AMENDMENT TO HOUSE BILL 823

2    AMENDMENT NO. ______. Amend House Bill 823 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-218 as follows:
 
7    (20 ILCS 2310/2310-218 new)
8    Sec. 2310-218. Phlebotomy on children and adults with
9intellectual and developmental disabilities.
10    (a) As used in this Section, "phlebotomist" means a person
11who is certified to draw blood for diagnostic testing,
12transfusion, research, or blood donation.
13    (b) The Department shall develop and make available
14training materials that ensure that all phlebotomists are
15trained in the most current methods of drawing blood from
16children and adults with intellectual and developmental

1disabilities. The materials shall conform to the best available
2practices used for drawing blood in a safe manner that is as
3comfortable as possible for the individual from whom blood is
4drawn and for the families, guardians, caretakers, or
5companions of the individual accompanying him or her while
6blood is drawn. The Department shall review these materials
7every 3 years to ensure that they conform with the best
8available practices.
9    (c) The Department shall ensure that health care providers,
10as that term is defined under the Health Care Services Lien
11Act, and laboratories, as that term is defined under the
12Illinois Clinical Laboratory and Blood Bank Act, that employ a
13phlebotomist incorporate the training described in subsection
14(b) as part of a phlebotomist's initial employment training and
15as part of any ongoing training to maintain competencies and
16certifications as a phlebotomist.".
