AMENDMENT TO SENATE BILL 1449

2    AMENDMENT NO. ______. Amend Senate Bill 1449, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Illinois Insurance Code is amended by
6adding Section 370c.2 as follows:
 
7    (215 ILCS 5/370c.2 new)
8    Sec. 370c.2. Task force on disability income insurance;
9parity for behavioral health conditions.
10    (a) As used in this Section, "behavioral health condition"
11means any mental, emotional, nervous, or substance use disorder
12or condition that falls under any of the diagnostic categories
13listed in the mental and behavioral disorders chapter of the
14current edition of the International Classification of Disease
15or that is listed in the most recent version of the Diagnostic
16and Statistical Manual of Mental Disorders.

1    (b) The Department shall form a task force to review the
2plans and policies for individual and group short-term and
3long-term disability income insurance issued and offered to
4individuals and employers in this State in order to examine the
5use of such insurance for behavioral health conditions. The
6Task Force shall work cooperatively with the insurance
7industry, community organizations, businesses and business
8coalitions, and advocacy groups to reduce the stigma of
9behavioral health conditions. The task force shall be comprised
10of the following members:
11        (1) 2 experts in the disability income insurance
12    industry appointed by the Governor.
13        (2) 2 experts in the behavioral health conditions and
14    treatment industry appointed by the Governor.
15        (3) 2 consumers of disability income insurance who have
16    experienced or are experiencing a behavioral health
17    condition appointed by the Governor.
18        (4) One member of the General Assembly appointed by the
19    Speaker of the House of Representatives.
20        (5) One member of the General Assembly appointed by the
21    President of the Senate.
22        (6) One member of the General Assembly appointed by the
23    Minority Leader of the House of Representatives.
24        (7) One member of the General Assembly appointed by the
25    Minority Leader of the Senate.
26    (c) The task force shall elect a chairperson from its

1membership and shall have the authority to determine its
2meeting schedule, hearing schedule, and agendas.
3    (d) Appointments shall be made 90 days after the effective
4date of this amendatory Act of the 101st General Assembly.
5    (e) Members shall serve without compensation and shall be
6adults and residents of Illinois.
7    (f) The task force shall:
8        (1) review existing plans and policies for individual
9    and group short-term and long-term disability income
10    insurance issued, delivered, and offered in the State;
11        (2) compare consumer use of short-term and long-term
12    disability income insurance coverage for behavioral health
13    conditions with use of such insurance for physical
14    conditions;
15        (3) review reports of current costs incurred from
16    individual and group short-term and long-term disability
17    income insurance to cover behavioral health conditions at
18    parity with physical conditions; and
19        (4) provide recommendations on the use of individual
20    and group short-term and long-term disability income
21    insurance to cover behavioral health conditions.
22    (g) Any of the findings, recommendations, and other
23information determined by the task force to be relevant shall
24be made available on the Department's website.
25    (h) The task force shall submit findings and
26recommendations to the Governor and the General Assembly by

1December 31, 2020.
2    (i) The task force is dissolved and this Section is
3repealed on December 31, 2021.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.".
