AMENDMENT TO SENATE BILL 263

2    AMENDMENT NO. ______. Amend Senate Bill 263 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Secretary of State Act is amended by adding
5Section 30 as follows:
 
6    (15 ILCS 305/30 new)
7    Sec. 30. Dutch Reach door opening method. The Secretary of
8State shall include in the Illinois Rules of the Road
9publication information advising drivers to use the Dutch Reach
10method when opening a vehicle door after parallel parking on a
11street. The Dutch Reach method includes: (1) checking the
12rear-view mirror; (2) checking the side-view mirror; and (3)
13opening the door with the right hand, or the hand farthest from
14the driver's-side door, thereby reducing the risk of injuring a
15bicyclist or opening the door in the path a vehicle approaching
16from behind.

1    Section 10. The Illinois Vehicle Code is amended by
2changing Section 6-109 as follows:
 
3    (625 ILCS 5/6-109)
4    Sec. 6-109. Examination of Applicants.
5    (a) The Secretary of State shall examine every applicant
6for a driver's license or permit who has not been previously
7licensed as a driver under the laws of this State or any other
8state or country, or any applicant for renewal of such driver's
9license or permit when such license or permit has been expired
10for more than one year. The Secretary of State shall, subject
11to the provisions of paragraph (c), examine every licensed
12driver at least every 8 years, and may examine or re-examine
13any other applicant or licensed driver, provided that during
14the years 1984 through 1991 those drivers issued a license for
153 years may be re-examined not less than every 7 years or more
16than every 10 years.
17    The Secretary of State shall require the testing of the
18eyesight of any driver's license or permit applicant who has
19not been previously licensed as a driver under the laws of this
20State and shall promulgate rules and regulations to provide for
21the orderly administration of all the provisions of this
22Section.
23    The Secretary of State shall include at least one test
24question that concerns the provisions of the Pedestrians with

1Disabilities Safety Act in the question pool used for the
2written portion of the drivers license examination within one
3year after July 22, 2010 (the effective date of Public Act
496-1167).
5    The Secretary of State shall include, in the question pool
6used for the written portion of the driver's license
7examination, test questions concerning safe driving in the
8presence of bicycles, which may include, but not be limited to,
9questions concerning the Dutch Reach method as described in
10Section 30 of the Secretary of State Act.
11    (b) Except as provided for those applicants in paragraph
12(c), such examination shall include a test of the applicant's
13eyesight, his ability to read and understand official traffic
14control devices, his knowledge of safe driving practices and
15the traffic laws of this State, and may include an actual
16demonstration of the applicant's ability to exercise ordinary
17and reasonable control of the operation of a motor vehicle, and
18such further physical and mental examination as the Secretary
19of State finds necessary to determine the applicant's fitness
20to operate a motor vehicle safely on the highways, except the
21examination of an applicant 75 years of age or older shall
22include an actual demonstration of the applicant's ability to
23exercise ordinary and reasonable control of the operation of a
24motor vehicle. All portions of written and verbal examinations
25under this Section, excepting where the English language
26appears on facsimiles of road signs, may be given in the

1Spanish language and, at the discretion of the Secretary of
2State, in any other language as well as in English upon request
3of the examinee. Deaf persons who are otherwise qualified are
4not prohibited from being issued a license, other than a
5commercial driver's license, under this Code.
6    (c) Re-examination for those applicants who at the time of
7renewing their driver's license possess a driving record devoid
8of any convictions of traffic violations or evidence of
9committing an offense for which mandatory revocation would be
10required upon conviction pursuant to Section 6-205 at the time
11of renewal shall be in a manner prescribed by the Secretary in
12order to determine an applicant's ability to safely operate a
13motor vehicle, except that every applicant for the renewal of a
14driver's license who is 75 years of age or older must prove, by
15an actual demonstration, the applicant's ability to exercise
16reasonable care in the safe operation of a motor vehicle.
17    (d) In the event the applicant is not ineligible under the
18provisions of Section 6-103 to receive a driver's license, the
19Secretary of State shall make provision for giving an
20examination, either in the county where the applicant resides
21or at a place adjacent thereto reasonably convenient to the
22applicant, within not more than 30 days from the date said
23application is received.
24    (e) The Secretary of State may adopt rules regarding the
25use of foreign language interpreters during the application and
26examination process.
