SYNOPSIS AS INTRODUCED:
 
415 ILCS 5/52.3-15 new

    Amends the Environmental Protection Act. Provides that the Environmental Protection Agency shall administer the moneys available to the State under a specified environmental mitigation trust agreement for states. Provides that the Agency may allocate administrative costs to specified eligible mitigation actions. Provides that a Beneficiary Mitigation Plan submitted by the State under the specified environmental trust agreement shall comply with these provisions. Provides that a Beneficiary Mitigation Plan filed within 60 days after the effective date of the amendatory Act shall be revised to comply with the amendatory Act and resubmitted in accordance with the specified environmental mitigation trust agreement. Effective immediately.

1    AN ACT relating to the Volkswagen Environmental Mitigation
2Trust.
 
3    Be it enacted by the People of the State of Illinois,
4represented in the General Assembly:
 
5    Section 5. The Environmental Protection Act is amended by
6adding Section 52.3-15 as follows:
 
7    (415 ILCS 5/52.3-15 new)
8    Sec. 52.3-15. Environmental Mitigation Trust.
9    (a) As used in this Section:
10    "Appendix D-2" means Appendix D-2 to the Environmental
11Mitigation Trust, entitled "Eligible Mitigation Actions and
12Mitigation Action Expenditures".
13    "Beneficiary Mitigation Plan" means a plan described in
14paragraph 4.1 of the Environmental Mitigation Trust.
15    "Director" means the Director of the Agency.
16    "Eligible Mitigation Action" has the meaning provided in
17paragraph 1.9 of the Environmental Mitigation Trust.
18    "Environmental Mitigation Trust" means the Environmental
19Mitigation Trust Agreement for State Beneficiaries filed on
20October 2, 2017 in In re: Volkswagen "Clean Diesel" Marketing,
21Sales Practices, and Products Liability Litigation,
223:16-CV-00295-CRB, MDL No. 2672 CRB (JSC) (N.D. 3 Cal.).
23    (b) The Agency shall administer the moneys available to the

1State under the Environmental Mitigation Trust so that:
2        (1) 15% of the moneys are dedicated to the purchase of
3    light duty electric vehicle supply equipment that
4    qualifies under Eligible Mitigation Action 9 in Appendix
5    D-2, entitled "Light Duty Zero Emission Vehicle Supply
6    Equipment"; and
7        (2) the remainder of the moneys are dedicated to the
8    replacement of fossil fuel-powered vehicles with
9    all-electric vehicles under one or more of the following
10    Eligible Mitigation Actions:
11            (A) 1, entitled "Class 8 Local Freight Trucks and
12        Port Drayage Trucks (Eligible Large Trucks)";
13            (B) 2, entitled "Class 4-8 School Bus, Shuttle Bus,
14        or Transit Bus (Eligible Buses)"; and
15            (C) 6, entitled "Class 4-7 Local Freight Trucks
16        (Medium Trucks)".
17    (c) The Agency may allocate administrative costs to the
18Eligible Mitigation Actions identified in subsection (b) of
19this Section in accordance with Appendix D-2.
20    (d) A Beneficiary Mitigation Plan submitted by the State of
21Illinois under the Environmental Mitigation Trust shall comply
22with this Section. A Beneficiary Mitigation Plan filed within
2360 days after the effective date of this amendatory Act of the
24100th General Assembly shall be revised to comply with this
25amendatory Act of the 100th General Assembly and resubmitted in
26accordance with the Environmental Mitigation Trust.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
