| 2 | | AMENDMENT NO. ______. Amend Senate Bill 2027, AS AMENDED, | 3 | | by replacing everything after the enacting clause with the | 4 | | following:
| 5 | | "Section 5. The Environmental Protection Act is amended by | 6 | | adding Section 21.7 as follows: | 7 | | (415 ILCS 5/21.7 new) | 8 | | Sec. 21.7. Landfills. | 9 | | (a) The purpose of this Section is to enact legislative | 10 | | recommendations provided by the Mahomet Aquifer Task Force, | 11 | | established under Public Act 100-403. The Task Force identified | 12 | | capped but unregulated or underregulated landfills that | 13 | | overlie the Mahomet Aquifer as potentially hazardous to | 14 | | valuable groundwater resources. These unregulated or | 15 | | underregulated landfills generally began accepting waste for | 16 | | disposal sometime prior to 1973. |

| 1 | | (b) The Agency shall prioritize unregulated or | 2 | | underregulated landfills that overlie the Mahomet Aquifer for | 3 | | inspection. The following factors shall be considered: | 4 | | (1) the presence of, and depth to, any aquifer with | 5 | | potential potable use; | 6 | | (2) whether the landfill has an engineered liner | 7 | | system; | 8 | | (3) whether the landfill has an active groundwater | 9 | | monitoring system; | 10 | | (4) whether waste disposal occurred within the | 11 | | 100-year floodplain; and | 12 | | (5) landfills within the setback zone of any potable | 13 | | water supply well. | 14 | | (c) Subject to appropriation, the Agency shall use existing | 15 | | information available from State and federal agencies, such as | 16 | | the Prairie Research Institute, the Department of Natural | 17 | | Resources, the Illinois Emergency Management Agency, the | 18 | | Federal Emergency Management Agency, and the Natural Resources | 19 | | Conservation Service, to identify unknown, unregulated, or | 20 | | underregulated waste disposal sites that overlie the Mahomet | 21 | | Aquifer that may pose a threat to surface water or groundwater | 22 | | resources. | 23 | | (d) Subject to appropriation, for those landfills | 24 | | prioritized for response action following inspection and | 25 | | investigation, the Agency shall use its own data, along with | 26 | | data from municipalities, counties, solid waste management |

| 1 | | associations, companies, corporations, and individuals, to | 2 | | archive information about the landfills, including their | 3 | | ownership, operational details, and waste disposal history. | 4 | | Section 10. The Illinois Groundwater Protection Act is | 5 | | amended by adding Section 10 as follows: | 6 | | (415 ILCS 55/10 new) | 7 | | Sec. 10. Pekin Metro Landfill; pilot projects. | 8 | | (a) Subject to appropriation, the Agency shall design and | 9 | | implement up to 2 pilot studies of landfills that overlie the | 10 | | Mahomet Aquifer to identify threats to surface and groundwater | 11 | | resources that are posed by the landfills. One of the pilot | 12 | | projects shall be conducted at the Pekin Metro Landfill in | 13 | | Tazewell County. In conducting the pilot projects, the Agency | 14 | | shall: | 15 | | (1) inspect and identify potential and current | 16 | | contamination threats to the water quality of aquifers in | 17 | | the same watershed as the landfill (for the Pekin Metro | 18 | | Landfill, the Mahomet Aquifer); | 19 | | (2) use geographic information systems and remote | 20 | | sensing technology to track defects, structures, | 21 | | appliances, and wells for routine inspection and | 22 | | sustainable management; | 23 | | (3) install or repair groundwater monitoring | 24 | | mechanisms necessary to identify whether contaminants from |

| 1 | | the landfill are affecting water quality in the Mahomet | 2 | | Aquifer; and | 3 | | (4) identify and provide cost estimates for any | 4 | | additional response actions necessary or appropriate to | 5 | | reduce or minimize potential threats to human health and | 6 | | the environment resulting from current landfill | 7 | | conditions. | 8 | | (b) Following the completion of the pilot project response | 9 | | actions, the Agency shall: | 10 | | (1) evaluate, in consultation with the Prairie | 11 | | Research Institute, the use of aerial photography and other | 12 | | remote sensing technologies, such as Light Detection and | 13 | | Ranging (LiDAR), to identify land erosion, landslides, | 14 | | barren areas, leachate seeps, vegetation, and other | 15 | | relevant surface and subsurface features of landfills to | 16 | | aid in the inspection and investigation of landfills; and | 17 | | (2) identify additional procedures, requirements, or | 18 | | authorities that may be appropriate or necessary to address | 19 | | threats to human health and the environment from other | 20 | | unregulated or underregulated landfills throughout the | 21 | | State. ".
