| 2 | | AMENDMENT NO. ______. Amend Senate Bill 2518 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 5. The Illinois Vehicle Code is amended by | 5 | | changing Sections 3-506, 3-802, and 3-806.3 and by adding | 6 | | Sections 3-407.5 and 3-699.16 as follows: | 7 | | (625 ILCS 5/3-407.5 new) | 8 | | Sec. 3-407.5. Temporary permit for charitable | 9 | | not-for-profit organization. | 10 | | (a) Any charitable not-for-profit organization that is | 11 | | exempt from federal income taxation under Section 501(c)(3) of | 12 | | the Internal Revenue Code and engaged in the maintenance and | 13 | | repair of motor vehicles may make application to the Secretary | 14 | | for a temporary permit to operate a motor vehicle that was | 15 | | donated to the not-for-profit organization for the purpose of | 16 | | donating the motor vehicle to a low-income individual. |

| 1 | | (b) A permit issued under this Section shall be valid for a | 2 | | period of 90 days. No more than 2 permits may be issued under | 3 | | this Section for any one vehicle. A vehicle may be operated | 4 | | with the temporary permit only for purposes of delivering the | 5 | | vehicle to a not-for-profit organization, moving the vehicle | 6 | | for maintenance or repairs, or delivering the vehicle to a | 7 | | low-income individual. | 8 | | (c) An applicant for the temporary permit shall provide the | 9 | | Secretary proof of the not-for-profit status of the | 10 | | organization, along with a document signed by the donor and the | 11 | | not-for-profit organization expressly stating that the vehicle | 12 | | is being donated to the not-for-profit organization by the | 13 | | donor, and the not-for-profit organization assumes all | 14 | | liability for the operation of the vehicle upon accepting the | 15 | | donation. This form must identify the vehicle by make, model, | 16 | | year, and vehicle identification number. An applicant for the | 17 | | temporary permit shall also provide the Secretary with proof of | 18 | | liability insurance covering the vehicle in at least the | 19 | | minimum amounts set forth in Article VI of Chapter 7. The | 20 | | donated motor vehicle shall meet the requirements for | 21 | | registration under Chapter 3 of this Code to qualify for a | 22 | | temporary permit under this Section. A copy of the permit shall | 23 | | be kept inside the motor vehicle at all times. | 24 | | (d) The Secretary may adopt any rules necessary to | 25 | | implement this Section. |

| 1 | | (625 ILCS 5/3-506) | 2 | | Sec. 3-506. Transfer of plates to spouses of military | 3 | | service members. Upon the death of a military service member | 4 | | who has been issued a special plate under Section 3-609.1, | 5 | | 3-620, 3-621, 3-622, 3-623, 3-624, 3-625, 3-626, 3-628, 3-638, | 6 | | 3-642, 3-645, 3-647, 3-650, 3-651, 3-666, 3-667, 3-668, 3-669, | 7 | | 3-676, 3-677, 3-680, 3-681, 3-683, 3-686, 3-688, 3-693, 3-698, | 8 | | or 3-699.12 , or 3-699.16 of this Code, the surviving spouse of | 9 | | that service member may retain the plate so long as that spouse | 10 | | is a resident of Illinois and transfers the registration to his | 11 | | or her name within 180 days of the death of the service member. | 12 | | For the purposes of this Section, "service member" means | 13 | | any individual who is serving or has served in any branch of | 14 | | the United States Armed Forces, including the National Guard or | 15 | | other reserve components of the Armed Forces, and has been | 16 | | issued a special plate listed in this Section.

Global War on Terrorism license plates. | 20 | | (a) In addition to any other special license plate, the | 21 | | Secretary, upon receipt of all applicable fees and applications | 22 | | made in the form prescribed by the Secretary, may issue Global | 23 | | War on Terrorism license plates to residents of this State who | 24 | | have earned the Global War on Terrorism Expeditionary Medal | 25 | | from the United States Armed Forces. | 1 | | Terrorism plates issued under this Section shall be affixed | 2 | | only to passenger vehicles of the first division, including | 3 | | motorcycles, or motor vehicles of the second division weighing | 4 | | not more than 8,000 pounds. Plates issued under this Section | 5 | | shall expire according to the multi-year procedure under | 6 | | Section 3-414.1 of this Code. | 7 | | (b) The design, color, and format of the Global War on | 8 | | Terrorism license plate shall be wholly within the discretion | 9 | | of the Secretary. The Secretary may, in his or her discretion, | 10 | | allow the Global War on Terrorism license plates to be issued | 11 | | as vanity or personalized plates in accordance with Section | 12 | | 3-405.1 of this Code. Global War on Terrorism license plates | 13 | | are not required to designate "Land of Lincoln", as prescribed | 14 | | in subsection (b) of Section 3-412 of this Code. The Secretary | 15 | | shall, in his or her discretion, approve and prescribe stickers | 16 | | or decals as provided under Section 3-412.

| 18 | | Sec. 3-802. Reclassifications and upgrades.
| 19 | | (a) Definitions. For the purposes of this Section, the | 20 | | following words
shall have the meanings ascribed to them as | 21 | | follows:
| 22 | | "Reclassification" means changing the registration of | 23 | | a vehicle from one
plate category to another.
| 24 | | "Upgrade" means increasing the registered weight of a | 25 | | vehicle within the
same plate category.

| 1 | | (b) When reclassing the registration of a vehicle from one | 2 | | plate category
to another, the owner shall receive credit for | 3 | | the unused portion of the
present
plate and be charged the | 4 | | current portion fees for the new plate. In addition,
the | 5 | | appropriate replacement plate and replacement sticker fees | 6 | | shall be
assessed.
| 7 | | (b-5) Beginning with the 2019 registration year, any | 8 | | individual who has a registration issued under either Section | 9 | | 3-405 or 3-405.1 that qualifies for a special license plate | 10 | | under Section Sections 3-609, 3-609.1, 3-620, 3-621, 3-622, | 11 | | 3-623, 3-624, 3-625, 3-626, 3-628, 3-638, 3-642, 3-645, 3-647, | 12 | | 3-650, 3-651, 3-664, 3-666, 3-667, 3-668, 3-669, 3-676, 3-677, | 13 | | 3-680, 3-681, 3-683, 3-686, 3-688, 3-693, 3-698, or 3-699.12 , | 14 | | or 3-699.16 may reclass his or her registration upon acquiring | 15 | | a special license plate listed in this subsection (b-5) without | 16 | | a replacement plate fee or registration sticker cost. | 17 | | (b-10) Beginning with the 2019 registration year, any | 18 | | individual who has a special license plate issued under Section | 19 | | 3-609, 3-609.1, 3-620, 3-621, 3-622, 3-623, 3-624, 3-625, | 20 | | 3-626, 3-628, 3-638, 3-642, 3-645, 3-647, 3-650, 3-651, 3-664, | 21 | | 3-666, 3-667, 3-668, 3-669, 3-676, 3-677, 3-680, 3-681, 3-683, | 22 | | 3-686, 3-688, 3-693, 3-698, or 3-699.12 , or 3-699.16 may | 23 | | reclass his or her special license plate upon acquiring a new | 24 | | registration under Section 3-405 or 3-405.1 without a | 25 | | replacement plate fee or registration sticker cost. | 26 | | (c) When upgrading the weight of a registration within the |

category, the owner shall pay the difference in | 2 | | current period fees between the
two plates. In addition, the | 3 | | appropriate replacement plate and replacement
sticker fees | 4 | | shall be assessed. In the event new plates are not required, | 5 | | the
corrected registration card fee shall be assessed.
| 6 | | (d) In the event the owner of the vehicle desires to change | 7 | | the registered
weight and change the plate category, the owner | 8 | | shall receive credit for the
unused portion of the registration | 9 | | fee of the current plate and pay the current
portion of the | 10 | | registration fee for the new plate, and in addition, pay the
| 11 | | appropriate replacement plate
and replacement sticker fees.
| 12 | | (e) Reclassing from one plate category to another plate | 13 | | category can be done
only once within any registration period.
| 14 | | (f) No refunds shall be made in any of the circumstances | 15 | | found in subsection
(b), subsection (c), or subsection (d); | 16 | | however, when reclassing from a flat
weight plate to an | 17 | | apportioned plate, a refund may be issued if the credit amounts | 18 | | to an overpayment.
| 19 | | (g) In the event the registration of a vehicle registered | 20 | | under the mileage
tax option is revoked, the owner shall be | 21 | | required to pay the annual
registration fee in the new plate | 22 | | category and shall not receive any credit for
the mileage plate | 23 | | fees.
| 24 | | (h) Certain special interest plates may be displayed on | 25 | | first division
vehicles, second division vehicles weighing | 26 | | 8,000 pounds or less, and
recreational
vehicles. Those plates |

| 1 | | can be transferred within those vehicle groups.
| 2 | | (i) Plates displayed on second division vehicles weighing | 3 | | 8,000 pounds or
less and passenger vehicle plates may be | 4 | | reclassed from one division to the
other.
| 5 | | (j) Other than in subsection (i), reclassing from one | 6 | | division to the
other division is prohibited. In addition, a | 7 | | reclass from a motor vehicle to a
trailer or a trailer to a | 8 | | motor vehicle is prohibited.

multi-year registration plates issued | 19 | | under Section 3-414.1, motor vehicles
displaying special | 20 | | registration plates issued under Section 3-609, 3-616, 3-621,
| 21 | | 3-622, 3-623, 3-624, 3-625, 3-626, 3-628, 3-638, 3-642, 3-645, | 22 | | 3-647, 3-650,
3-651, or 3-663, or 3-699.16, motor vehicles | 23 | | registered at 8,000 pounds or less under Section
3-815(a), and | 24 | | recreational vehicles registered at 8,000 pounds or less under
| 25 | | Section 3-815(b). Widows and widowers of claimants shall also |

this reduced registration fee for the | 2 | | registration year in which the claimant
was eligible.
| 3 | | Commencing with the 2009 registration year, the | 4 | | registration fee paid by
any vehicle owner who has claimed and | 5 | | received a grant under the Senior
Citizens and Persons with | 6 | | Disabilities Property Tax Relief
Act or who is the spouse of | 7 | | such a person shall be $24 instead of the fee
otherwise | 8 | | provided in this Code for passenger cars displaying standard
| 9 | | multi-year registration plates issued under Section 3-414.1, | 10 | | motor vehicles
displaying special registration plates issued | 11 | | under Section 3-607, 3-609, 3-616, 3-621,
3-622, 3-623, 3-624, | 12 | | 3-625, 3-626, 3-628, 3-638, 3-642, 3-645, 3-647, 3-650, 3-651, | 13 | | 3-663, or 3-664, or 3-699.16, motor vehicles registered at | 14 | | 8,000 pounds or less under Section
3-815(a), and recreational | 15 | | vehicles registered at 8,000 pounds or less under
Section | 16 | | 3-815(b). Widows and widowers of claimants shall also be | 17 | | entitled to
this reduced registration fee for the registration | 18 | | year in which the claimant
was eligible.
| 19 | | Commencing with the 2017 registration year, the reduced fee | 20 | | under this Section shall apply to any special registration | 21 | | plate authorized in Article VI of Chapter 3 of this Code for | 22 | | which the applicant would otherwise be eligible. | 23 | | Surcharges for vehicle registrations under Section 3-806 | 24 | | of this Code shall not be collected from any vehicle owner who | 25 | | has been approved for benefits under the Senior Citizens and | 26 | | Disabled Persons Property Tax Relief Act or a person who is the |

Section does not | 7 | | apply to the fee paid in addition to the registration fee
for | 8 | | motor vehicles displaying vanity, personalized, or special | 9 | | license
plates.
