AMENDMENT TO SENATE BILL 2599

2    AMENDMENT NO. ______. Amend Senate Bill 2599 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Criminal Code of 2012 is amended by
5changing Section 31-6 as follows:
 
6    (720 ILCS 5/31-6)  (from Ch. 38, par. 31-6)
7    Sec. 31-6. Escape; failure to report to a penal institution
8or to report for periodic imprisonment.
9    (a) A person convicted of a felony or charged with the
10commission of a felony, or charged with or adjudicated
11delinquent for an act which, if committed by an adult, would
12constitute a felony, who intentionally escapes from any penal
13institution or from the custody of an employee of that
14institution commits a Class 2 felony; however, a person
15convicted of a felony, or adjudicated delinquent for an act
16which, if committed by an adult, would constitute a felony, who

1knowingly fails to report to a penal institution or to report
2for periodic imprisonment at any time or knowingly fails to
3return from furlough or from work and day release or who
4knowingly fails to abide by the terms of home confinement is
5guilty of a Class 3 felony; or a person convicted of a felony,
6or adjudicated delinquent for an act which, if committed by an
7adult, would constitute a felony who knowingly fails to abide
8by the terms of home confinement is guilty of Class 4 felony.
9    (b) A person convicted of a misdemeanor or charged with the
10commission of a misdemeanor, or charged with or adjudicated
11delinquent for an act which, if committed by an adult, would
12constitute a misdemeanor, who intentionally escapes from any
13penal institution or from the custody of an employee of that
14institution commits a Class A misdemeanor; however, a person
15convicted of a misdemeanor, or adjudicated delinquent for an
16act which, if committed by an adult, would constitute a
17misdemeanor, who knowingly fails to report to a penal
18institution or to report for periodic imprisonment at any time
19or knowingly fails to return from furlough or from work and day
20release or who knowingly fails to abide by the terms of home
21confinement is guilty of a Class B misdemeanor.
22    (b-1) A person in the custody of the Department of Human
23Services under the provisions of the Sexually Violent Persons
24Commitment Act under a detention order, commitment order,
25conditional release order, or other court order who
26intentionally escapes from any secure residential facility or

1from a Department employee or any of its agents commits a Class
22 felony.
3    (c) A person in the lawful custody of a peace officer for
4the alleged commission of a felony offense or an act which, if
5committed by an adult, would constitute a felony, and who
6intentionally escapes from custody commits a Class 2 felony;
7however, a person in the lawful custody of a peace officer for
8the alleged commission of a misdemeanor offense or an act
9which, if committed by an adult, would constitute a
10misdemeanor, who intentionally escapes from custody commits a
11Class A misdemeanor.
12    (c-5) A person in the lawful custody of a peace officer for
13an alleged violation of a term or condition of probation,
14conditional discharge, parole, aftercare release, or mandatory
15supervised release for a felony or an act which, if committed
16by an adult, would constitute a felony, who intentionally
17escapes from custody is guilty of a Class 2 felony.
18    (c-6) A person in the lawful custody of a peace officer for
19an alleged violation of a term or condition of supervision,
20probation, or conditional discharge for a misdemeanor or an act
21which, if committed by an adult, would constitute a
22misdemeanor, who intentionally escapes from custody is guilty
23of a Class A misdemeanor.
24    (d) A person who violates this Section while armed with a
25dangerous weapon commits a Class 1 felony.
