1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
527-13.2 as follows:
 
6    (105 ILCS 5/27-13.2)  (from Ch. 122, par. 27-13.2)
7    Sec. 27-13.2. Required instruction. In every public school
8there shall be instruction, study, and discussion of effective
9methods by which pupils may recognize the danger of and avoid
10abduction, and in every public school maintaining any of
11grades kindergarten through 8 there shall be, for such grades,
12instruction, study, and discussion of effective methods for
13the prevention and avoidance of drugs and the dangers of
14opioid drug and substance abuse. School boards may include
15such required instruction, study and discussion in the courses
16of study regularly taught in the public schools of their
17respective districts; provided, however, that such instruction
18shall be given each year to all pupils in grades kindergarten
19through 8. The State Superintendent of Education may prepare
20and make available to all public and non-public schools
21instructional materials which may be used by such schools as
22guidelines for development of a program of instruction under
23this Section; provided, however, that each school board shall

1itself determine the minimum amount of instruction time which
2shall qualify as a program of instruction which will satisfy
3the requirements of this Section.
4    The State Superintendent of Education, in cooperation with
5the Department of Children and Family Services, shall prepare
6and disseminate to all public schools and non-public schools,
7information on instructional materials and programs about
8child sexual abuse which may be used by such schools for their
9own or community programs. Such information may also be
10disseminated by such schools to parents.
11    Notwithstanding the foregoing provisions of this Section,
12no pupil in any of grades kindergarten through 8 shall be
13required to take or participate in any class or course
14providing instruction in recognizing and avoiding sexual abuse
15if the parent or guardian of the pupil submits written
16objection thereto; and refusal to take or participate in such
17class or course after such written objection is made shall not
18be reason for failing, suspending or expelling such pupil.
19Each school board intending to offer any such class or course
20to pupils in any of grades kindergarten through 8 shall give
21not less than 5 days written notice to the parents or guardians
22of such pupils before commencing the class or course.

24    Section 99. Effective date. This Act takes effect upon
25becoming law.
