from the petition, provided that:
13        (1) the person striking the signature shall initial
14    the petition at the place where the signature is struck;
15    and
16        (2) the person striking the signature shall sign a
17    certification listing the page number and line number of
18    each signature struck from the petition. Such
19    certification shall be filed as a part of the petition.

4election, except that in 2022 the period shall begin on May 15,

7general election and ending the day after the general
8election. A member of the General Assembly may not mail,
9during a period beginning February 1 of the year of a general
10primary election, except that in 2022 the period shall begin
11on May 15, 2022, and ending the day after the general primary
12election and during a period beginning September 1 of the year
13of a general election and ending the day after the general
14election, any newsletters or brochures that were printed, at
15any time, by the Legislative Printing Unit, except that such a
16newsletter or brochure may be mailed during those times if it
17is mailed to a constituent in response to that constituent's
18inquiry concerning the needs of that constituent or questions
19raised by that constituent.
