| 1 | | SENATE JOINT RESOLUTION
| 2 | | WHEREAS, On February 27, 1861, in an attempt to avert the | 3 | | secession of Southern states, United States Representative | 4 | | Thomas Corwin of Ohio proposed an amendment to the United | 5 | | States Constitution that would prohibit the United States | 6 | | Constitution from being amended in a manner that authorizes | 7 | | Congress to abolish or interfere with the states' domestic | 8 | | institutions, including slavery; and
| 9 | | WHEREAS, On March 2, 1861, the Corwin Amendment was | 10 | | approved by a joint resolution of the United States Congress | 11 | | (12 Stat. 251) and was submitted to the states for | 12 | | ratification; and
| 13 | | WHEREAS, The Twenty-Third General Assembly ratified the | 14 | | Corwin Amendment in "An Act ratifying a certain amendment to | 15 | | the Constitution of the United States", in force June 2, 1863 | 16 | | (Public Laws 1863, p. 41); and
| 17 | | WHEREAS, The Corwin Amendment was not ratified by | 18 | | three-fourths of the states and, therefore, is not part of the | 19 | | United States Constitution; and
| 20 | | WHEREAS, With the end of the Civil War and the ratification | 21 | | of the 13th Amendment to the United States Constitution, the |

| 1 | | purposes of the Corwin Amendment have become moot; therefore, | 2 | | be it
| 3 | | RESOLVED, BY THE SENATE OF THE ONE HUNDRED FIRST GENERAL | 4 | | ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES | 5 | | CONCURRING HEREIN, That the State of Illinois rescinds its | 6 | | ratification of the following proposition, known as the Corwin | 7 | | Amendment to the United States Constitution:
| 8 | | "ARTICLE XIII. | 9 | | No amendment shall be made to the Constitution which will | 10 | | authorize or give to Congress the power to abolish or | 11 | | interfere, within any State, with the domestic institutions | 12 | | thereof, including that of persons held to labor or service by | 13 | | the laws of said State."; and be it further | 14 | | RESOLVED, That a certified copy of this resolution be | 15 | | forwarded to the Archivist of the United States, the President | 16 | | of the United States, the President pro tempore of the United | 17 | | States Senate, the Speaker of the United States House of | 18 | | Representatives, and each member of the Illinois congressional | 19 | | delegation.
