AMENDMENT TO SENATE BILL 309

2    AMENDMENT NO. ______. Amend Senate Bill 309, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The University of Illinois Hospital Act is
6amended by adding Section 8b as follows:
 
7    (110 ILCS 330/8b new)
8    Sec. 8b. Closed captioning required. The University of
9Illinois Hospital must make reasonable efforts to have
10activated at all times the closed captioning feature on a
11television in a common area provided for use by the general
12public or in a patient's room or to enable the closed
13captioning feature when requested to do so by a member of the
14general public or a patient if the television includes a closed
15captioning feature.
16    It is not a violation of this Section if the closed

1captioning feature is deactivated by a member of the University
2of Illinois Hospital's staff after such feature is enabled in a
3common area or in a patient's room unless the deactivation of
4the closed captioning feature is knowing or intentional. It is
5not a violation of this Section if the closed captioning
6feature is deactivated by a member of the general public, a
7patient, or a member of the University of Illinois Hospital's
8staff at the request of a patient of the University of Illinois
9Hospital.
10    If the University of Illinois Hospital does not have a
11television that includes a closed captioning feature, then the
12University of Illinois Hospital must ensure that all
13televisions obtained for common areas and patient rooms after
14the effective date of this amendatory Act of the 100th General
15Assembly include a closed captioning feature. This Section does
16not affect any other provision of law relating to disability
17discrimination or providing reasonable accommodations or
18diminish the rights of a person with a disability under any
19other law.
20    As used in this Section, "closed captioning" means a text
21display of spoken words presented on a television that allows a
22deaf or hard of hearing viewer to follow the dialogue and the
23action of a program simultaneously.
 
24    Section 10. The Alternative Health Care Delivery Act is
25amended by adding Sections 35.5 and 7c as follows:

1    (210 ILCS 3/35.5 new)
2    Sec. 35.5. Closed captioning required. An alternative
3health care model licensed under this Act must make reasonable
4efforts to have activated at all times the closed captioning
5feature on a television in a common area provided for use by
6the general public or in a patient's room, or enable the closed
7captioning feature when requested to do so by a member of the
8general public or a patient, if the television includes a
9closed captioning feature.
10    It is not a violation of this Section if the closed
11captioning feature is deactivated by a member of the
12alternative health care model's staff after such feature is
13enabled in a common area or in a patient's room unless the
14deactivation of the closed captioning feature is knowing or
15intentional. It is not a violation of this Section if the
16closed captioning feature is deactivated by a member of the
17general public, a patient, or a member of the alternative
18health care model's staff at the request of a patient of the
19alternative health care model licensed under this Act.
20    If the alternative health care model licensed under this
21Act does not have a television that includes a closed
22captioning feature, then the alternative health care model
23licensed under this Act must ensure that all televisions
24obtained for common areas and patient rooms after the effective
25date of this amendatory Act of the 100th General Assembly

1include a closed captioning feature. This Section does not
2affect any other provision of law relating to disability
3discrimination or providing reasonable accommodations or
4diminish the rights of a person with a disability under any
5other law.

10    Section 15. The Ambulatory Surgical Treatment Center Act is
11amended by adding Section 7c as follows:

13    Sec. 7c. Closed captioning required. An ambulatory
14surgical treatment center licensed under this Act must make
15reasonable efforts to have activated at all times the closed
16captioning feature on a television in a common area provided
17for use by the general public or in a patient's room, or enable
18the closed captioning feature when requested to do so by a
19member of the general public or a patient, if the television
20includes a closed captioning feature.
21    It is not a violation of this Section if the closed
22captioning feature is deactivated by a member of the ambulatory
23surgical treatment center's staff after such feature is enabled
24in a common area or in a patient's room unless the deactivation

1of the closed captioning feature is knowing or intentional. It
2is not a violation of this Section if the closed captioning
3feature is deactivated by a member of the general public, a
4patient, or a member of the ambulatory surgical treatment
5center's staff at the request of a patient of the ambulatory
6surgical treatment center licensed under this Act.
7    If the ambulatory surgical treatment center licensed under
8this Act does not have a television that includes a closed
9captioning feature, then the ambulatory surgical treatment
10center licensed under this Act must ensure that all televisions
11obtained for common areas and patient rooms after the effective
12date of this amendatory Act of the 100th General Assembly
13include a closed captioning feature. This Section does not
14affect any other provision of law relating to disability
15discrimination or providing reasonable accommodations or
16diminish the rights of a person with a disability under any
17other law.

22    Section 20. The Community Living Facilities Licensing Act
23is amended by adding Section 5.5 as follows:

2Facility licensed under this Act must make reasonable efforts

6feature when requested to do so by a member of the general
7public or a resident, if the television includes a closed
8captioning feature.
9    It is not a violation of this Section if the closed
10captioning feature is deactivated by a member of the Community
11Living Facility's staff after such feature is enabled in a
12common area or in a resident's room unless the deactivation of
13the closed captioning feature is knowing or intentional. It is
14not a violation of this Section if the closed captioning
15feature is deactivated by a member of the general public, a
16resident, or a member of the a Community Living Facility's
17staff at the request of a resident of the Community Living
18Facility licensed under this Act.
19    If a Community Living Facility licensed under this Act does
20not have a television in a common area that includes a closed
21captioning feature, then the Community Living Facility
22licensed under this Act must ensure that all televisions
23obtained for common areas after the effective date of this
24amendatory Act of the 100th General Assembly include a closed
25captioning feature. This Section does not affect any other
26provision of law relating to disability discrimination or

1providing reasonable accommodations or diminish the rights of a
2person with a disability under any other law. Nothing in this
3Section shall apply to televisions that are privately owned by
4a resident or third party and not owned by the Community Living
5Facility.
6    As used in this Section, "closed captioning" means a text
7display of spoken words presented on a television that allows a
8deaf or hard of hearing viewer to follow the dialogue and the
9action of a program simultaneously.
 
10    Section 25. The Nursing Home Care Act is amended by adding
11Section 3-801.2 as follows:
 
12    (210 ILCS 45/3-801.2 new)
13    Sec. 3-801.2. Closed captioning required. A facility
14licensed under this Act must make reasonable efforts to have
15activated at all times the closed captioning feature on a
16television in a common area provided for use by the general
17public or in a resident's room, or enable the closed captioning
18feature when requested to do so by a member of the general
19public or a resident, if the television includes a closed
20captioning feature.
21    It is not a violation of this Section if the closed
22captioning feature is deactivated by a member of the facility's
23staff after such feature is enabled in a common area or in a
24resident's room unless the deactivation of the closed

2violation of this Section if the closed captioning feature is

8feature, then the facility licensed under this Act must ensure

14diminish the rights of a person with a disability under any
15other law. Nothing in this Section shall apply to televisions
16that are privately owned by a resident or third party and not
17owned by the facility.

22    Section 30. The MC/DD Act is amended by adding Section
233-801.2 as follows:

2licensed under this Act must make reasonable efforts to have
3activated at all times the closed captioning feature on a
4television in a common area provided for use by the general
5public or in a resident's room, or enable the closed captioning
6feature when requested to do so by a member of the general
7public or a resident, if the television includes a closed
8captioning feature.
9    It is not a violation of this Section if the closed
10captioning feature is deactivated by a member of the facility's
11staff after such feature is enabled in a common area or in a
12resident's room unless the deactivation of the closed

11    Sec. 3-801.2. Closed captioning required. A facility
12licensed under this Act must make reasonable efforts to have
13activated at all times the closed captioning feature on a
14television in a common area provided for use by the general
15public or in a resident's room, or enable the closed captioning
16feature when requested to do so by a member of the general
17public or a resident, if the television includes a closed
18captioning feature.
19    It is not a violation of this Section if the closed
20captioning feature is deactivated by a member of the facility's
21staff after such feature is enabled in a common area or in a
22resident's room unless the deactivation of the closed
23captioning feature is knowing or intentional. It is not a
24violation of this Section if the closed captioning feature is

3a facility licensed under this Act.
4    If a facility licensed under this Act does not have a

8effective date of this amendatory Act of the 100th General
9Assembly include a closed captioning feature. This Section does
10not affect any other provision of law relating to disability

12diminish the rights of a person with a disability under any
13other law. Nothing in this Section shall apply to televisions
14that are privately owned by a resident or third party and not
15owned by the facility.

20    Section 40. The Specialized Mental Health Rehabilitation
21Act of 2013 is amended by adding Section 2-101.5 as follows:

23    Sec. 2-101.5. Closed captioning required. A facility
24licensed under this Act must make reasonable efforts to have

2television in a common area provided for use by the general
3public or in a consumer's room, or enable the closed captioning
4feature when requested to do so by a member of the general
5public or a consumer, if the television includes a closed
6captioning feature.
7    It is not a violation of this Section if the closed
8captioning feature is deactivated by a member of the facility's
9staff after such feature is enabled in a common area or in a
10consumer's room unless the deactivation of the closed
11captioning feature is knowing or intentional. It is not a
12violation of this Section if the closed captioning feature is
13deactivated by a member of the general public, a consumer, or a
14member of the facility's staff at the request of a consumer of
15a facility licensed under this Act.
16    If a facility licensed under this Act does not have a
17television in a common area that includes a closed captioning
18feature, then the facility licensed under this Act must ensure
19that all televisions obtained for common areas after the
20effective date of this amendatory Act of the 100th General
21Assembly include a closed captioning feature. This Section does
22not affect any other provision of law relating to disability
23discrimination or providing reasonable accommodations or
24diminish the rights of a person with a disability under any
25other law. Nothing in this Section shall apply to televisions
26that are privately owned by a resident or third party and not

6    Section 45. The Hospital Licensing Act is amended by adding
7Section 11.8 as follows:

9    Sec. 11.8. Closed captioning required. A hospital licensed
10under this Act must make reasonable efforts to have activated
11at all times the closed captioning feature on a television in a
12common area provided for use by the general public or in a
13patient's room, or enable the closed captioning feature when
14requested to do so by a member of the general public or a
15patient, if the television includes a closed captioning
16feature.
17    It is not a violation of this Section if the closed
18captioning feature is deactivated by a member of the hospital's
19staff after such feature is enabled in a common area or in a
20patient's room unless the deactivation of the closed captioning
21feature is knowing or intentional. It is not a violation of
22this Section if the closed captioning feature is deactivated by
23a member of the general public, a patient, or a member of the
24hospital's staff at the request of a patient of a hospital

1licensed under this Act.
2    If a hospital licensed under this Act does not have a
3television that includes a closed captioning feature, then the
4hospital must ensure that all televisions obtained for common
5areas and patient rooms after the effective date of this
6amendatory Act of the 100th General Assembly include a closed
7captioning feature. This Section does not affect any other
8provision of law relating to disability discrimination or
9providing reasonable accommodations or diminish the rights of a
10person with a disability under any other law.
11    As used in this Section, "closed captioning" means a text
12display of spoken words presented on a television that allows a
13deaf or hard of hearing viewer to follow the dialogue and the
14action of a program simultaneously.
 
15    Section 50. The Community-Integrated Living Arrangements
16Licensure and Certification Act is amended by adding Section
1710.5 as follows:
 
18    (210 ILCS 135/10.5 new)
19    Sec. 10.5. Closed captioning required. A
20community-integrated living arrangement certified under this
21Act must make reasonable efforts to have activated at all times
22the closed captioning feature on a television in a common area
23provided for use by the general public or in a resident's room,
24or enable the closed captioning feature when requested to do so

1by a member of the general public or a resident, if the
2television includes a closed captioning feature.
3    It is not a violation of this Section if the closed
4captioning feature is deactivated by a member of the
5community-integrated living arrangement's staff after such
6feature is enabled in a common area or in a resident's room
7unless the deactivation of the closed captioning feature is
8knowing or intentional. It is not a violation of this Section
9if the closed captioning feature is deactivated by a member of
10the general public, a resident, or a member of the
11community-integrated living arrangement's staff at the request
12of a resident of a community-integrated living arrangement
13certified under this Act.
14    If a community-integrated living arrangement certified
15under this Act does not have a television in a common area that
16includes a closed captioning feature, then the
17community-integrated living arrangement certified under this
18Act must ensure that all televisions obtained for common areas
19after the effective date of this amendatory Act of the 100th
20General Assembly include a closed captioning feature. This
21Section does not affect any other provision of law relating to
22disability discrimination or providing reasonable
23accommodations or diminish the rights of a person with a
24disability under any other law. Nothing in this Section shall
25apply to televisions that are privately owned by a resident or
26third party and not owned by the community-integrated living
