AMENDMENT TO HOUSE BILL 290

2    AMENDMENT NO. ______. Amend House Bill 290, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The School Code is amended by changing Section
62-3.163 as follows:
 
7    (105 ILCS 5/2-3.163)
8    Sec. 2-3.163. Prioritization of Urgency of Need for
9Services database.
10    (a) The General Assembly makes all of the following
11findings:
12        (1) The Department of Human Services maintains a
13    statewide database known as the Prioritization of Urgency
14    of Need for Services that records information about
15    individuals with developmental disabilities who are
16    potentially in need of services.

1        (2) The Department of Human Services uses the data on
2    Prioritization of Urgency of Need for Services to select
3    individuals for services as funding becomes available, to
4    develop proposals and materials for budgeting, and to plan
5    for future needs.
6        (3) Prioritization of Urgency of Need for Services is
7    available for children and adults with a developmental
8    disability who have an unmet service need anticipated in
9    the next 5 years.
10        (4) Prioritization of Urgency of Need for Services is
11    the first step toward getting developmental disabilities
12    services in this State. If individuals are not on the
13    Prioritization of Urgency of Need for Services waiting
14    list, they are not in queue for State developmental
15    disabilities services.
16        (5) Prioritization of Urgency of Need for Services may
17    be underutilized by children and their parents or
18    guardians due to lack of awareness or lack of information.
19    (b) The State Board of Education may work with school
20districts to inform all students with developmental
21disabilities and their parents or guardians about the
22Prioritization of Urgency of Need for Services database.
23    (c) Subject to appropriation, the Department of Human
24Services and State Board of Education shall develop and
25implement an online, computer-based training program for at
26least one designated employee in every public school in this

1State to educate him or her about the Prioritization of
2Urgency of Need for Services database and steps to be taken to
3ensure children and adolescents are enrolled. The training
4shall include instruction for at least one designated employee
5in every public school in contacting the appropriate
6developmental disabilities Independent Service Coordination
7agency to enroll children and adolescents in the database. At
8least one designated employee in every public school shall
9ensure the opportunity to enroll in the Prioritization of
10Urgency of Need for Services database is discussed during
11annual individualized education program (IEP) meetings for all
12children and adolescents believed to have a developmental
13disability.
14    (d) The State Board of Education, in consultation with the
15Department of Human Services, through school districts, shall
16provide to inform parents and guardians of students a copy of
17the Department of Human Services's guide titled "Understanding
18PUNS: A Guide to Prioritization for Urgency of Need for
19Services" each year at the annual review meeting for the
20student's individualized education program through school
21districts about the Prioritization of Urgency of Need for
22Services waiting list, including the consideration required in
23subsection (e) of this Section.
24    (e) The Department of Human Services shall consider the
25length of time spent on the Prioritization of Urgency of Need
26for Services waiting list, in addition to other factors

1considered, when selecting individuals on the list for
2services.

5    Section 99. Effective date. This Act takes effect upon
6becoming law.".
