AMENDMENT TO SENATE BILL 1731

2    AMENDMENT NO. ______. Amend Senate Bill 1731 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by changing Sections
510-22.39 and 34-18.7 as follows:
 
6    (105 ILCS 5/10-22.39)
7    Sec. 10-22.39. In-service training programs.
8    (a) To conduct in-service training programs for teachers.
9    (b) In addition to other topics at in-service training
10programs, at least once every 2 years, licensed school
11personnel and administrators who work with pupils in
12kindergarten through grade 12 shall be trained to identify the
13warning signs of mental illness and suicidal behavior in youth
14and shall be taught appropriate intervention and referral
15techniques. A school district may utilize the Illinois Mental
16Health First Aid training program, established under the

1Illinois Mental Health First Aid Training Act and administered
2by certified instructors trained by a national association
3recognized as an authority in behavioral health, to provide the
4training and meet the requirements under this subsection. If
5licensed school personnel or an administrator obtains mental
6health first aid training outside of an in-service training
7program, he or she may present a certificate of successful
8completion of the training to the school district to satisfy
9the requirements of this subsection.
10    (c) School guidance counselors, nurses, teachers and other
11school personnel who work with pupils may be trained to have a
12basic knowledge of matters relating to acquired
13immunodeficiency syndrome (AIDS), including the nature of the
14disease, its causes and effects, the means of detecting it and
15preventing its transmission, and the availability of
16appropriate sources of counseling and referral, and any other
17information that may be appropriate considering the age and
18grade level of such pupils. The School Board shall supervise
19such training. The State Board of Education and the Department
20of Public Health shall jointly develop standards for such
21training.
22    (d) In this subsection (d):
23    "Domestic violence" means abuse by a family or household
24member, as "abuse" and "family or household members" are
25defined in Section 103 of the Illinois Domestic Violence Act of
261986.

1    "Sexual violence" means sexual assault, abuse, or stalking
2of an adult or minor child proscribed in the Criminal Code of
31961 or the Criminal Code of 2012 in Sections 11-1.20, 11-1.30,
411-1.40, 11-1.50, 11-1.60, 12-7.3, 12-7.4, 12-7.5, 12-12,
512-13, 12-14, 12-14.1, 12-15, and 12-16, including sexual
6violence committed by perpetrators who are strangers to the
7victim and sexual violence committed by perpetrators who are
8known or related by blood or marriage to the victim.
9    At least once every 2 years, an in-service training program
10for school personnel who work with pupils, including, but not
11limited to, school and school district administrators,
12teachers, school guidance counselors, school social workers,
13school counselors, school psychologists, and school nurses,
14must be conducted by persons with expertise in domestic and
15sexual violence and the needs of expectant and parenting youth
16and shall include training concerning (i) communicating with
17and listening to youth victims of domestic or sexual violence
18and expectant and parenting youth, (ii) connecting youth
19victims of domestic or sexual violence and expectant and
20parenting youth to appropriate in-school services and other
21agencies, programs, and services as needed, and (iii)
22implementing the school district's policies, procedures, and
23protocols with regard to such youth, including
24confidentiality. At a minimum, school personnel must be trained
25to understand, provide information and referrals, and address
26issues pertaining to youth who are parents, expectant parents,

1or victims of domestic or sexual violence.
2    (e) At least every 2 years, an in-service training program
3for school personnel who work with pupils must be conducted by
4persons with expertise in anaphylactic reactions and
5management.
6    (f) At least once every 2 years, a school board shall
7conduct in-service training on educator ethics,
8teacher-student conduct, and school employee-student conduct
9for all personnel.

12    Sec. 34-18.7. Youth mental illness and suicide detection
13and intervention. At least once every 2 years, licensed school
14personnel and administrators who work with pupils in
15kindergarten through grade 12 shall be trained to identify the
16warning signs of mental illness and suicidal behavior in youth
17and shall be taught various intervention techniques. The school
18district may utilize the Illinois Mental Health First Aid
19training program, established under the Illinois Mental Health
20First Aid Training Act and administered by certified
21instructors trained by a national association recognized as an
22authority in behavioral health, to provide the training and
23meet the requirements under this Section. If licensed school
24personnel or an administrator obtains mental health first aid
25training outside of an in-service training program, he or she

1may present a certificate of successful completion of the
2training to the school district to satisfy the requirements of
3this Section. The Such training shall be provided within the
4framework of existing in-service training programs offered by
5the Board or as part of the professional development activities
6required under Section 21-14 of this Code.
